Property Owner: Oceanside Investors LLC (Real Estate (RE) #00 127420.000000) 11 REVIEW OF APPLICATION: The road abandonment petition was submitted by one of the only two property owners that are considered affected by the Monroe County Code (MCC). Only four parcels are contiguous to the improved section of the subject road segment: The portion of the right-of-way to be abandoned is bordered by the land associated with Block 46 to the north (developed with a nonresidential building formerly used by the Hickory House restaurant), a harbor to the west, and the land associated with Block 60 to the south (developed with a mixed use marina commonly known as Oceanside Marina). The applicant, the property owner of Oceanside Marina, has requested abandonment in order to improve access to and from their nonresidential development. This petition has been reviewed by County staff and utilities and documents of no objection were received by the following: • Monroe County Engineering Department (pending) • Monroe County Code Compliance Department (pending) • Monroe County Office of the Fire Marshal (pending) • Monroe County Sheriffs Office (pending) • AT&T (pending) • Florida Keys Aqueduct Authority (pending) • Keys Energy Services (letter dated May 1, 2014) • KW Resort Utilities, Corp. (letter dated April 25, 2014; however additional documentation is required as the utility requested an easement) • Co cast (pending) The aforementioned received documents are attached to this report. The BOCC has to the authority to grant sbandomnents of dedicated and accepted rights -of - way under jurisdiction of the County in accordance with MCC §19-1. MCC §19-1, Abandonment of rights -of -way, provides the following provisions and criterion for granting 2 abandonments. 3 4 (a) No dedicated and accepted right-of-way in the county shall be abandoned where.- 6 (1) The right-of-way terminates on a body of open water,- or 7 8 The portion of the right-of-way to be abandoned is bordered by land associated with 9 Block 46 to the north (developed with a nonresidential building formerly used by the 10 Hickory House restaurant), a harbor to the west, and land associated with Block 60 to 11 the south (developed with a mixed use marina commonly known as Oceanside 12 Marina). 13 14 Water is defined in MCC § 10 1 - 1: water or community water means all water on or 15 beneath the surface of the ground, including the water in any watercourse, water body 16 or wetland. Open water is not defined in the MCC. 17 18 The use of the adjective "open" prior to water in this provision is presumably 19 intended to limit the type of restricted body of water in which a right-of-way 20 terminates to a body which is open without restriction. Therefore, although the 21 defined to of water expressly includes wetlands, the undefined to of open water 22 does not necessarily include wetlands which may have attributes that restrict open 23 access. 24 25 According to a boundary survey submitted with the application, the improved section 26 of the segment to be abandoned terminates in wetlands vegetated with mangroves. 27 The unimproved section of the segment to be abandoned terminates in water; 28 however this inaccessible segment may not be natural open water as this area has 29 been dredged in the past. The plat (platted in 1910, recorded in 1911) shows the 30 roadway beyond the mangrove community to the west, but it was drawn prior to 31 existing improvements in the area. The current mean high water line is situated prior 32 to the mangroves to the east. 33 34 As defined in MCC § 10 1 - 1, mangrove community means a wetland plant association 35 subject to tidal influence where the vegetation is dominated by one more of the 36 following three species of mangroves: 1) Avicennia germitiatis (Black mangrove), 2) 37 Lag uncularia racurnoss, (White mangrove), 3) Rhizophora mangle (Red mangrove). 38 39 Note: Due to a) current regulations severely restricting the removal of mangroves and 40 the filling of wetland/submerged land and b) the lack of necessity to extend the 41 improved roadway her to the west, the unimproved section of the of the segment 42 of Peninsular Avenue that is currently wetland and/or submerged land will not be 43 developed in the future unless there is a dramatic change in regulations and 44 site/community conditions. 45 1 Staff finds that the improved section of the right-of-way does not terminate on a body 2 of open water. 3 4 (2) The right-of-way provides access to the public to land on open water,- or 5 6 7 According to a boundary survey submitted with the application, the improved section 8 of the segment to be abandoned terminates in wetlands vegetated with mangroves. 9 10 Staff finds that the right-of-way does not provide access to the public to land on open 11 water. 