AGENDA ITEM WORDING: Approval of a Resolution of the Monroe County Board of County
Commissioners, amending Resolution No. 493 -1992, specifically the Fee Schedule of Library
Facilities Impact Fees to be imposed on new residential development pursuant to Chapter 126
Impact Fees of the Monroe County Land Development Code, amending all fees in the Fee Schedule
to Zero Dollars; and providing for an Effective Date.
ITEM BACKGROUND:
The purpose of impact fees is to charge new development to pay their proportionate share for the
construction or expansion of off -site capital improvements that are necessitated by and benefit the
new development.
In 1992, the County (through a consultant) conducted studies on impact fee calculations and
established the current fees based on these studies. It is typically recommended that communities
conduct impact fee study updates every 3 -5 years to keep facility costs and data up to date.
The fees established in 1992 have not been updated. Pursuant to Board of County Commissioners
direction on March 24, 2016, staff is proposing a Resolution to eliminate Library Facilities Impact
Fees (as well as eliminating Employee Fair Share Housing, Sheriff Facilities, and Solid
Waste /Recycling Facilities Impact Fees.) Staff is concurrently working on a Request For Proposals
(RFP) for an Evaluation and Update to Impact Fee Data for Transportation (Roadways), Parks and
Recreation, and Fire Protection / EMS Impact Fees.
During the meeting on March 24, 2016 staff presented preliminary maximum impact fees for each of
the categories based upon the proposed eligible projects in the County's Capital Improvement Plan
(CIP.) Specifically for Library Facilities, the County has only one project — the new Marathon
Library. The Marathon Library is projected to utilize the entire (September 30, 2016 CAFR) balance
of $1,082,082. Following that project the County has no other Library Facility projects in the CIP.
Therefore the proposed maximum fee that could be established on new residential dwelling units
would be $0.00. The attached resolution proposes this amended fee of $0.00.
PREVIOUS RELEVANT BOCC ACTION:
On October 16, 1992 the Board of County Commissioners approved Resolution No. 493 -1992. The
Resolution established the impact fee schedule which is in place today.
On March 24, 2016 the Board of County Commissioners directed staff to move forward with an
ordinance and resolutions to eliminate Employee Fair Share Housing, Sherriff Facilities, Solid
Waste /Recycling Facilities, and Library Facilities Impact Fees.

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
AMENDING RESOLUTION NO. 493 -1992, SPECIFICALLY
THE FEE SCHEDULE OF LIBRARY FACILITIES IMPACT
FEES TO BE IMPOSED ON NEW RESIDENTIAL
DEVELOPMENT PURSUANT TO CHAPTER 126 IMPACT
FEES OF THE MONROE COUNTY LAND DEVELOPMENT
CODE, AMENDING ALL FEES IN THE FEE SCHEDULE TO
ZERO DOLLARS; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Board of County Commissioners adopted Resolution No. 493 -1992 on
October 16, 1992 establishing a Library Facilities Impact Fee Schedule to be imposed on new
residential development pursuant to Chapter 126 Impact Fees of the Monroe County Code; and
WHEREAS, the Board of County Commissioners has acknowledged that at this time the
amount of development of capital improvements of library facilities concludes a reasonable
determination that the Library Facilities Impact Fee Schedule be amended to $0.00 for all types of
new residential development;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY THAT:
The following Library Facilities Impact Fee Schedule shall be adopted and imposed on
new residential development in the unincorporated area of the County and within the boundaries
of participating municipalities pursuant to an Interlocal Agreement:
Section 1. Pursuant to and in accordance with Chapter 126 Impact Fees of the Monroe
County Code, the Library Facilities Impact Fees to be imposed on new residential development
shall be amended as set forth herein the Library Facilities Impact Fee Schedule as follows:
