ITEM BACKGROUND: The Marine Resources Office has operated a vessel pumpout boat in the Key Largo area since 2005. In an effort to evaluate the availability of pumpout facilities in other areas of the Keys staff has generated an inventory of existing land -based and mobile pumpout facilities. Although the inventory indicates extensive facilities coverage throughout the Keys, several gaps in service areas have been identified as well as a wide range of pumpout costs based on service providers. In an effort to provide for a more effective pumpout program, expand the service area, and ensure a nominal cost for pumpouts staff has developed Options I, II and III for the Board to consider for the future provision of pumpout service. Due to a variety of challenges associated with the operation of the pumpout program, including logistical and infrastructural issues as well as staff resource limitations, staff is evaluating alternative means of providing services. The fiscal year 2010-11 budget includes funding to increase vessel pumpout services. There are a variety of ways the County can accomplish this. The following three options are provided for the Board to consider regarding the future operation and management of the pumpout program, and the budgeted increase in pumpout services. Option I- In-House Services. The following budget breakdown indicates the anticipated net cost to the county to establish two pumpout vessels and captains which would allow continued service in the Key Largo, and provide for expansion of the current service area. Description Costs Salary &Wages (loaded): Two Pumpout Captains $105,529 Management (10 hrs /week) $20,000 Sub -total $125 Operating costs: Repair and maintenance $21 Misc. expenses $20 Operating supplies $2 Fuel $18 Internal fuel $6 Sub -total $67,100 Capital Outlay (cost/yr over 5 yrs): Vessel /trailer (2) * $12 Tow Vehicle (2) $8 Sub -total $20 Pumpout charges ($5 per pumpout) Total $213 Revenue = Net Yearly Cost $4,000 $4,000 Option II- out - Sourcing of Services $209,529 The Board would direct staff to develop and advertise a Request for Proposals (RFP) to contract pumpout services with a qualified vendor or vendors. The service area would cover the upper Keys area, or other geographic areas of the Keys based on the discretion of the Board. Staff is prepared to develop an RFP for retaining the services of a vendor or vendors to provide pumpout service based on the direction of the BOCC, and within budget constraints. * assumes approval of Clean Vessel Act grant with County match of $31,250 each for vessels costing $125,000 Option III- Services to be Provided by a Non - Profit organization The Board would approve financial support to a non - profit organization requesting such support for the provision of pumpout services in the upper Keys area, or other geographic area of the Keys based on a prop osal/request by the organization. Staff has been approached by the National Marine waste Foundation which is partnering with Mote Marine Laboratory to establish a pumpout program for providing free pumpout service to boaters in Monroe County. Staff Recommendation: Staff recognizes that daily operations, infrastructural and logistical issues, and education/outreach to marina patrons and anchor -outs may be more efficiently and effectively provided by the private or non- profit sector. By privatizing pumpout services, or supporting a non-profit, the following benefits can be realized: • No need to supervise Pumpout Captains • No benefits packages • No need to manage infrastructural issues • No need to expend time and resources on hiring procedures • No need to write and manage grants to fund operational costs • Complaints would be addressed (primarily) by vendor or non- profit • Staff could continue to focus on primary services • Elimination or reduction of liability • County could easily expand, reduce, or eliminate services as desired Staff recommends investigating Option III to determine its viability. If not successful with Option III staff recommends pursuing Option II to determine if afor- profit or non -profit can provide services at a cost equal to, or lesser than, Option I. Inventory of Liveaboard Anchorages And Current Pumpout Service Providers In The Florida Keys (revised September 20 10) The following information lists various liveaboard anchorages in the Florida Keys, describes existing pumpout services, and illustrates the proximity of liveaboard anchorages to those pumpout services. Liveaboard Anchorages in the Florida Ke s The Keys -Wide Mooring Field System Preliminary Planning Document generated by the Marine Resources Department in 2002 recognized fifteen anchorage sites from Key Largo to Key West (Diagram 1 below). The sites were characterized by their use and general boating impacts. Services include both land -based and mobile pumpout services, and are both privately and publically owned and operated. The following sections describe the services available, their locations and distribution throughout the Keys. Land -Based Pumpout Services Land -based pumpout facilities include services that are open to the public and those that are provided exclusively to the guests or residents of the facilities. The tables below list those facilities and contain the best available information to date. The following marina facilities provide pumpout services for the exclusive use of their guests and residents. Facilities listed include condominiums and resorts, private marinas, municipal marinas, as well as state and federal facilities. The Florida Boating Access Facilities Inventory and Economic Study, developed by the Florida Fish & Wildlife Conservation Commission in 2009, indicates that Monroe County has the highest percentage of marinas offering pumpouts in the state. The following data indicates the percentage of anchored vessels in each sub -area which currently can be served by existing mobile pumpout providers. While several of the anchorage sites are not located within the range of an existing mobile pumpout service provider, those anchorages typically contain few vessels. NELSON DOCUMENTATION: Included x To Follow Not Required DISPOSITION: AGENDA ITEM # -- b Pump Out Vessel and Support System for the Upper Keys Presented to Monroe County Board of County