AGENDA ITEM WORDING: Approval of the selection of Boating Improvement Funds (BIF)
funding requests for FY' 15 submitted by the Village of Islamorada ($22,500 for regulatory buoy
maintenance) and the City of Marathon ($24,000 for construction of a kayak launching facility), and
direction for staff to draft Inter -Local Agreements (ILA) with the Village of Islamorada and the City
of Marathon based on staff s selection recommendations, providing for reimbursement for boating and
waterways related projects to be performed in FY' 15.
ITEM BACKGROUND: At the February 15, 2012, BOCC meeting the Board approved Resolution
No.080-2012 (amending Resolution No.371-2011) establishing policy and procedures for the award of
BIF reimbursement funding to the municipalities within Monroe County. The procedures provide for
submittal of annual funding requests, a project scoring and selection process, and award of funding
through Inter -Local Agreements (ILA) based on funding availability (see attached draft FY' 15 BIF
budget). Staff has received three funding request applications for FY' 15, including: the Village of
Islamorada in the amount of $22,500 for regulatory buoy maintenance, the City of Marathon in the
amount of $24,000 for construction of a kayak launching facility, and the City of Key West in the
amount of $38,990 for mooring field related work. Staff has ranked and scored the funding requests, as
indicated below (see attached Score Sheet- points are based on a total possible score of 60pts).
1- 53pt. Marathon- $24,000 requested for kayak launch construction
2- 35pt. Village of Islamorada- $22,500 requested for regulatory buoy maintenance
3- 20pt. Key West- $38,990 requested for mooring field related work
Staff recommends the selection of Marathon and the Village of Islamorada for reimbursement funding
for the above described projects. Staff does not recommend funding the City of Key West for mooring
field related costs, as the Key West mooring field was completely self -funding in last fiscal year, and
Resolution No.080-2012 discourages requests for projects involving revenue producing infrastructure.
A financial analysis of mooring field revenues/expenditures provided by, and communications with,
Key West staff indicate that the Key West mooring field did not incur any unmet needs in the previous
fiscal year (i.e. analysis indicates $184,475 in mooring field revenues and $108,251 in expenditures).
Upon direction from the Board, staff will prepare ILA's between the County and the municipalities
selected for BIF funding. The ILA's will be structured to provide for a `not to exceed' amount. Staff
anticipates bringing ILA's back to the Board in June or July 2014.

A RESOLUTION OF THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS RESCINDING RESOLUTION NO.
371-2011 AND ESTABLISHING POLICY FOR THE
EXPENDITURE OF BOATING IMPROVEMENT FUNDS AND
PROCEDURES FOR THE AWARD OF BOATING
IMPROVEMENT FUNDS TO THE MUNICPALITIES WITHIN
MONROE COUNTY.
WHEREAS, moneys from vessel registration fees designated for the use of
counties is distributed by the tax collector to the Board of County Commissioners,
pursuant to F.S. 328.72, hereafter referred to as State Boating Improvement Funds; and
WHEREAS, State Boating Improvement Funds are for the sole purposes '
pr-wlid-ixg =r-x-eat&&,x.-qLc-h-v--k-AnLniuking-amd--Dther uniform waterway markers, public bol,
ramps, lifts, and hoists, marine railways, and other public launching facilities, derehi
vessel removal, and removal of vessels and floating structures deemed a hazard to publ
safety and health for failure to comply with F.S.327.53; and
WHEREAS, State Boating Improvement Fund revenues provide approximately
'CV250,000 annually; and
WHEREAS, the County approved Ordinance No.034-2002 to impose an annual
registration fee on vessels registered, operated, or stored in the water within its
�'niqdiciio,r. Tsursuant to F.S.32V.66. hereaiter referred to as Coumv Routine Inwrovement
WHEREAS, County Boating Improvement Funds shall be expended for
patrol, regulation, and maintenance of the takes, rivers, and waters and for other boatin
related activities of municipalities or counties; and I
WHEREAS, County Boating Improvement Fund revenues provide
approximately $400,000 annually; and

WHEREAS, the County may provide Boating Improvement Fund dollars to
various municipalities for boating and waterway projects in accordance with the allow]
uses described in F.S.327.53 and F.S.328,66; and
WHEREAS, the County approved Resolution No.371-2011 which establishl
criteria for the general use of Boating Improvement Funds and procedures for
reimbursement of Boating Improvement Funds to the municipalities; and
WHEREAS, the County desires to revise the policy established by Resoluti
No.371-201 1, refining the purpose of reimbursement firading to the municipalities fro
Boating Improvement Funds, establishing funding request submission procedures,
providing for a selection process for the award of reimbursement flaming;
Section 1. Resolution No.3 71-2011 is hereby rescinded.
Section 2. The Monroe County Board of County Commissioners shall expend
State and County Boating Improvement Funds only for County boating and waterway
related projects, and municipal boating and waterway related projects in the form of
ceimbursement funding, in accordance with the allowed uses of Boating Improvement
Funds as described in F.S. 328.72 and F.S. 328.6&
Section 3. The Monroe County Board of County Commissioners
municipalities within Monroe County shall only perform boating and waterway relal
projects that serve the general boating public.
Section 4. The Monroe County Board of County Commissioners may provi
reimbursement funding from Boating Improvement Funds to the various municipaliti
for the purpose of providing for repair and maintenance of existing infrastructure, as W1
as for capital improvement projects. The following procedures are established:

GUIDELINES AND INSTRUCTIONS
FOR SUBMITTAL OF MUNICIPALITY FUNDING REQUESTS
FOR USE OF MONROE COUNTY BOATING IMPROVEMENT FUNDS
for
Fiscal Year 2015

Policy for the expenditure of County Boating Improvement Funds {IF) to the various
municipalities is established by Monroe County Resolution No.080-2012, and in accordance
with the allowed uses of RIF as described in F.S. 328.72.
Reimbursement Funding Guidelines
• RIF fonds may only be used for boating and waterway related projects that serve the general
public.
• RIF expenditures to the municipalities will be provided in the form of reimbursement
subsequent to completion of projects. Funding will not be provided for projects previously
completed.
• Reimbursement may be provided for repair and maintenance of existing infrastructure, as
well as for capital improvement projects. Capital improvement projects are encouraged.
• Funding requests for revenue producing infrastructure (such as mooring fields or marinas)
are discouraged. Requests for such projects should include evidence and written analysis of
unmet costs. Boating Improvement funds should not be used to simply supplant repair and
maintenance imding.
• Funding requests for capital improvement projects that involve future revenue producing
infrastructure should include a fiscal analysis and assurance that the improvement will be
self -supportive and include operating and maintenance funding for future needs.
• Projects for consideration must occur over public upland or public bay bottom.
Request Submittal Instructions
Fundina: Request submittal:
Municipality binding request forms must be submitted by April I oft a current fiscal year.
Prided Selection:
County Growth Management staff will evaluate and score each request and make selection
recommendations to the BOCC by June of the current fiscal year, Funding awards may include
all of, or a portion of, the amount requested. The BOCC will evaluate the staff recommendations
and provide Board approval in ranking order, based on binding availability.
Project evaluation and scoring will be based on the following criteria:
30 pt Community need and project merit
10 pt Project promotes public water access
10 pt Project is shovel ready (plans, estimates, designs, and permits in place)
5 pt Project is a new capital improvement (rather than repair/maintenance)
5 pt Match funding (25% or greater) is being provided
-10 pt Project is for repair or maintenance of completely self- ding existing
infrastructure
Fundina Awards:
Municipalities receiving awards will enter into an Inter -local Agreement (ILA) with the County.
The ILA will describe the project, award amount, and required documentation for
reimbursement. The ILA will be executed by the municipality, and four signed originals will be
provided to the County, The ILA will be submitted to the BOCC for final execution.
Commencement of the project shall not occur prior to full execution of the ILA.
Reimbursement Procedures:
Upon completion of the project the municipality will submit all required documentation to the
County (as described in the ILA), including a request for reimbursement, invoices, and copies of
cancelled checks. County staff will review the documentation and submit the reimbursement
request packet to the Clerk of the Court for issuance of payment.
All projects must be completed, and invoicing dated within the same fiscal year of the funding.

Project Title: Kayak Launch at Boot Key Harbor City Marina
Project description and purpose (explain the community need and project merit):
Boot Key Harbor City Marina seeks to expand access to the waterways through installation of an ADA
accessible kayak launch and small educational center to be built on site, Boot Key Harbor is central to many
kayak trails and provides a unique opportunity for kayak enthusiasts due to its location, near proximity of
available kayak trails, and protected waters, In addition to the location's benefits to users, the location offers
benefits to the City also. Marina staff can oversee the maintenance of this structure and stocking of
educational materials when making the daily rounds of the property at no additional cost to the City,
Merits of the project include introduction of the City Marina and Community Park areas to locals and tourists
that may not otherwise avail themselves of these city features, as well as providing safe and easy access to
.i several secluded kayak trails through an already established slow speed minimum wake zone,
Inclusion of a kayak launch may generally offer opportunities for environmental education of the public through
display of various signage and brochures at the launch site (See attached examples), Such education may
include information on mangrove ecosystems, manatees, turtles, and other forms of sea life that may be
encountered on a trail or information on fishing and boating regulations that may be applicable to the area.

Description of how project may promote public water access:
A kayak launch at Boot Key Harbor City Marina would enable kayak enthusiasts to access the water in a saf%
protected, and monitored harbor. Boot Key Harbor is an established slow speed minimum wake zone,
enabling synergy between kayakers and boaters in a shared waterway area, Kayakers, may also feel safer
leaving their cars parked in an open public area shared by a close-knit liveaboard boating community.

The applicant will provide any pertinent documentation to assist with the review and evaluatlon of the funding request
such as site plans (verifying property ownership), design plans, permits, ate,
City Marina has obtained a preliminary design of the kayak launch from local contractor, John Coffin, who
designed and built the successful launch behind Marathon City Hall. Once funding is secured, the project will
be put out for bid through a Design Build request for proposals and permitting will be applied for by the
awarded contractor.

