AGENDA ITEM WORDING: A public hearing to consider a request for Administrative Relief for

ITEM BACKGROUND: A building permit was applied for on 2/18/2005 and a ROGO application
was applied for on 3/30/2005. The applicant applied for administrative relief on 7/16/2009 and is
within the allowable time frame to be eligible for administrative relief under Section 138-27 of the
Momoe County Code.
Staff recommends that administrative relief be awarded in the form of a purchase offer by the
Monroe County Land Authority.
Since the December 16, 2009 BOCC meeting, staff performed an evaluation of this site to make sure
the parcel is appropriately classified in the Tier System based on written policy (criteria) as amended
by the Department of Community Affairs final order DCA07-GM-166A.
PREVIOUS RELEVANT BOCC ACTION: The Board of County Commissioners continued this
item from the December 16,2009 meeting.

Dear Ms. Miriam Rodriguez:
Following the Board of County Commissioners (BOCC) meeting on December 16,2009,
we researched your site to determine the options you have available to you to achieve
building permit issuance as opposed to recommended purchase by Monroe County under
Section 138-27(f)(1) - Administrative Relief which indicates:
"(/) Board's action. At the conclusion of the public hearing, the board may take any or a
combination of the following actions:
(1) Offer to purchase the property at its fair market value as its preferred action if the
property is located within:
a. A designated tier I area;
b. A designated tier II area (Big Pine Key and No Name Key);
c. A designated tier III-A area (special protection area); or
d. A designated tier III area on a nonwaterfront lot suitablefor affordable housing.
(2) Grant the applicant an allocation awardfor all or a number of dwelling units requested in
the next succeeding quarterly allocation period or extended pro rata over several succeeding
quarterly allocation periods as the preferred action for buildable properties not meeting any of
the criteria in subsection (/)(1) of this section
(3) Suggest or provide such other relief as may be necessary and appropriate. ..
Currently your parcel is designated Tier 1. Under Section 130-130 (e) Tier Overlay district map
amendments (following), you have the option to request a Tier Map Amendment. In addition to
this option, your property is identified in Board of County Commissioner's Resolution 148-2006
directing Growth Management Staff to process request for amendments to the adopted tier overlay
map based on a request from the previous owner. Neither of these options guarantee a change to
the tier designation. The adoption and amendments to the Tier Overlay District Map will be in

accordance with procedures for amending the Land development Regulations. We are attaching a
summary of the existing (1) Tier Criteria for your infonnation, (2) Policy 105.2.1 and (3) Policy
205.1.1 from the Monroe County Comprehensive Plan, and (4) Chapter 130 of the Monroe County
Land Development Code. These are the official policies governing the Tier System and criteria
used to detennine which Tier category land is placed in.
Option to request a tier map amendment.
"Section 130-130 (e): Tier overlay district map amendments. The tier overlay district map
may be amended to reflect existing conditions in an area if warranted because of drafting or
data errors or regrowth of hammock However, the clearing of tropical hardwood hammock or
pinelands that results in the reduction of the area of an upland native habitat patch to less than
the one-acre minimum shall not constitute sufficient grounds for amending the designation of a
tier Ill-A area to tier 111. The tier overlay district map amendments shall be made pursuant to
the procedures for map amendments to this chapter. Unlawful conditions shall not be
recognized when determining existing conditions and regulatory requirements. "
This being said, because questions arose during the BOCC meeting on December 16. 2009 we
conducted an evaluation of your site under the Tier criteria referenced above and attached for
designation to see if staff could recommend an alternative Tier designation. We have determined
this parcel is appropriately placed in the Tier I category. The following table identifies the
analysis:

County Commissioners meeting in Key Largo and staff will maintain the recommendation for
purchase. based on a Tier I designation. according to Section 138-27(f)(l).
Additional infonnation relevant to the applicant but unrelated to the Tier System is the FEMA
Injunction List. There are a number of parcels identified on the FEMA Injunction List which may
not be able to obtain flood insurance. Your property is on the list, which means you may not be
able to obtain flood insurance. Therefore, if an allocation award is granted and a pennit is
subsequently issued, you may not be able to obtain flood insurance. Please note this has no
bearing on the Division's review for Administrative Relief or the Tier Designation.
If you are not able to come to agreement on purchase with the Monroe County Land Authority,
you will remain in the Rate of Growth Ordinance (ROGO) process and continue earning
perseverance points toward issuance of a building penn it.

