ITEM BACKGROUND: The FDEP is allowing the County to repair the Blimp Road boat ramp. In order to do so the County must enter into the attached "Agreement to Maintain Public Access and Operate Ston-nwater System Form 62-330.900-1. This agreement is a standard form required by FDEP, even though there is no stromwater system at this site. The County agrees and acknowledges its obligation that the boat ramp shall remain open to the public, be operated and maintained for the life of the facility, and the County will abide by Florida Administrative Code 62-330.417. The County is currently under contract with T.Y. Lin International/J.H. Ross for the design through construction administration for the repair of the Cudjoe Key boat ramp on Blimp Road. PREVIOUS RELEVANT BOCC ACTION: On May 16, 2012, the BOCC approved a Task Order with T.Y. Lin International/HJ Ross for professional design services for the repair of the existing boat ramp on Blimp Road on Cudjoe Key. On September 21, 2012 the BOCC approved a First Amendment to the Task Order deleting the completion date of August 31, 2012. Permittee and the Department hereby agree as follows: 4:� 1. On November 6, 2012, the Department verified that Permittee qualified to use Noticed General Permit Rule 62-330.417, Florida Administrative Code, (F.A.C.) (DEP File No. 44- 0314539-001, hereinafter referred to as the "Permit"), authorizing the construction of an open -to - the public boat ramp, at the real property described as follows: See Attached Exhibit "A." 2. Permittee agrees and acknowledges its obligation that the boat ramp facility shall remain open to the public for the life of the facility in accordance with Rule 62-330.417, F.A.C. 3. The requirement described in paragraph 2 above is enforceable by the Department using the remedies provided by Chapters 120, 373, and 403 of the Florida Statutes. 4. This agreement runs with the land and is binding upon Permittee, its successors and assigns. 5. The stormwater treatment system authorized in subsection 62-330.417(5), F.A.C., must be operated and maintained for the life of the facility by Permittee, its successors or assigns, in accordance with all the terms and conditions of Rule 62-330.4171, F.A.C. 6. Permittee agrees that at least sixty (60) days before it transfers or sells the boat ramp facility to any entity it shall submit a request to the Department to transfer the Permit to the new owner, and advise the new owner of the requirement to obtain a transfer of the permit. Until transferred the local government shall remain responsible for the operation and maintenance of the facilities.