12 13 (3) The abandonment would preclude a way for the public to maintain access to the 14 water., 15 16 According to a boundary survey submitted with the application, the improved section 17 of the segment to be abandoned terminates in wetlands vegetated with mangroves. 18 19 Staff finds that the abandonment would not preclude a way for the public to maintain 20 access to the water. 21 22 (b) In all other cases of abandonment, no right-of-way shall be abandoned unless there is an 23 agreement to do so by all affected property owners. For purposes of this subsection, an 24 affected property owner is the owner of property which, if the right-of-way is abandoned, 25 wilk 26 27 There are only two affected property owners, Oceanside Investors LLB and Monroe 28 County. Oceanside Investors LLC is the applicant. If the BOCC opts to approve this 29 application, the approval shall also constitute the required agreement by the County as an 30 affected property owner to carry out the abandonment. 31 32 (1) Have access that is currently used by that property owner eliminated; 33 34 Only one of the affected properties (owned by Monroe County) meets this criterion. 35 36 The two existing access drives to/from the Oceanside Investors LLC property are 37 located to the east of the segment to be abandoned. Therefore, access that is currently 38 used would not be eliminated. 39 40 The existing access drive to/from the Monroe County property occurs along the 41 segment to be abandoned. However as Monroe County would acquire the portion of 42 the right-of-way north of the centerline, the access that is currently used would not be 43 terminated. 44 45 (2) Have the only platted access eliminated- 46 Page 4 of 6 (File #2013-150) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 Only one of the affected properties (owned by Monroe County) meets this criterion. The two existing access drives to/from the Oceanside Investors LLC property are located along the platted Peninsular Avenue roadway. However, one of the access drives is situated due south of the platted Maloney Avenue's southern terminal point (the Maloney Avenue/Peninsular Avenue intersection). Access at this point technically occurs from both Maloney Avenue and Peninsular Avenue. The existing access drive to/from the Monroe County property occurs along the segment to be abandoned. However as Monroe County would acquire the portion of the right-of-way north of the centerline, the access that is currently used would not be eliminated. (3) Have the paved area adjacent to that property increased for turn -around purposes, - or Both affected property owners meet this criterion. For the purpose of allowi vehicular traffic to turn around, a turnaround with an appropriate design will required by the Office of the Fire Marshal and the Public Works Division. I (4) Be increased in size. Both affected property owners meet this criterion, as both affected properties would be increased in size as a result of the abandonment. (c) A road may be abandoned only at the terminal portion of the road and in its full width unless the abandonment will comply with the County Code requirements for road, turn- around, and fire -rescue access and one of following circumstances exists: (1) An adjacent lot owner has on the platted right-of-way or within a setback a substantial structure which predates the Special Session Law 59-1578 pertaining to maps, plats and right-of-way. The term "substantial structure" specifically does not include wood or metal fences, sheds or tiki huts or other items not listed which are accessory structures. For the purpose of allowing vehicular traffic to turn around, a turnaround with an appropriate design will be required by the Office of the Fire Marshal and the Public Works Division. (2) The abandonment is requested by a county department or governmental ageneyfor a public purpose. The abandonment is requested by private property owners, not by a County department or governmental agency. At a minimum, survey should include a legal description 13 of the roadway; elevations; location and dimensions of all existing structures, paved 14 areas and utility structures; roadways and easements; and all bodies of water on the 15 site and adjacent to the site. I have completed a thorough historical review of the Peninsular Avenue portion of Stock Island and the requirements of Monroe County Code ("Code"), as part of an effort to provide background data regarding the ability of Monroe County to abandon the West end of Peninsular Avenue (the "Road"). It is my opinion that Monroe County may permissibly undertake an abandonment of the Western terminating portion of the Road upon agreement of the neighboring properties, Oceanside Investors, LLC ("Or side"") and M-onme County, as owner of the Hickory House ("Hickory House"). The following memorandum outlines the legal and factual grounds underlying Monroe County's ability to abandon the Road under the Code and the Monroe County Comprehensive Plan C'Comp. Plan"). 1. Factual Background The following facts are relevant to the abandonment of the Western terminating portion of the Road: l° Peninsular Avenue was platted in 1910 d recorded in the Public Records of Monroe County, FloridaPlat Book 1 Page 55. 2. At the time of its platting, Oceanside Marina did not exist and the area was not 3° The Hickory House was built sometime prior to 1945. 4, During the 1960s, Oceanside Marina was developed as a world class luxury marina. When it was developed, the land immediately North of Oceanside Marina was dredged into a boat basin providing ats access to the Hickory House and OceansideMarina's Northern Seawall. 5, When Oceanside Marina was developed, the developer dredged a portion of the right-of-way of Peninsular Avenue for use as a boat basin, Both Hickory House e d Oceanside installed piers for the mooring of vessels. Photos depicting the piers are attached hereto, As can be ascertained, the Hickory House had two piers, one in the center of the Hickory House property and one located on just inside its Southern property line boundary. The Fred Hildebrandt survey dated February 2, 1997 depicts the location of the old destroyed dock. 6. Since Oceanside Marina's development in the 1960s, a thick, mature red mangrove community has grovyn at the termination of Peninsular Avenue blocking all public access to the boat basics. I have included a benthic survey confirming their existence which is also depicted on the Hildebrandt survey. 7. On June 13, 2013, my client, Oceanside, purchased the property adjacent to the right-of-way proposed to be abandoned. My client agrees to create any turnaround required by County Code. 2 H. Determinations PrecludingAbandonment Monroety Cade is drafted in such a manner that unless specifically proscribed by a provision of the Code, the County may abandon any right-of-way °thin the County subject to certain requirements, Section 19-1(a) of the Code outlines the circumstances under which the County may not abandon a right-of-way. Section 1 1(a) states as follows; Sec. 1 -1 Abandonment of rights way (a) No dedicatedaccepted right-of-way in the county shall be abandonedwhere: (1) The right-of-way terminates n a body of open water; or (2) The right-of-way provides access to the public to land can open water; or (3) The abandonment would preclude a way for the public to maintain access to the water, In order to determine whether the Road may lawfully be abandonedder Section 1 -1(a), it is necessary to undertakeanalysis of the terms of the provision. Under Section 19- 1 of the Code, Public rights -of -way are defined to include; [Ljand that is dedicated or deed to (or is now used or will be d y) the county as a road, street, alley, walkway, drainage facility, access for ingress and egress, or for Queer purposes, including those rights -of -way within municipalities that by virtue of bilateral agreements between the municipality and the county are subject to the jurisdiction control of the county engineering department; and those state secondary roads for which maintenance has been assigned to and accepted by the county. Until such time as the board of county commissioners accepts ownership and responsibility for the maintenance of a right-of-way, it shall not be considered part of the public rights -of -way ., ,except in such cases where the title to such ri to way was vested in the county prior to June 11, 19 3, I have included historic photos of the Hickory House road evidencing its existence since at least 1945, The road was originally an extension of State Road 4(A) which was subsequently conveyed to Monroe County. Because the Road has existed since prior to June 11, 1963, and has been owned by the County and is owned by Monroe County, the Road is considered a public-right-of­ssay> 1. Section 194(a)(1) The next inquiry that must be undertaken to determine if the Road may lawfully be abandoned is whether the Road terminates on a body of open water pursuant to the proscription in Code Section 194(a)(1). Significam to understanding Code Section 19- l(a)(1) is the inclusion of Code Section 19-1(aX2) which provides that no dedicated right-of-way may be abandoned where it "provides seem to the public to land on open water". By including part 2 of 19- 1 (a) which specifically addresses a road that terminates at land before open water, it requires part I of 19-1 (a) to only apply to a road that terminates directly at open water. Title determination requires a two -prong analysis to determine whether (1) the Road terminates and (2) if the Road does terminate, whether it terminates in a body of open water. As discussed previously, it is clear the road terminates. As to the second prong, the Road terminates not at the water, but on land. I have included Florida Department of Transportation ("FDOT") historical photographs from 1959, 1971 and 1985. 1 have also included photographs from the Key West library beginning in 1876 with the initial survey of the Surveyor General's Office, and including depictions of the road in the 1940s. The photographic evidence indicates that when .19 Oceanside marina was constructed, fill lengthened the end point of the road creating a substantial strip of land between the end of the Road and water. It should be noted that in order to meet the criteria of Section 19-1 (a)(1) or 19- 1 (a)(2), and thus be ineligible for abandonment under the Code, the Road must terminate not just at a body of water, but at a body of open water, The inclusion of the unmodified to "water" in Section 19(a)(3) belies the Code's intent that "open water" not constitute any body of water, but be used as a specific tenn. 2. Section 19-1(a)(2) This distinction is crucial in appraising whether the Road provides access to the public to land on open water, and thus satisfies the requirements of Section 19-1(a)(2) and is not eligible for abandonment, The Road does not provide access to land on open water. Other than being defined in the Monroe County Comprehensive Plan for limited purposes not applicable here, the County has not defined "'Open Water," While it is difficult to determine the definition of "Open Water, it is much simpler to determine the proper classification of the area of water accessed by the land adjacent to the Road, In the case of Lwiplons,Plus, Inc. v. Hobdy, 650 So. 2d 213 (Fla. 3d DCA 1995), the Third District Court of Appeal undertook to determine the definition of a "boat basin" in interpreting restrictions in a recorded plat. Id. at 214. The Court found that the to was unambiguous, and represented an "enclosed or partly enclosed water area wherein boats are docked or moored." Id. Pictures prior to the dredging of the North boat basin and after the dredging of the boat basin, which was undertaken in approximately 1962, are attached. As clearly evidenced by the photographs, prior to Oceanside's development the basin did not provide boat access and the area in question was dredged as a matimade boat basin for the mooring d docking f vessels in order to provide access to open water via a dredged channel. The water accessed by the strip of land adjacent to the Road is properly terined a "boat basin," s it is partly enclosed and houses docked boats. In fact, any other use by any person at the tip of Peninsular Avenue would interfere with the historic by Oceanside and its riparian rights. Additionally, d even if the boat basin were considered to be ripen water, the Road does not provide access to the public to land on open water, As can clearly be seer in the photos and survey, the land at the terminus of the Road dries not directly abut any water, but rather abuts a significant mangrove community. The County defines a mangreve community as a wetland d l t association subject to tidal influence where the vegetation is dominated by black, white or red mangroves. Here, it is blocked by red mangrovesm Pursuant to Code Section 118, Mangroves are a separate and distinct term from wetlands and submerged lands. The latter, submerged lands, would be inclusive of y body of water, The Cn ty's Section 118 governing shorelines and shoreline setbacks deems such mangroves to be interchange zone between land and water, Under no circumstances can rives be deemed water. Moreover, the Comp. Plan requires the definitions of "the terms 'altered shoreline' and 'unaltered shoreline" to recognize the following general features of h; 1 „ altered shorelines are generally located directly along dredged canals, basins d channelsand/or have been filled or vertically bulkheaded to such a degree that the original natural slope landward of the water is no longer present. 2, unaltered shorelines are generally located along natural non dredged waterways and open water and have a sloping profile typical of the original natural l conditions of the shoreline even though fill or riprap may be present" Comp. Plan Policy 212.2.2 C The rum. Plan makes it clear that open water is associatedwith unaltered shorelines which have a sloping profile typical with the original natural conditions. Here, the shoreline has clearly been altered and does not provide a natural shoreline, but immediately claps to a depth of greater than feet at mean high tide. 3. Section 1 1()(3) Finally, the determination whether the road fails within the bounds of Section 1 l(a)(3) is thus precluded from abandonment, follows the analysis of Section 1 - 1(a)( ), above, As can clearly be seen in the historic photos and survey, the abandonment of the Road would not preclude a way for