Obiecttve 105.2
Monroe County shall implement with assistance of the state and federal governments a 20-year
Land Acquisition Program to: 1) secure for conservation and passive reaeation purposes
remaining private/y-owned environmentally sensitive lands; 2} retire development rights on
privately-owned vacant lands to Omit furlher sprawl and equitably balance the riQh1s of property
owners with the bng-tenn susfainabJlity of the Keys man-made and natural systems; and, 3)
secure and retain lands suitable for affordable housing, This objective recognizes the finite limits of
the carryfng capacity of the natural and man-made systems in the Aorida Keys to continually
accommodate further development and the need for the significant expansion of the pubic
acquisition of vacant developable lands and development rights to equitably balance the ngh1s and
expectations of property owners.
Policy 105.2.1
Monroe County shall designate all lands outside of mainland Monroe County~
except for the Ocean Reef planned development, into three general categories
for purposes of its land Acquisition Program and smart growth initiatives In
accordance with the crtteria in Policy 205.1.1. These three categories are:
Natural Area (Tier 1); Transition and Sprawf Reduction Area (Tier II) on Big Pine
Key and No Name Key only; and Infill Area (Tier III). The purposes, general
characteristics. and growth management approaches associated with each tier
are as fotlows:
1. Natural Area (Tier I): Any defined geographic area .where all or a
significant portion of the land area is characterized as environmentally
sensitive by the policies ,of this Plan and applicable habitat conservation
plan, is to be designated as a Natural Area. New development on vacant
land is to be severely restricted and privately owned vacant lands are to
be acquired or development rights retired for resource conservation and
passive recreation purposes. However, this does not preClude proviSions
of infrastructure for existing development. Within the Natural Area
designation are typically found lands within the acquisition boundaries of
federal and state resource conservation and park areas, including
isolated platted subdMsions; and privately-owned vacant lands with
sensitive environmental features outside these acquisition areas.
2. Transition and Sprawl Reduction Area (Tier II): Any defined geographic
area on Big Pine Key and No Name Key, where scattered groups and
fragments of environmentally sensitiVe lands, as defined by this Plan.
may be found and where existing platted subdivisions are not
predominately developed, not served by complete infrastructure facilities,
or not within close proximity to established commercial areas, is to be
designated as a Transition and Sprawl Reduction Area. New
development is to be discouraged and privately owned vacant lands
acquired or development rights retired to reduce sprawl, ensure that the
Keys carrying capacity is not exceeded, and prevent further
encroachment on sensitive natural resources. Within a Transition and
Sprawl Reduction Area are typically found: scattered small non-residential
development and platted subdivisions with less than 50 percent of the lots
developed; incomplete infrastructure in terms of paved roads, potable
water. or electricity; and scattered clusters of environmentally sensitive
lands. some of which are within or in close proximity to existing platted
subdivisions.

3. Infill Area (Tier 1/1); Any defined geographic area, where a significant
portion of land area fs not characterized as environmentally sensitive as
defined by this Plan, except for dispersed and isolated fragments of
environmentally sensitive lands of less than four acres In area, where
existing platted subdivisions are substantially developed, served by
complete infrastructure facilities, and within close proximity to established
commercial areas, or where a concentration of non-residential uses
exists, is to be designated as an Infill Area. New development and
redevelopment are to be highly encouraged, except within tropical
hardwood hammock or plneland patches of an acre or more in area,
where development is to be discouraged. Within an Infill Area are typically
found: platted subdivisions with 50 percent or more developed lots
situated in areas with few sensitive environmental features; full range of
available public infrastructure in terms of paved roads, potable water. and
electricity; and concentrations of commercial and other non-resk:lentlal
uses within close proximity. In some Infill Areas, a mix of non-residential
and high-density residential uses (generally 8 units or more per acre) may
also be found that form a Community Center.
Policy 105.2.2
Monroe County shall prepare an overlay map(s) designating geographic areas of
the County as one of the three Tiers in accordance with the guidance in Policy
105.2.1, which shall be incorporated as an overlay on the zoning map(s) with
supporting text amendments in the Land Development Regulations. These maps
are to be used to guide the Land Acquisition Program and the smart growth
initiatives in conjunction with the Livable CommuniKeys Program (Policy
101.20.1).
Policy 105.2.3
The priority for acquisition of lands and development rights under the County's
Land Acquisition Program shall be as follows: Tier I-{Natural Area)-first priority;
Tier /I (Transition and Sprawl Reduction Area) and patches of tropical harc/wOOc/
hammock or pinelands of one acre or greater in area within Tier III-second
prIority; and Tier III (Infill Arear third priority. except acquisition of land for
affordable housing shall also be a first priority. These acquisition prIorities shall
be applied consistent with the Policy 105.2.10 that directs the focus of the
County's acquIsition efforts to the acquisition or retirement of development rights
of privately owned vacant platted subdivision lots within Tiers I and II. Federal.
State and local funding will be used for purchasing privately owned vacant lands
for Tier II.
Policy 105.2.4
Monroe County shalf prepare a specific data base tied to its Geographic
Information System, containing information needed to implement, monitor. and
evaluate its Land Acquisition Program, smart growth initiatives, and Livable
CommuniKeys Program.
Policy 105.2.5
Monroe County shalf, in coordination with feeleral and state agencies. implement
a land acquisition program to acquire all remaining privately.owned vacant lands
within areas designated as a Natural Area (Tier I).

(b) Application. The Tavernier Creek to MUe Marker 97 U.S. Highway 1 Corridor Development Standards
and Guidelines are hereby adopted by reference and declarecf a part of this chapter. Within the overlay
district. as designated on the Tavernier Creek to Mile Marker 97 U.S. Highway 1 District Overlay Map'
uses permitted as. of right and uses requiring a minor or major conditional use permit shall be reviewed
based upon the Tavernier Creek to Mile Marker 97 U.S. Highway 1 Corridor Development standards
and Guidelines and approved if found in compliance with these standards and guideBnes.
(c) Amendment. The Tavernier Creek to Mile Marker 97 U.S. Highway 1 Corridor Development Standards
and Guidelines may be amended by resolutlon of the board of county commissioners upon recom-
mendatIon of the planning commission and the director of planning.

Sec. 130-129. Tavernier historic district overlay.
(a) Purpose. The purpose of the Tavernier historic district overlay is 10 implement the policies of the
comprehensive plan and Tavernier Creek to Mile Marker 97 Livable CommuniKeys Master Plan to
protect the historic resources of the community and to encourage development that is sensitive and
compa1ible with the historic character of the Tavernier historicdlstrict as identified through the Tavernier
Creek to Mile Marker 97 Livable CommuniKeys Master Plan.
(b) Application. The Tavernier HIstoric District Preservation Guidelines are hereby adopted by reference
and declared part of this chapter. Wrthin the overlay district, the county historic preservation commis-
sion shall review new development remocleUng or redevelopment of uses permitted as of right and
uses requiring a minor or major conditional use permit, based on the 1'avernier Historic District
Preservation Guidelines.
(c) An'Jendment The Tavernier Historic District preservation Guidelines m~ be amended by ~llJtion pf
the board of countycommTssioners uPon reconimenaation of tl1eplanning cOmmiSsion andfheCfirector
of planning.

