ITEM BACKGROUND -
The applicant has requested a special permit to utilize the subject property for a temporary construction
staging area. The staging area would facilitate a canal restoration/water quality improvement project
being carried out by Monroe County.
If approved, the expected commencement date of the staging area is March 1, 2015 and shall expire
March 1, 2016.
PREVIOUS RELEVANT BOCC ACTION:
At the December 10, 2014 meeting, the BOCC approved an ordinance establishing §6-3 of the Monroe
County Code, which provides the approval process for temporary construction staging areas with a
special permit granted by the BOCC. (Ordinance 0 18-2014)

WHEREAS, an application was filed for a special permit allowing a temporary
construction staging area at a property on Witters Lane, Big Pine Key, approximate mile marker
31 (Florida Bay side of the Overseas Highway); and
WHEREAS, the property is legally described as Block 1, Lot 48, Doctors Area
Subdivision (Plat Book 3, Page 141), having real estate (RE) Number: 00310490.000000; and
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
grant the special permit allowing a temporary construction staging area; and
WHEREAS, S, the temporary construction staging area would facilitate a canal
restoration/water quality improvement project being carried out by Monroe County; and
WHEREAS, due notice has been carried out and a public hearing has been held in
accordance with Monroe County Section 6-3; and
WHEREAS, .A,S, at said public hearing, the Board considered the argument of all parties
present wishing to speak on the matter; and
WHEREAS, the Board makes the following Findings of Fact and Conclusions of Law:
1. The temporary construction staging area is not inconsistent with any of the criterion
provided in Monroe County Code §6-3;

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MO ROE COUNTY, FLORIDA, that the preceding Findings of
Fact and Conclusions of Law support its decision to approve the request for a special permit,
subject to the following conditions:
1. The temporary construction staging area shall only be used in association with the canal
restoration project for Canal #266 on Big Pine Key.
2. The expected commencement date of the temporary construction staging area is March 1,
2015, The termination date of the temporary construction staging area shall be no later
than March 1, 2016.
3. Other than fencing, no temporary structure associated with the temporary construction
staging area shall be located in any required setback.
4. Upon termination of the temporary construction staging area, the property shall be
restored to its prior condition.

29 The BOCC has the authority to approve temporary construction staging areas in accordance
30 with MCC §6-3. A special permit may be granted by resolution by the BOCC to allow a
31 property to be used as a construction staging area for an off -site project. The BOCC shall
32 hold a public hearing on the request for a temporary construction staging area and shall issue
33 a resolution granting, granting with conditions or denying the request. The resolution shall
34 take effect on the date of enactment by the BOCC.

36 Applicability. A temporary construction staging area for all off -site project is a permitted
37 activity in any land use (zoning) district, provided it is approved by a special permit and
38 meets the criteria set forth in MCC §6-3. This special pen -nit shall approve the temporary
39 construction staging area location and use and shall not override or substitute for any other
40 provision of the Florida Building Code and Monroe County Code that require an additional
41 type of building pen -nit, certification or approval.

43 Criteria. Approval of such a special permit shall be granted only if the following criteria are
44 met:
45
46 (1) The temporary construction staging area shall serve a project being carried out in the
47 vicinity of the construction staging area: In compliance.