the public to maintain access to the water, because the land between the Road and the water does not provide access to the water, d only to a thick, fully mature red mangrove community. This interpretation is supported y County Ste s recommendation of approval of Resolution No. 387-2013, for abandonment of a right-of-way located on Pompano Drive, Key Largo. In the Staff Recommendations, it is noted that abandonment would preclude a way for the public to maintain access to water, although currently vegetation is blocking the access." The vegetation in Key Largo was not mangroves, but was non-native invasive species which could be removed was de mininus in size compared to the mangrove community located jaeent to Peninsular Avenues Consequently, the County Commission approved the abandonment in Key Largo based on the determination that the County had not maintained access and allowed vegetation to make access difficult. Based on the Co ty's prior determination and action in Key Largo, the area does not meet the preclusion of Code Section 19 1(a)(3)m 7 In. Conclusion As established above, the Road does not meet any of the requirements of Sec. 19- 1(a), and abandonment by the County is thus permissible under the Code. MONROE GO, PLANNING DEFT BENTMC RESOURCES SURVEY r Survey of Benthic Resources North Marina Area and Sea Waifs of the Marina The following underwater survey was conducted by the undersigned on December 26, 2013. The Survey is divided into two sections — the north marina area and the sea walls of the marina. A 40' bottom construction zone is included along all sea wall surveys. Separate maps are included for the detail needed due to the large scale of the project. This report includes a site description, methodology, observed species list, conclusions, a coral assessment with NOAA reports, mapping, and photos. Site Deserlution: The subject location is a dredged basin bottom area and seawalls surrounding the basin on the Atlantic Ocean side of Stock Island in the Florida Keys — Monroe County. The shoreline is armored with concrete king pile and panel sea wall construction. Plans are to replace and upgrade the walls. There are approximately 1,241 linear feet of sea wall existing on the property. The upland shore is barren of significant vegetation except for a cluster of Red Mangroves in the SE corner of the north marina basin. The upland area of the property is developed with a mold -family residential condominium. The water depth along the sea wall range from 8 feet to 23 That and the bottom of the basin is barren mud with sparse and occasional macro algae vegetation at a maximum density of 5%. The 40' bottom zone waterward of the wafts is predominantly barren of any aquatic vegetation and is soft silt and mud. 2 The north marina area is a small commercial oriented mooring facility with four floating docks connected to the concrete sea walls. The southeast corner has Red Mangroves growing in the shallower water depth near shore. A shallow area is present just off -shore but it is generally deep water with 10 to 12 feet new the sea wall and deeper going waterward to the north and west. The tide was ebbing at near low tide. A linear crossing grid was swum in two directions covering the basin bottom 100 feet from shore (sea wall) at the north marina and 40 feet waterward from the sea walls in the main basin area — fuel dock. The sea wall was carefully inspected ti+om the water line to the bottom interface for density and type of benthos cover. Emphasis was given to any coral colonies that may have encrusted on the walls. Vegetation and benthos were identified, measured and mapped. The mooring area for the vessel using the lift and dock terminus was also swum and mapped. Snorkel gear was used for the survey. The area affected by the walkway was swum in one line centered where it is proposed. The bottom benthos in the 40 foot wide zone was identified by species and density noted in percentage of cover. Any notable or remarkable resources outside of the footprint were noted on the Benthic Map. The visibility underwater during the survey was 13 feet in all directions. GPS coordinates were taken of any coral colonies encountered, photographed and the wall marked in blue paint as to the location. Coordinates were taken in decimal minutes using NAD 93 datum. All density or cover classification estimates of bottom or wall vegetation reference the ocular estimation techniques established in (Fonseca et. al. I "S, Nudds,1977). Benthic community classifications and definitions used in this Survey are based on Florida Administrative Code 62-312.410(1 Xa) and also "Benthic Habitats ofthe Marlda Keys Atlas" by the FWCC tit FKNMS. Coral assessments of all hard surfaces at the site were conducted. The coral colonies present were measured in centimeters and looted on the