AGENDA ITEM WORDING: Approval to advertise an RFQ for Construction Manager at Risk
(CMAR) Services for the Plantation Key Judicial Courthouse and Detention Facility program.
ITEM BACKGROUND: In 2015 Monroe County entered into an agreement for professional
services to design and permit the P.K. Judicial Courthouse and Detention facility. The "Construction
Manager at Risk" (CMAR) project delivery model develops the cost of construction earlier than the
Design- Bid -Build delivery model traditionally used by the County. The RFQ will specify specific
review points in the process at which the estimated construction costs can be reviewed leading to a
final Guaranteed Maximum Price (GMP) at which the construction contractor will deliver the final
product. The CMAR process is designed to include the constructor (CMAR) in the design process to
take advantage of his construction expertise as design decisions are made. As project subsystems are
finalized, the CMAR locks in subcontracts to build his final GMP. The RFQ will specify that the
County will retain the final decision to execute the final construction contract with the CMAR or to
use a traditional hard bid process to select a general contractor.
The CMAR process trades off some preconstruction fees to the CMAR contractors with the expected
reduction /elimination of change orders during construction. Success in this largely depends on a
robust review process in the design phase by the CMAR and elimination of owner initiated changes
after design completion.
The County's project manager remains the "owner's representative" in the process and retains the
final decision authority after consultation with the stakeholders on all decisions.
PREVIOUS RELEVANT BOCC ACTION: On February 18, 2015, the BOCC approved an
Agreement for professional services to design and permit the P.K. Judicial Courthouse and
Detention facility. On May 20, 2015, the BOCC approved a First Amendment to the Agreement
increasing the scope of work to include a site plan review and approval process, which was a
requirement of the Village of Islamorada. On October 21, 2015, the BOCC approved a Second
Amendment to the Agreement to provide a schedule of values for compensation from Design
through Construction Administration. On May 17, 2017, the BOCC approved a Third Amendment to
the Agreement to provide for the design through construction administration of the Plantation Key
Judicial Courthouse and Detention Facility.