Sec. 130-130. Tier overlay district.
(a) Purpose. The purpose of the tier overfay district is to designate geographical areas outside of the
mainland of the county, excluding the Ocean Reef planned development, into tiers to assign RaGO
al)d NROGO points, determilJS the amount of clearing of upland native vegetation that may be
permitted, and prioritize lands for pUblic acquisition. The tier boundaries are to be depicted on the tier
overlay district map. Lands on Big Pine Key and No Name Key shall be delineated as tier I, II, or 1/1.
Lands in the remainder of the unincorporated county. excluding the Ocean Reef planned development,
shall be delineated as tier I, III, and III-A (special protection area).

(f) Request fw tier I designation.
(b) Tier boundaries. Tier boundaries shall follow property lines wherever possible, except whel'8 a parcel
line or distinct geographical feature, such as a canal or roadway, may be more appropriate.
(c) TN boundary criteria, excluding Big Pine Key and No Name Kay.. The tier boundaries are designated
using aerial photography, data from the Florida Keys Carrying Capacity Study, the endangered species
maps, property and permitting information and field evaluation. The following criteria, at a minimum,
are used to evaluate upland habitats and designate boundaries between different tier overlays:
(1) Tier I boundaries shall be delineated to include one or more of the following ,criteria and shall
be designated tier I:
a. Vacant lands which can be restored to connect upland native habitat patches and
reduce further fragmentation of upland native habitat.
b. Lands required to provide an undeveloped buffer. up to 500 feet in depth, if indicated
as appropriate by special spec/es studies, between natural areas and development to
reduce secondary impacts. Canals or roadways, depending on width, may fonn a
boundary that removes the need for the buffer or reduces its depth.
c. lands designated for acquisition by public agencies for conservation and, naturaJ
resource protection.
d. Known locations of threatened and endangered species, as defined in section 101-1,
identified on the threatened and endangered plant and animal maps or the Florida
Keys Carrying Capacity Study maps, or identified in on-site surveys.
e. Conservation, native area, sparsely settled, and offshore Island land use districts.
f. Areas with minimal existing development and infrastructure.
(2) lands located outside of Big Pine Key and No Name Key that are not designated tier I shall be
designated tier III.
(d) Big Pine J<sy and No Name Key tier boundary criteria. The tier boundaries shall be designated usIng
the B;g Pine Key and No Name Key Habitat Conservation Plan (2005) and the adopted community
master plan for Big Pine Key and No Name Key.
(e) Tieroverlay district map amendments. The tier overlay district map may be amended to reflect existing
conditions in an area if warranted because of drafting or data errors or regrowth of hammock. However,
the clearing of trOpical hardwood hammock or pinelands that results in the reduction of the area of an
upland native habitat patch ,to less than the one-acre m inlmu m shall not constitute sufficient grounds for
amending the designation of a tier III-A area to tier III. The preceding sentence may not be relevant
since the one acre is not a criteria anymore pursuant to final order. The tier overlay district map
amendments sharr be made pursuant to the procedures for map amendments to this chapter. Unlawful
conditions shall not be recognized when determinIng existing conditions and regulatory requirements.
(f) Request for tier I designation. Notwithstanding the provisions of section 102-158(d)(2), any indMdUal
may submit an application to the plannIng department containing substantial and competentdocumen-
tation that an area meets the tier I criterla. Applications must he received by July 1 of each year 'on- a
form approved by the director of planning for consideration by the special magistrate at a public hearing
advertised at least 15 days prior to the hearing date. Said hearing by the special magistrate shaU be
held prior to November 1 of each year. The director of planning will review the documentation and any
other appropriate scientific information and prepare an analysis report for the special magistrate. The

3 Eligibility for Administrative Relief Options:
4 Section 138-27 of the Monroe County Land Development Regulations and Policy 101.6.1 of the
5 2010 Comprehensive Plan provides a mechanism whereby an applicant who has not received an
6 allocation award in the ROGO system may apply to the Board of County Commissioners for
7 Administrative Relief. The applicant is eligible for Administrative Relief having complied with
8 all requirements of the dwelling unit allocation system and having been considered in at least the
9 first sixteen consecutive quarterly allocation periods, and not having received an allocation
10 award. The application was timely submitted for administrative relief in the form of one (1)
11 ROGO allocation award and the applicant has not expressed a desire to sell the property to the
12 County.