49 The proposed staging area is adjacent to the canal (Canal #266) which is subject to the
50 canal restoration project.

(2) The temporary construction staging area shall serve a project being carried out by a
goveninriental agency: In carnpliunce.
The canal restoration project is being carried out by Monroe County, Florida.
(3) The temporary construction staging area shall not be located in a tier I designated area: In
compliance.
The proposed staging area would be located on a property that is in a tier 11 designated
area.
(4) The property subject to the request shall be posted and surrounding property owners
within 300 feet shall be notified in writing at least 15 days prior to the BOCC public
hearing, with the notice located so it shall be easily visible from all public streets and
public ways abutting the property: Compliance to be determinedprior to public hearing.
Planning & Environmental Resources Department staff shall carry out the notification as
required.
(5) Prior to establishment of the temporary construction staging area, a special building
permit approving any associated temporary structure shall be issued in accordance with
MCC §6-112. In compliance.
The proposed staging area will not have any structure requiring a building permit.
(6) No clearing or filling shall occur to accommodate the temporary construction staging
area: In compliance.
The proposed staging area would be located on a property that is predominately scarified.
No clearing or filling shall occur to accommodate the staging area.
(7) Other than fencing, no temporary structure associated with a temporary construction
staging area shall be located in any required setback: In compliance,
According to the plans submitted with the application, other than fencing, no structure or
storage would be located in a required setback.
(8) The temporary construction staging area shall be compatible with existing uses on
surrounding properties, as determined by the BOCC. If necessary, prior to issuance of a
special permit allowing the temporary construction staging area, the board may attach
conditions to any special permit approval to a) avoid substantial harm to public health or
safety; b) avoid substantial harm to, or impairment of the normal use of, a public place;
and/or c) avoid substantial harm to the environment. Depending on the nature and
anticipated duration of the use, as a condition of approval to the special permit, the board
reserves the right to: a) Provide a deadline for termination of the construction staging
area; b) Limit the hours of operation; c) Limit the type of equipment and materials on the

site; d) Require fencing, landscaping and/or other screening to limit potential visual and
noise impacts of the use on adjacent property owners; and e) Require surface water
management improvements to the affected site: In compliance.
The BOCC reserves the right to attach such conditions to any special permit approval at
the February 18, 2015 public hearing.
(9) The property shall be restored to its prior condition: Compliance to be determined upon
termination of the staging area,

Lot 48 Witters, Lane Shearin Property Proposed Staging Area
Description of Project: This project is part of the Water Quality Improvement Program being
funded by Monroe County for Canal Restoration Demonstrations. The purpose of the project is to
hydraulically vacuum dredge the accumulated weed rack along the bottom of the unnamed
manmade canal located between Baileys and Witters Lanes in Big Pine Key, Florida to a maximum
depth of -10.4 feet Mean Low Water. Due to weed rack loading and lack of flushing, a layer of
decomposing weed rack (organic muck) has accumulated along the bottom of the canal which
consumes oxygen and prevents the inhabitance of fish or other marine organisms. The project
entails hydraulically removing the organic muck layer within the canals to the limestone bottom to
promote a viable benthic community. Six inches of sand will be placed on the limestone canal
bottom after dredging to assist in promoting seagrass growth. N
Commencement and Termination Dates of Construction Staging Area: Feb-9, 2015 through
2015
Hours of Operation: 8 AM— 6 PM Monday through Friday
Types of Equipment and Materials to be stored in Staging Area:
1. Geotubes placed in Roll off containers
2. Piping that will contain the extracted muck extending from the canal to the property
Additionally, trucks and other equipment will need to enter the property to place and remove the
Roll off containers but will not be stored on site.
Proposed Fencing, Screening or Landscaping: A temporary construction fence consisting of 6
foot high chain link fence with canvas privacy screening will be placed around the perimeter of the
staging area.
Any Proposed Surface Water Management Improvements: The Contractor will be required to
implement best management practices within the staging area to control all storm water runoff. The
Contractor will provide a final Erosion and Sediment Control plan based upon the Sediment and
Erosion Control Plan presented on the Design Drawings. The final Erosion and Sediment Control
plan will be sent to Monroe County and Engineer of Record for review/approval before
commencement of construction activities.
Current Vegetation: The property is predominantly maintained lawn. An Australian pine is
located along the shoreline of the parcel immediately to the east and a red mangrove and Australian
pine are located at the property boundary with the parcel to the west. Former red mangroves, as
evidenced by old prop roots, are shown on the Vegetation Survey (attached). A gumbo limbo tree is
located near the street. The proposed methodology will not require the modification of any site
vegetation at the proposed staging area. All vegetation on site will be protected by silt fencing
installed prior to construction to protect the plants. In areas where silt fencing could entrap or
impede the Florida Key Deer, storm water erosion control wattles will be used as an alternative to
filter storm water runoff.
