Item W3 BOARD OF COUNTY COMMISSIONERS AGENDA ITEM SUMMARY ADD ON Meeting Date: November 20,2002 Division: County Attorney AGENDA ITEM WORDING: Report and direction for acquisition of Shrimp Road on Stock Island. ITEM BACKGROUND: Safe Harbor Enterprises, Inc. owned by the Bernstein family, has agreed to quitclaim to the County its right in the land under the portion of Shrimp Road not previously conveyed in connection with Bernstein Park. A survey of Shrimp Road established that part of the roadway (near the curve approaching Robbie's Marina) was not owned by Safe Harbor, but by Edward Knight and David Wolkowsky. The County Attorney's office has inquired of Mr. Knight (the majority owner) whether he would be willing to quitclaim the strip of land needed to complete the acquisition of the road by Monroe County. He responded with an inquiry whether the County would be willing to buy that strip. Legal staff is of the opinion that the public has already acquired a prescriptive easement in the roadway, by long use (decades). Therefore, the value of the strip to be acquired is minimal. Staff needs direction from the BOCC before proceeding further toward acquisition of the remaining strip of roadway.