14 Environmental Information:
15 The property is located in Tier 1 and the habitat evaluation index (HEI) submitted with the
16 application indicate that the parcel is vegetated with biota indicative of tropical hardwood
17 hammock and the elevation indicates high hammock variety, but is rated low in quality. The
18 number of native plants is indicative of moderate diversity, consisting of 22 native woody
19 species. According to correspondence from the U.S. Fish and Wildlife Service the hammock
20 could serve as habitat for several threatened and endangered animals, however the map of
21 protected species does not indicate that any listed species are known to utilize the property.
22 There is connectivity through adjacent undeveloped lots to a much larger hammock to the north.
23
24 The parcel is bounded by undeveloped, vegetated properties to the north. The properties to the
25 south and the west are developed and to the east a paved roadway, Indies Road. The parcel to the
26 north is undeveloped and a conservation lot owned by the Monroe County Land Authority. The
27 2009 Habitat Maps show the property as hammock and the adjacent parcels as developed.

29 Tier Designation Criteria:
30 Comprehensive Plan Policy 205.2.1 states "Monroe County shall designate the boundaries of the
31 overlay tier system based on the criteria in Policy 205.1.1."

33 Pursuant to Comprehensive Policy 2051.1(1) lands located outside of Big Pine Key and No
34 Name Key the minimum criteria for Tier 1 is:
35
36 . Natural areas including old and new growth upland native vegetated areas, above 4 acres
37 in area.
38 . Vacant land which can be restored to connect upland native habitat patches and reduce
39 further fragmentation of upland native habitat.
40 . Lands required to provide an undeveloped buffer, up to 500 feet in depth, if indicated by
41 appropriate special species studies, between natural areas and development to reduce
42 secondary impacts; canals or roadways, depending on size may form a boundary that
43 removes the need for the buffer or reduces its depth.
44 . Lands designated for acquisition by public agencies for conservation and natural resource
45 protection.
46 . Known locations of threatened and endangered species.

2 Map or within a buffer/restoration area as appropriate.

5 Pursuant to Monroe County Code Section 130-130(b) Tier boundaries shall follow property lines
6 wherever possible, except where a parcel line or distinct geographical feature, such as a canal or
7 roadway, may be more appropriate.

9 Pursuant to Monroe County Code Section 130-130(c)(1) Tier 1 boundaries shall be delineated to
10 include lor more of the following criteria and shall be designated tier 1:
11
12 a. Vacant lands which can be restored to connect upland native habitat patches and reduce
13 further fragmentation of upland native habitat.
14 b. Lands required to provide an undeveloped buffer, up to 500 feet in depth, if indicated as
15 appropriate by special species studies, between natural areas and development to reduce

21 identified on the threatened and endangered plant and animal maps or the Florida
22 Carrying Capacity Study maps, or identified in on-site surveys.
23 e. Conservation, native area, sparsely settled, and offshore island land use districts.
24 f. Areas with minimal existing development and infrastructure.

26 The native upland habitat community on the parcel may serve as habitat for several threatened
27 and endangered species. Though the current map of protected species does not indicate specific
28 use of this parcel, the species occurrence maps do show utilization by multiple species within the
29 hammock to the north. The subject parcel provides connectivity through the adjacent county
30 owned parcel to this larger hammock.

32 Tier 1 limits regarding allocations:
33 Monroe County Code Section 138-24(a)(6) limits on the nwnber of allocation awards in Tier 1.
34 The annual nwnber of allocation awards in Tier I shall be limited to no more than three (3) in the
35 Upper Keys. We are in ROGO Year 18, which began July 14,2009 and will end July 12,2009.
36 To date no allocations have been made in ROGO Year 18.

