At the November 20, 2012, Board of County Commissioner's meeting the Board granted approval and authorized execution of Item F19 a Second Amendment to Contract with MBI /K2M Architecture, Inc. to continue to Phase II of the Customs & Border Protection Facility Project at the Marathon Airport by preparing the final design, and continuing with a Request for Proposal (RFP) for construction. Should you have any questions, please feel free to contact me. cc: County Attorney Finance File i • 1 • SECOND AMENDMENT TO CONTRACT BETWEEN OWNER AND CONTRACTOR THIS SECOND AMENDMENT (herein after "AMENDMENT ") to the CONTRACT BETWEEN OWNER AND ARCHITECT/ENGINEER (the "Contract" or "Agreement ") is made and entered this 20 day of November 2012, between MONROE COUNTY ( "Owner" or "County ") and MBI/K2M ARCHITECTURE, INC. ( "Architect "), in order to amend the Contract between the parties dated October 19, 2011, and as Amended on July 18, 2012, as follows: WITNESSETH WHEREAS, on the 16 day of December, 2009, the parties entered into a continuing contract for projects in which the estimated construction costs of each individual project under the contract does not exceed Two Million Dollars ($2,000,000.00), or for study activity if the fee for professional services for each individual study under the contract does not exceed Two Hundred Thousand Dollars ($200,000.00); and WHEREAS, on the 19 day of October, 2011, the parties entered into a contract for an individual study for the Design Concept and Cost Estimating for a General Aviation Facility Customs Terminal in the Existing Marathon Airport, located at 9400 Overseas Highway; and WHEREAS, on the 18` day of July, 2012, the Owner approved a First Amendment to Contract between the parties adding Additional Services to the Scope of Services to include Revising and Refining the Design Concept Plan, Order of Magnitude Cost Estimate, allowing participation at a Monroe County BOCC meeting and participation at a Design Review meeting, increasing the date of completion by 180 days, and increasing compensation; and WHEREAS, the Owner wishes to amend the Contract of October 19, 2011, as amended on July 18, 2012, to continue with Phase II of the project by preparing a Request for Proposal (RFP) for construction of a Customs & Border Protection facility at the Marathon Airport; now therefore IN CONSIDERATION of the mutual promises contained herein, the parties hereby agree that the original contract dated October 19, 2011, and as amended on July 18, 2012, shall be amended as • follows: A. SCOPE OF WORK Architect shall proceed with Phase II of the General Aviation Facility Customs Terminal in the Existing Marathon Airport that shall include the Design, Construction Documents Preparation, Permitting, and Construction Administration Services. Architect shall provide architectural design and mechanical, plumbing, electrical, fire protection, security, and technology engineering services as required for the reconfiguration of the existing Marathon Airport to accommodate a new Customs Terminal in approximately 4,400 s.£ Design is based on First Floor Concept Plan Revised, drawing A2.1.1 prepared by Architect dated August 27, 2012. Architect shall reconfigure the part of the existing Marathon Airport utilizing the approximate 4,400 s.f. for a new customs Terminal in compliance with current Department of Homeland Security Standards and the First Floor Concept Plan Revised, drawing A2.1.1 dated August 27, 2012 which was previously approved by the Department of Homeland Security. Architect shall conduct an Existing Conditions Analysis and As -Built Drawings which will include: • Photograph and measure existing building and site features in area of work • Prepare existing site plan, floor plans, and ceiling plans in CAD • Document existing mechanical, plumbing, and electrical services l .r • Site visit by Architect and Mechanical and Electrical Engineers Shematic Design shall include: • Refine preliminary floor plans and develop ceiling and system plans for review and approval by Monroe County Staff, City of Marathon Staff, and Department of Homeland Security • Meeting(s) with Architect and aforementioned groups to review and modify the design Design Development shall include: • Further development of approved Schematic Design plans with interior details, enlarged plans, and systems engineering, including: 1) Architectural a) Demolition Plans b) Floor and Ceiling Plans c) Enlarged Interior Plans, Elevations, and Details d) Finishes consistent with building standard 2) Heating, Ventilating and Air Conditioning (HVAC) Engineering a) Modifications to existing HVAC systems as necessary for offices and vestibules b) Design for 100% outside air /exhaust system with negative pressure for hold room and detention room. Provide duct smoke detectors in ductwork