Commissioners by Monroe County Sheriff's Department Sector 7 Zone 1 Citizens Advisory Council May 19, 2004 Pump Out Vessel and Support System for the Upper Keys Introduction The Monroe County Sheriffs Department Sector 7, Zone 1 Citizens Advisory Council is requesting that Monroe County address the need for a Pump -out Vessel and Support System in the Upper Keys. We are asking our County Commissioners to consider the recommendations brought before you by the Citizens Advisory Council and adopt a plan that will expedite a solution to this problem. The Advisory Council is comprised of the Monroe County Sheriffs Department Zone Commander, Sgt. Lou Caputo, and seven volunteer members from the community living within the zone. Formed approximately five years ago, the purpose of the advisory council is to address public concerns for regulatory improvements, crime intervention and public safety. The advisory Council meets once a month and has been successful in assisting the community to address problems that arise in our local area. Problem Since October 2003 the Advisory Council has primarily focused on Florida's No Discharge regulation and our near shore water quality. Representatives from several agencies visited the monthly meetings to discuss the issue and assist in identifying a solution to the problem of illegal raw sewage being discharged into the near shore waters of Monroe County. In the Upper Keys there is a growing population of live- aboard boaters. These boaters often live on vessels that no longer move or they stay at marinas where there are no pump -out facilities. Identified sources include: 1. on an average there are 200 — 300 moored vessels in the near shore waters off Key Largo, with 70% of those recently contacted by an Inter- agency task force were found in violation of the No Discharge Zone established by the State of Florida on June 19 2002; and 2. Insufficient pump -out facilities in the Upper Keys Solutions The Advisory Council feels that the solution is three fold: 1. Education 2. Pump out Vessel and Support System 3. Enforcement Monroe County Sheriff's Department Sector - Zone 1 C:itlzens Advisory Col €nu ; George Garrett and Rich Jones from the Monroe County Department of Marine Resources attended several meetings. The exchange of information has been instrumental in helping the advisory council to identify solutions such as grant money that is available to install pump -out facilities or to purchase a vessel that can pump out holding tanks. The advisory council has been able to facilitate discussions with local marina owners and look for land based pump -out stations. Land based pump - out stations are part of the overall solution and are necessary to fulfill the needs for the requested pump -out vessel and proposed mooring fields around the island of Key Largo. As a result of the advisory council's meetings a multi - agency task force formed together with the Monroe County Sheriffs Department that included the Department of Environmental Protection's Southeast District Bureau of Florida Park Police, Florida Fish and Wildlife Conservation Commission (FWC) and FWC's Sanctuary Patrol. On February 2e the task force visited anchorages around the Upper Keys handing out education packets, checking sanitation devices and safety equipment. Additionally the advisory council contacted Lisa Corey, Monroe County Public Outreach Coordinator on the No Discharge Zone and was able to connect her with local marina owners that expressed an interest in applying for grant money to install land based pump -out stations. Summary The concept of a Pump Out Vessel and Support System for the Upper Keys is widely accepted. The Advisory council has received overwhelming support in the form of letters from bordering State and Federal Agencies that include Everglades [National Park and John Pennekamp Coral Reef State Park. We have received letters from private citizens, homeowners associations, community crime watch groups and private marinas as well as Resolubons from both the Sanctuary Advisory Council and the Monroe County Marine and Port Advisory Committee. The issue is not new, however the problem is growing faster than we are finding a solution. We urge our County Representatives to move forward with a solution to this problem. Officers from the Park Ser- vice, Florida Fish and Wildlife Commission, the Sanctuary and the Monroe County Sher- iff's Office manned seven boats and caftewd boaters to check for violations and to hand out educational material. When the operation was over, they had contacted 70 bouts between Jewfish Creek and Tavernier Creek, on both the ocean side and bay side of the upper Keys. "Our goal was to let people know what the law says about safety and sanitation," said Monroe County Sheriff's Sgt. Lou Caputo. "We asked each boater if we could board the vessel and check iL Everyone we talked with gave us permission to board. "Once on board, * we checked all their safety equip- ment and checked to make sure sanitation equipment was properly installed and operat- ing," he said. The gmup handed out 13 warnings and 11 citations. One person was arrested and charged with boating under the influence of alcohol. The citations were almost exclusively handed out to boats that were pumping waste directly into the water without any sanitation equip- ment at all, spokesmen said. All the boats were given a packet of information in a waterproof fag. Caputo said that this type of operation would take place regularly. Regarding the "pump out" issue, he has seen a problem and has contributed a lot of his personal time to help solve it. We could use more of that around here, It seems to me that he is also solving a law - enforcement issue at the same time. With the law on the books, but no way for boaters to "do the right thing," it has been impossible and impractical for the different agencies to do their part to enforce the "no discharge" laws. Sergeant Caputo's efforts help the community by solving a water quality problem, by working to provide a much - needed service that works to that end, and by making it possible for the other law enforcement agencies to do their part. In any case, Sergeant Caputo is a terrific ambassador for your office, and his work on this and other community issues is appreciated.