38 Relief Options under Administrative Relief:
39 The remedies available to the Board of County Commissioners for Administrative Relief
40 pursuant to Section 138-27 include:
41
42 a. Offer to purchase the property at its fair market value as its preferred action if the
43 property is located within: a) a designated Tier I area; b) a designated Tier II area
44 (Big Pine Key and No Name Key); c) a designated Tier III-A area (Special
45 Protection Area); or d) a designated Tier III area on a non-waterfront lot suitable
46 for affordable housing.

b. Grant the applicant an allocation award for all or a number of dwelling units
requested in the next succeeding quarterly allocation period or extended pro rata
over several succeeding quarterly allocation periods as the preferred action for
buildable properties not meeting any of the criteria in (1) above.
c. Suggest or provide such other relief as may be necessary and appropriate.
In the event purchase is recommended and the owner refuses the purchase offer, the
applicant may remain in the ROGO System and continue earning perseverance points
according to Monroe County Code Section 138-28.
IV. RECOMMENDATION
It is recommended that the Board of County Commissioners find that the applicant has met the
criteria and qualifies for Administrative Relief. It is further recommended that a Resolution be
adopted that establishes this relief by an offer to purchase by the Monroe County Land
Authority.

WHEREAS, Miriam Candy Rodriquez submitted an application for
administrative relief under Sec. 138-27 of the Monroe County Land Development
Regulations; and
WHEREAS, the Monroe County Board of County Commissioners makes the
following findings of fact and conclusions of law:
1. The application for administrative relief from Miriam Candy Rodriquez
is for Lot 8, Block 9, Harris Ocean Park Estates 1st Addition, Key Largo
in Monroe County, Florida having RE# 00450150.000000.
2. The date of the ROGO application is 3/30/2005.
3. The ROGO allocation application has been in the ROGO system for at
least four (4) consecutive years and qualifies for administrative relief
under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive
Plan.
4. Monroe County Code (MCC) Section 138-27 provides a mechanism
whereby an applicant who has not received an allocation award in
ROGO may apply to the Board of County Commissioners for
administrative relief.
5. The Board of County Commissioners (BOCC) has the authority to grant
administrative relief under Section 138-27(f) and may grant the
applicant a building allocation, offer to purchase the property at fair
market value, or provide such other relief as may be necessary and
appropriate.
6. The applicant applied for administrative relief on 7/1612009, under
Section 138-27 of the MCC and Policy 101.6.1 of the 2010
Comprehensive Plan.
7. Policy 101.6.5 of the 2010 Comprehensive Plan provides criteria to be
used for determining lands that are appropriate for acquisition and the
criteria includes the environmental sensitivity of the vegetative habitat
on the lot and the applicable Tier designation.

8. The subject property has the land use district designation of Improved
Subdivision (IS), is located in the Harris Ocean Park Estates Ist
Addition and is located in a Tier 1 designated area.

INTRODUCTION: Pursuant to your directive the above referenced parcel was reviewed as a
habitat analysis. All parcels listed as 426 (Tropical Hardwood Hammock) on the existing
conditions map require that a habitat analysis be performed and that an evaluation index (HEr) be
computed. The subject parcel is of the high hammock variety.