c) Design for 100% exhaust system in interview room d) Design for separate HVAC system for the computer phone room e) HVAC system control modification as required 3) Plumbing Engineering a) Modifications to existing sanitary waste and vent, and domestic water systems for detention room b) New detention type fixtures with electronic flush control in detention room. Flush control cutoff outside of room to be provided. Floor drain with tamper proof cover to be provided. c) Eye wash and hand wash sink adjacent to detention room and search room to be provided d) Condensate drain piping for HVAC to be provided 4) Fire Protection Engineering a) Modifications to the existing fire protection system as required to support new floor plan b) Pop -down sprinkler heads in detention room, hold room, interview room c) FM 200 fire protection system for computer room 5) Electrical Engineering a) Lighting fixture selection, layout, circuiting b) Electrically powered equipment connection, circuiting c) Branch, power and distribution wiring and raceway d) Connection of lighting to emergency power system for interview, detention and holding rooms e) Dedicated power with UPS system for computer room f) Modifications to existing fire alarm system 6) Electronic Systems Engineering — Extension/Modifications to the existing system a) Telephone distribution system (phone system/switch by Owner) b) Data systems — distribution system (electronics by Owner) c) Systems per CBP airport Technical Design Standards — Current Version 7) Security Systems Engineering — Extensions/Modifications to the existing system a) Provide duress system with keyed reset/disable control for interview room, hold, and detention rooms b) Provide CCTV with microphone in interview room c) Provide CCTV in hold room and detention room d) Provide IDS and alarm with UPS back -up with keypad control inside computer room e) Server room to be designed in accordance with CBP and USDHS standards 8) Specifications a) Meeting(s) with Architect, Mechanical and Electrical Engineers and aforementioned groups to review and modify the design. b) Design Development level cost estimate Construction Documents shall include: • Architectural and engineering drawings and specifications for bidding, permitting, and construction • Meeting(s) with Architect, Mechanical and Electrical Engineers and aforementioned groups to review and modify the design • Submission of construction documents to FDOT and/or FAA for review and comment. • Final cost estimate Project Bidding shall include: • Assist County in preparing bid documents, including drawings, specifications, addenda, pre -bid conference, bid review, and contractor recommendation Construction Administration shall include: • Assistance to determine, in general, if work is proceeding in accordance with the plans • Periodic site visits to review progress of work • Answer questions by contractor, issue field clarifications, bulletins, change order review, payment application review • Shop drawing /submittal review • Project closeout B. PAYMENTS Payment for Professional Services for the scope of work above shall be a lump sum fee of Eighty Thousand Dollars and 00 /100 ($80,000.00), plus reimbursable expenses not to exceed Five Thousand Dollars and 00 /100 ($5,000.00). Reimbursable expenses include the following: • Reproductions as requested only by the Owner (beyond 8 signed and sealed full size sets, plus one full size reproducible set, and one 11 x 17 reproducible set) and one electronic version • Expenses of transportation submitted by Architect, in writing, and living expenses in connection with out -of- county travel authorized by the Owner, but only to the extent and in the amounts authorized by Section 112.061, Florida Statutes • • Postage and handling of Drawings and Specifications, except for those charges for postage between the Architects branch offices and between the Architect and his consultants • Renderings and Models requested by the Owner. Payments will be made on a monthly basis, based on the Fee Schedule as provided below: • Schematic Design (15 %) $12,000 • Design Development (30 %) $24,000 • Construction Documents (30 %) $24,000 • Bidding (5 %) $ 4,000 • Construction Administration (20 %) $16,000 Fees include meetings and coordination with authorities having jurisdiction over the project, including but not limited to Monroe County Staff, City of Marathon Staff, the Department of Homeland Security C. SCHEDULE The Architect shall perform its services as expeditiously as is consistent with professional skill and care and the orderly progress of the work. This Agreement shall terminate upon completion of the Construction Phase of the project. D. EXCLUSIONS The following services are specifically excluded: • Asbestos /mold abatement survey • The project will not be LEED accredited.