Benthic Survey Map attached Coral colony data is reported using NOAA protocol and included in this Survey (See Attached). Staeeies of Sneeial Attendon: 'there are no threatened or endangered species of sea grass or oilier benthos observed in this survey. Sea grass species are protected by the State of Florida and there is only one such species found growing on the basin bottom of the north marina site. Shoal Grass is located in a shallow rocky area of the north marina basin in a patch 4' by 6' in size and at a density of 10•A bottom cover. There are no other species of sea grass found. Stony coral is present in two locations on the sea wall and on concrete bags found stacked in the southeast comer ofthe main marina basin (see map above). At the mouth of two concrete flow pipes along the wall, titers are stony coral colonies encrusted on the pipes. These pipes are near but out of any re -construction planning. All coral species found in the Survey are the Lesser Starlet Coral (Siderastrea radians). There h no evidence of the threatened species - Aaropora spp. of stony coral. Aescriation of Bottom Substrate: The substrate ofthe basin bottom is bard base limestone rock covered with a deep layer of mud, organic silt, and fill gravel that has migrated into the water from erosion. Where the bed rock has remained or been exposed in shallower water, the macro algae and in one area — light sea grass is present. The mud bottom 40 feet waterward from the sea walls is predominantly barren of aquatic vegetation. M u Dominant $enthos at the Sites: The basin bottom area 40' out fiom the sea wall are generally barren but in some areas there is up to 5% macro algae with a lack of species diversity. The water is deep and light is minimal to sustain the vegetation. The principal vegetation is the algae species of Penicillus spp., and Halimeda lncrasata4ww. Bataphora oeratea& is the dominant alga on the face of the sea walls. The north marina facility basin has predominantly alga species of BaAWhora oerstead f, PeniciAus spp., and Halimeda incmwa/tuna ChonaWa litloralfs and Laurenefa poitel are intermingled. There is a small 4' by 6' patch of the sea grass Shoal Grass (Halodule wrightll) at 10% density cover in three to four feet of water. 'Ibis is the only area of noted sea grass in the entire basin survey area. See the Benthic Map for density of the bottom vegetation and grass. There are no species of stony or sots coral present in the marina area or on the sea walls north of the east basin wall of the main marina area (Fueling Dock, North Wall. (The white Head Tamed seen in photos is I sq. and used for Density % estimates.} Macro Algae 10% on East Wall — Typical (Bataphora) Flow Pipe GMl Colony Summery: Basin flow culverts or pipes are placed at the entrance to two of the boat docks in the main marina area. These concrete structures are approximately four feet in diameter and they are encrusted with coral colonies at the mouth of two of the pipes (see map). The colonies are all Siderastrea radians or the Lesser Starlet Coral and are only found a few feet into the pipes on the ends. They are waterward of the sea walls approximately throe feet and would be out of any sea wall re -construction activity. It is recommended that plans be developed to protect the coral during any construction work in the future. The reporting for these is separate from the coral found on the walls and represent the numbers and suutbece area measured for colony protection only. Sea Wall Coral Colony Summery: Two Siderastrea radians colonies are found on the east sea wall in 3 feet of water below MLW line. These measure 18cm and 8cm respectively and are mapped above. The colonies are unable to be relocated due to their thin and brittle morphology. Reconstruction permitting of the sea wall would require mitigation for the impact. In addition to these encrusted colonies on sea wall panels, there are concrete bags stacked at the sea wall side of the out -flow culvert in the southeast comer of the main marina basin. The flow pipe or culvert has no corals on it but the bags have nine (9) colonies scattered on them that will need to be mitigated during re-constructlon activity. Since each bag is capable of being removed from the site, it is recommended that these bags (4) be removed and relocated by a trained coral handler to a similar location and orientation in the water complex to rescue the corals. Refer to the reports attached to this Survey for the size and surface area of the colonies. They are all of the species Skbrmstrea radians. A total of l I coral colonies are found within the footprint of a future sea wall repair or re- construction project. Nme ofthese could be relocated as a mitigation measure. There are no soft corals located in the project footprint or the 40 foot water ward bottom zone.