SITE AND PROJECT DESCRIPTION: The site in question was inspected with Alex Score
assistingltraining on 6-29-2004 and resulted in the following: The site is bordered on the north and
south by vacant wooded lots, the west by a cleared lot with a house and the east by a paved
roadway, West Indies Road. Thepg!ja".kU.etate.d with biota indicative oftro'pica1 hardwood
hammock and the elevation indiCates high hammock variety.
The HEr was performed and submitted by Marcella Nemec for this lot, with the addition of I
native vine species (Fuzzy Passionflower vine) and 2 exotic herbs (purple Oysterplant and African
Orchid) species and no change in points, I agree with her findings. The species diversity is
moderate, consisting of 22 native woody species. There are 4TIEIRI plants on the lot, 3 very rare
Princewoods, Milkbark, Mahogany and Inkwood, with a density of over six per acre calculated.
The hammock could serve as habitat for several TIE animals, however none were seen by Alex,
Marcella or myself and the site is not mapped habitat. We looked for Liguus tree snails, but saw
none. There were several exotic species present, African Orchid, Spiral Plant and PUlple
Oysterplant, but no class one exotics. Less than 5% of the site was invaded. The size ,of the parcel
is small, only 51 OOsquare feet. The entire parcel appears relatively uniform in sensitivity.
RECOMMENDA nON: The hammock was rated as low in quality. The open space ratio is .40,
which will allow 3060 square feet to be cleared, including the construction imp.act area of five feet
width measured from the dripline or furthest extension of the house. A site pre~tion permit
should be issued and the clearing and construction barriers field checked prior to validating
the construction permit. All non-native plants should be removed from the open spacelhammock
preserve areas of the site. A transplant plan must be submitted for TIE and Rare plants, as well as
allY trees 4" or greater that will be removed for construction. The conservation easement deed
restriction must be recorded before the C. O. is issued. This deed restriction will prevent future
owners from damaging the required open space areas, where native vegetation is to remain in its
natural state forever.
TIME EXPENDITURE: Not applicable, approximately 0.75 hours on site.

Thank you for your request for technical assistance with the Fish and Wildlife Service (Service)
on the proposed construction of a single-family residence. The project is located at 231 West
Indies Road, Lot 8, Block 9t Hanis Ocean Park Estates Subdivisio~ Key !.argOt Monroe County,
Florida. This letter corrects an incorrect Block number and supercedes our letter dated
November 5,2004. The Real Estate number for Lot 8, Block 9 is 004S01So..000000.
Site descriDtion
The vegetated, undeveloped lot is bounded by West Indies Road to the east, developed lots to the
south and weS4 and an undevelopedt vegetated lot to the north. According to the June 2004
Habitat Analysis you submittedt 24 native plant species are present onsite, including one State~
threatened and two State-endangered plants.
Effects AnalYSis
The number of nath.e plants recorded. 24, is indicative of moderate diversity. The native plants
documented include wild coffee (Psychotria nervosa)t wild lime (Zanthoxy/umfagara), and
yellowroot (Morinda royoc)t the three of four species preferred by the federally and S18te-
endangered Schaus swallowtail butterfly (Heraclides aristodemus ponceanus) for breeding and
feeding. Woody plant species favored by the State-threatened Florida tree snails (Liguus
fasc;atus) were observed, including wild tamarind (Lysiloma latisiliquum) and Jamacia dogwood
(Piscidia piscipula). However, the site is not shown on the Service's Geographic Infonnation
System database as potential habitat for the Schaus swallowtail butterfly~ the federally threatened
and State-endangered Stock Island tree snail (Orthalicus reses), or the State~threatened white-
crowned pigeon (Columba leucocepha/a) and the Florida tree snail (Liguusfasciatus). There is
connectivity through adjacent undeveloped lots to a much larger hammock to the north. Tree
snails were sought during the habitat survey, but none were observed.

Because there is potential for the site to provide habitat for the above listed species. the county
bas imposed the following conservation measures: all non-native plants will be removed, all
native plants displaced by construction will be transplanted, a transplant plan must be submitted
for review. and a conservation deed easement restriction will be placed on the remainder of the
property occupied by native vegetation. The Service encourages and supports these measures.
Determination
The Service believes. based on the infonnation you submitted for the county's pennit
requirement and our review. your project is not likely to significantly increase adverse risk to any
federally listed threatened or endangered species or critical habitat.
Please note that Service review of this project in no way implies compliance with other Federal,
State. COWlty, or municipal regulations. It is the applicants' responsibility to ensure that the
project meets all applicable regulations. If modifications are made to the project. if additional
infonnation involving potential effects to listed species becomes available, if a new species is
listed, or if designated critical habitat may be adversely affected by the project. reinitiation of
technical assistance may be necessary.
