Discussion and presentation regarding status of BP oil spill claim; approval to file lawsuit to recover
damages arising out of the Deepwater Horizon Oil Spill.
ITEM BACKGROUND: In November 2012, the BOCC approved the hiring of a consortium of firms
led by the local Campbell & Malafy firm to represent the County in filing a claim in connection with
the Deepwater Horizon Oil Spill claims process for local governments and gave approval to the film
of the County s claim. The claim was filed on January 13, 2013. Under the Oil Pollution Act, BP has
ninety days from the date we submitted the claim to the BP Government Claim Program to render a
decision (accept the claim, deny the claim, or simply no response). Any lawsuit must be filed by the
County no later than three years from the date of the original incident, or by 4/19/2013. The
consortium of firms representing Monroe will provide a summary of the claim, including a description
of potential recovery, and a recommendation on whether to file litigation (contingent on BP's
response), and if so, in which venue.
PREVIOUS RELEVANT BOCC ACTION: November 2012, award of contract to consortium of
firms including Campbell & Malafy law firm to represent the County in filing claim, and approval to
file the claim.