11- PROJECT SUMMARY
Project Title: Islamorada Regulatory Buoy Maintenance Program FY 14/15
Project description and purpose (explain the community need and project merit):
Islamorada, Village of Islands boundaries extend from Tavernier Creek Bridge at mile marker 90.9 south to
the Channel Two Bridge at mile marker 72.6, and includes Plantation Key, Windley Key and Upper and Lower
Matecumbe Keys. Nicknamed the "Sportfishing Capital of the World," the waters off Islamorada, Village of
Island (the "Village") are heavily trafficked by recreation boaters, fishermen and personal watercraft.
To aid in boater safety and facilitate preservation of near shore waters, flats and reefs, the Village has
operated a Buoy Maintenance Program since 2004, maintaining a Florida Uniform Waterway Marker
compliant system of 120 regulatory buoys and a series of fixed navigational, recreational and informational
markers within the Village's 1200'off-shore jurisdiction in the Atlantic Ocean and the Gulf of Mexico.The
Village experience frequent losses and damages to its buoy system as the result of routinely heavy boat
traffic, environmental wear, seasonal storm activity and occasional theft. Under Florida law, and pursuant to
the Village Ordinance 03-10, the Village is responsible for responding to reports of damaged or missing buoys
and markers. Subsequently, the Village has retained marine contractors to regularly inspect the buoys and
markers to ensure operational continuity of the system and therefore, the safety of the public and the
environment.
To assist with anticipated program maintenance costs in FY 14/15, the Village requests Monroe County
reimburse the Village $22,500 in Boating Improvement Funds for cost expended in the upcoming fiscal year.
Based on prior years' expenditures and FY 14/15 program goals of increased site visitation, permitting
additional buoy locations and continued distribution of educations materials, the Villages will provide $5,000
cash match towards program costs from its FY 14/15 Public Works Budget. Funded program works would
include: 1.) Labor for certified divers to visit buoy locations, inspecting, cleaning, repair and replace buoys and
anchoring materials as needed,- 2,) Supplies for replacement buoys, anchor assembly lines, property
identification and numbering decals,- 3.) Labor and supplies for buoy installations at newly permitted locations
as need arises-, and 4.) Printing and distribution of educational materials advising boaters about safety issues
and waterway marker information,

Islamorada's Buoy Maintenance Program utilizes 120 highly visible shallow draft buoys marked with CPS
identifiers. to determine position, warn of dangers and obstructions to navigation and alert boaters and
operators of various Federal, State and Local Regulations, Safer than fixed signs, buoys reduce the severity
of boater/sign collisions and are less expensive to erect and maintain. The buoys are ideal for the low -energy
environment surrounding Islamorada, where boaters must remain vigilant of manatees and sea turtles year
round. To promote safe boating practices and protection of the Village's fragile sea grass beds and manatee
and sea turtle populations, all buoys exhibit the remind: "IDLE SPEED NO WAKE 300'FROM SHORE." For
boating visitors unfamiliar with the area, the Village also distributes educational brochures and rack cards to
increase public safety awareness and knowledge of local boating issues.

The applicant will provide any pertinent documentation to assist with the review and evaluation of the funding request
such as site plans (verifying property ownership), design plans, permits, etc.
In compliance with Florida Administrative Code, and Village Ordinance 03-10, Islamorada's current waterway
marker plan was reviewed and approved by the Florida Fish A Wildlife Conservation Commission's Office of
Boating Safety & Waterway Management in December 2008. The attached FWCC Permit No. 04-018 lists the
statewide marker identification numbers, latitude/longitude, and sign verbiage for each of the 120 approved.
The funding would go to the continued maintenance of the current buoys and replacement for any lost buoys.

11- PROJECT SUMMARY
Project Title: Key West Mooring Field
Project description and purpose (explain the community need and project merit):
The Key West Mooring Field is a vital resource for public use. The mooring field is the only managed mooring
field in Key West waters providing a safe haven for boaters and at the same time protecting near shore bay
bottom from the negative effect of conventional anchoring. The resource caters to local and visitors for
mooring of vessel and will also provide upland services such as bathroom, showers, sewer pump out service,
dinghy dock and overnight vehicle parking.
The City of Key West needs the counties support as an ongoing effort to keep the Key West Mooring Field
infrastructure in good working condition and safe for public use. Inspection and maintenance of the mooring
field has become increasingly more expensive and the counties support helps Key West Mooring Field with
operational cost.
The funding will cover expense associated with new mooring equipment as needed also any near shore
demarcations, channel markers and customer informational signs,

Description of how project may promote public water access:
The project helps with the cost of maintenance and regular inspections required to keep Key West Mooring
Field safe for public use. The Key West Mooring Field promotes safe boating and provides the public with
information for best environmental practices in nearshore waters, also provides the public boater a safe place
I to moor his/her vessel with the least amount of impact on the environment. Upland amenities make the
mooring field a very desirable location for transient boating as well as local users with bathrooms, showers,
pump out and free parking for vehicles,
