ITEM BACKGROUND: The Pigeon Ivey Foundation has requested BOCC approval to host a sheet shooting event on the island. The BOCC by this Resolution gives approval conditioned upon the following: a. clearance from the Department of Environmental Protection, b, coordination of event with the local Monroe County Sheriff's Office to insure all proper safety pre -cautions are taken, and c. a "hold harmless" certificate from both the Pigeon Ivey Foundation and the entity producing the event, holding Monroe County harmless in the event of any liability occurring, and d. an insurance certificate naming Monroe County as co-insured for the event producer is obtained. OF COUNTY CONQ�HSSIONERS OF MONROE COUNTY, FLORIDA, IN SUPPORT OF A SKEET SHOOTING EVENT BEING HELD ON PIGEON KEY. VnMREAS, Monroe County owns an island known as Pigeon Key, which was used in the 1900's as part of the Flagler Overseas Railroad, and later used for a toll gate and toll -keepers residence, establishing routine land -based travel throughout the island chain and providing historical significance for the Florida Kegs; and WIHEREAS, Monroe County currently leases the island to the Pigeon Key Foundation for purposes of preservation and operations for tourist, cultural, historic, and educational activities; and VVHEREAS, the Pigeon Key Foundation has requested approval of their hosting a skeet shooting event on the island; and WHEREAS, the US Environmental Protection Agency and the Florida department of Environmental Protection regulate skeet shooting ranges and/or the discharge of ammunition into areas of environmental sensitivity; and WBEREAS, Monroe County is designated as are Area of Critical State Concern due to the many environmental attributes, and a rational marine Sanctuary has been established encompassing the Florida Keys; NOW, THEREFORE BE IT RESOLVED by the MONROE COUNTY BOARD OF COUNTY COMMISSIONERS that: 1) The COUNTY approves a skeet shooting event being held on Pigeon key, conditioned upon the following: a) Clearance from the Florida Department of Environmental Protection; b) Coordination of event with the Sheriffs Office to insure that all pre -cautions are taken to avoid any potential danger to passersby, whether by vehicle on the 7 Mile Bridge; pedestrians on the Old 7 Mile Bridge, or people in passing boats; c) A Hold Harmless certificate from both the Pigeon Key Foundation and any entity producing the event specific to the event, holding Monroe County harmless from any liability which might be incurred in the course of the event; d) A certificate showing insurance coverage for the event producer naming Monroe County as a co-insured. 2} The County Clerk shall forward a copy of this resolution to Sherdff Bob Peryam.
