At the October 19, 2011, Board of County Commissioner's meeting the Board granted approval and authorized execution of the following: Item C45 First Amendment to Agreement with Pedro Falcon Electrical Contractor's Inc. for the Renovation and Addition of Fire Station #17 in Conch Key. Item C46 Contract with Currie, Sowards, Aguila Architects, (CSA), to draw a preliminary design of a parking facility on Thomas Street. Item C47 Contract for Professional Services with William P. Horn Architect P.A. for Restroom and Shower Facilities at the Crawl Key Fire Training site. Item C52 Task Order Contract with MBI /K2M Architects under their continuing services agreement with the County. This task order contract for NTE $7,000 will provide initial site layout and feasibility grade cost estimate to construct a Customs and Border Protection (CBP) area at the Marathon Airport in the area identified by CBP representatives. Attached is a duplicate original of each of the above - mentioned for your handling. Should you have any questions, please do not hesitate to contact this office. cc: County Attorney Finance File✓ • CONTRACT FOR PROFESSIONAL SERVICES BETWEEN OWNER AND ARCHITECT/ENGINEER THIS CONTRACT made as of the 19 day of October, 2011. FOR PROFESSIONAL SERVICES BETWEEN OWNER AND ARCHITECT /ENGINEER (the "Contract" or "Agreement ") is made and entered into by MONROE COUNTY, BOARD OF COUNTY COMMISSIOENRS ( "Owner" or "County"), a political subdivision of the State of Florida, whose address is 1100 Simonton Street, Key West, Florida 33040, its successors and assigns through the Monroe County Board of County Commissioners (`BOCC "), and MBI /K2M ARCHITECTURE, INC. the ( "Architect ")., whose address is 1001 Whitehead Street Suite 101, Key West, FL 33040, its successors and assigns. NOW, THEREFORE, in consideration of the mutual promises, covenants and agreements stated herein, and for other good and valuable consideration, the sufficiency of which hereby acknowledged, the Owner and the Architect agree: 1. This Contract is in accordance to the Continuing Contract as approved by the BOCC on December 16, 2009 where professional services are to be rendered for projects in which the estimated construction costs of each individual project under contract does not exceed Two Million Dollars ($2,000,000.00). All terms and conditions of the continuing contract approved by the BOCC shall apply to this contract. Modifications to the existing contract consist of the following: A. SCOPE OF SERVICES Architect shall provide conceptual architectural services for Design Concept and cost estimating for a General Aviation Facility Customs Terminal in the existing Marathon Airport, located at 9400 Overseas Highway. Scope of work is limited to existing conditions survey, conceptual floor plan and cost estimating: Existing Conditions Survey • Photograph and measure the existing terminal as required for the scope of work • Create as -built drawings of existing building sufficient for design concept plan Design Concept • Coordination with County Staff to refine requirements as identified during meetings with Department of Homeland Security • Prepare conceptual floor plan for General Aviation Facility in existing terminal Comply with current U.S. Customs and Border Protection Airport Technical Design Standards, August 2006 Meeting with County to review design concept plan for comments and approval Cost Estimate Prepare cost of construction estimate based on approved design concept plan Estimate to include architectural and engineering fees for scope of work DELIVERABLES: • Floor Plan (proposed GAF facility and adjacent partial adjacent airport terminal) • Cost Estimate, including estimated cost of construction and A/E fees B. EXCLUSIONS The following services are specifically excluded: Construction documents for permit and construction. Architect will submit proposal for construction documents and engineering services at Client's request C. PAYMENTS Professional services for the scope indicated above will be a total of Six Thousand Five Hundred Dollars and 00 /100 ($6,500.00), plus direct (reimbursable) expenses. Direct (reimbursable) expenses include the following: • Additional Reproduction of reports, drawings, and specifications • Renderings • Additional color and black and white copies at direct cost • Any other similar project - related item Invoicing will be monthly based on percent completion. Each invoice will include a description of the work completed and the percentage of completion represented by the work. The percentage of completion shall be agreed upon between the Owner and the Architect. D. ADDITIONAL SERVICES Any items beyond those specifically outlined and described above, are considered to be Additional Services and are chargeable at the standard hourly rates listed below: ARCHITECTURE INTERIOR DESIGN Principal $225.00 Director, Interior Design $175.00 Director, Architect $175.00 Senior Designer $135.00 Project Mgr, Arch II $150.00 Purchasing Agent $125.00 Project Coordinator /CA $125.00 Senior Draftsman $97.50 Draftsman II $80.00 Administration $60.00 Intern $42.50 Staff Designer/Designer $97.50 Junior Designer $75.00 Administrative $60.00 Intern $42.50 Architect has relationship with 3D computer and hand rendering companies. If renderings are requested they shall be billed as a reimbursable cost only when approved by the Owner prior to start of work. E. SCHEDULE The Architect shall perform its services as expeditiously as is consistent with professional skill and care and the orderly progress of the Work. The Architect, upon notice to proceed by the Owner, shall complete the Scope of Work within six (6) weeks or Forty -Two days (42). F. The Architect shall not disclose, publish, or authorize others to disclose or publish, design data, drawings, specifications, reports, or other information pertaining to the services performed by Architect or other information to which the Architect has had access during the Term of the Continuing Contract without the prior written approval of the County, during the Term of the Continuing Contract and for a period of two years after the termination of the Continuing Contract. Nevertheless, the parties agree the Architect may use and publish the County's name and give a general description of the work provided by the Architect for the purpose of informing other clients and potential clients of the architect's work experience and qualifications. G. Should the County receive a request for documents pursuant to Chapter 119, Florida Statutes, Architect shall cooperate with the County to facilitate the County's compliance with Chapter 119, Florida Statutes. Should the Architect assert any exemptions to the requirements of Chapter 119 and related statutes, the burden of establishing such exemption, by way of injunctive or other relief as provided by law, shall be upon the Architect. Failure by the Architect to cooperate with the County in connection with a Public Records request shall be grounds for immediate unilateral cancellation of the Continuing Contract by the County. H. In providing opinions of probable construction cost, the Owner understands that the Architect has no control over the cost or availability of labor, equipment or materials, or over market conditions or the Contractor's method of pricing, and that the Architect's opinion of probable construction costs are made on the basis of the Architect's professional judgment and experience. The Architect makes no warranty, express or implied, that the bids or the negotiated cost of the Work will not vary from the Architect's opinion of probable construction cost.
