AGENDA ITEM WORDING: Discussion of request by the property owner, Marine Mammal
Conservancy Inc.(MMC) for a reduction in the outstanding code fines and costs imposed in code
cases CE06030008, CE09030107 and CEI 1060014.
ITEM BACKGROUND:
Code case CE0603008 resulted in a finding of violation of MCC 6-4(a)- unsafe electric
for having a dangerous electrical panel and unsafe building for using rope as handrails by the
Code Compliance Special Magistrate on July 31, 2009. Fines in the amount of $ 250.00 per day
were imposed by the Special Magistrate.
When compliance was not achieved by the compliance date (10/22/2009) fines in the
amount of $2500.00 per day began to accrue.
When compliance was finally achieved (04/19/2010) the outstanding fines totaled
$ 227,250.00. The outstanding costs are $100.00.
Code case CE09030107 resulted in a finding of violations by the Code Compliance
Special Magistrate on July 30, 2009 of -
MCC 110- 1 40(l)- a building permit is required prior to the installation of wooden shed
(Jack's Shed), fences in the water, temporary tents, storage containers and construction trailer;
MCC 130-93(a)(7)- accessory uses without a principal structure is not allowed according
to Monroe County Code;
MCC 6-4(b)- the shed with electrical, a/c and that is being used for habitation has been
deemed unsafe by the building official due to lack of permits, approvals and inspections.
Fines in the amount of $50.00 on violation of MCC 110-140(1); $50 per day on violation
MCC 130-93(a)(7); and $250.00 per day on violation MCC 6-4(b) were imposed by the Special
Magistrate. When compliance was not achieved by the compliance date fines in the amount of
$250.00 per day began to accrue.
When compliance was finally achieved on 04/19/2012, the outstanding fines totaled
$ 318,150.00. The outstanding costs are $200.24.
Code Case CE 11060014 resulted in a finding of violations by the Code Compliance
Special Magistrate on November 17, 2011 of
MCC 110- 1 40(l)- a building permit is required for the permitted installation of
electrical outlets and panels, plumbing pipes and connections, lattice work and sign attached to
fence.
**This is an alleged repeat violation.
MCC I 22-4(b)(3)b-items and use under the elevated structure and within the lattice
enclosure must be permitted or removed, household items, couch, exercise equipment,
appliances and items not defined in limited storage must be removed;
MCC 130-93(a)7- establishing storage or accessory uses including the use of the
unpermitted shower facility, storage under the elevated building, storage of abandoned vessels,
docking of vessel and storage of miscellaneous items throughout the property requires permits,
approvals and inspections;
MCC 6-144(7)b- the listed permits are expired and/or open without final inspections:

"This is an alleged repeat violation.
When compliance was finally achieved the outstanding fines totaled $34,950.00. The
outstanding costs are $1,505.59.
Enclosed is a letter from Robert Coakley on behalf of MMC and the print out of the e-
Gov notes for the code cases.
Resolution 148-2008, which is enclosed, states "It is hereby declared to be the policy of
the County that the County will accept a minimum of twenty-five percent (25%) of accrued fines
and costs in settlement of Code Enforce eats cases after said fines and costs have been imposed
by the special master. The County will not settle any fines or costs prior to compliance."
The total outstanding amount of the fines in all 3 of the code cases is $ 580,350. The total
outstanding amount of the costs in all 3 of the code cases is $1,805.83.
Twenty-five percent of the total fines in all 3 code cases is $145,087.50. Twenty-five
percent of the costs is $451.46.

STAFF RECOMMENDATIONS: Approval of a reduction of fines to the amount of
$145,087.50 pursuant to Resolution 148-2008 but not costs. Costs should be paid in full in the
amount of $1,805.83. If the total amount of the reduced fines plus costs ($146,893.33) is not paid
within 30 days the amount should revert back to the original amount of fines and costs
($582,155.83).

This stranding simulation is being developed to closely simulate the reality of a stranding, Volunteers,
will experience the stranding event from first notification through stabilization and transport. MMC staff
will be available to advise and watch, but participants of this class will get to do the work and solve the
problems themselves. This is must -have experience for NIMC volunteers I
The schedule for the training will have the basic class in the morning, followed by lunch and the
stranding simulation in the afternizan.
And because we can!t think of a nicer group of people to be with, on all the work of the day is over,
we party! BET) whatever, get to know your fellow volunteers and staff and take in the night sky as you

A RESOLUTION OF THE BOARD
MONROE COUNTY, FLORIDA, SETTING A MINIMUM PERCENTAGE
THAT WILL BE ACCEPTED TO SETTLE FINES AND COSTS IMPOSED
IN CODE ENFORCEMENT CASES; PROVIDING FOR REPEAL OF
INCONSISTENT PROVISIONS; PROVIDING FOR AN EFFECTIVE
GT[EREAS, Section 162.09(1), FloridaStatutes, and Monroe County Code Section .3-7 gives
the special master appointed to hear Code Enforcement cases the authority to impose firms after a finding
that the property owner has violated the Monroe County Code and that the property owner thereafter has
not corrected the violation(s); and
WHEREAS, under Section 16 .09(3), Florida Statutes, and Monroe County Code Section 6.3-5,
if the County prevails in prosecuting a case before the special master, the County is also entitled to
recover all costs incurred in prosecuting the ease; and
WHEREAS, a certified copy of the order imposing fines and costs becomes a lien on real and
personal property owned by the violator once recorded with the County Clerk; and
WHEREAS, thereafter, the County has the authority to initiate litigation for foreclosure of the
lien or for a money judgment; and
in the alternative, the County has the ability to enter into an agreement with the
property owner to settle the matter on such terms and conditions As the parties deem mutually acceptable,
in order to resolve the matter short of litigation; and
WHEREAS, the average cost of investigating and prosecuting a Code Enforcement case is at
least 1,101,43, and the Code Enforcement Department projects that 1,200 cases will be brought before
the special master in the current fiscal year, for a total projected cost of approximately 1.2 million; and
WHEREAS, it is appropriate to defray the majority if not all of the cost through the collection of
fan and costs from the actual property owners cited for the violations; and
WHEREAS, it is advantageous for the County not to mitigate the fines and costs by a significant
amount at time of settlement, so that the fines and costs will serve as a deterrent to other property owners
not to violate the Monroe County Code, or so that the imposed fines and costs will act as an incentive for
the property owners found to have violated the Code to correct the Code violations as quickly as possible.
THEREFORE,E IT RESOLVED BY THE BOARDOF COUNTY COMMISSIONERS F
MCA OE COUNTY, that:

Thank you for your support. Here is an explanation of MMC current situation with regard to Code
Enforcement. We appreciate that both you an Roman Gastesi will be delivering this to the County
Commissioners. I look forward to attending their next meeting on May 21st, 2014. Let me know if there is
anything else I need to submit before the meeting.
The Marine Mammal Conservancy (MMC) has a long history and successful history of providing support to
Monroe County for the recovery, rehabilitation and release of stranded marine mammals through out the Florida
Keys.
MMC is cornmitted to protecting Marine Mammals and their habitats through research, rescue, rehabilitation,
release and education. MMC is a US Internal Revenue Service designated 501(c)(3) nonprofit corporation
located on a three -acre lot on the Gulf coast of Key Largo, Florida. MMC is an all volunteer based organization
that receives 100% of its financial support for the work they do through private donations. MKIC does not
receive government funding and could not do this work without the generosity and support of donors. The
Marine Mammal Conservancy, Inc is authorized under a Stranding Agreement with the US National Marine
Fisheries Service to respond, rescue, transport, and rehabilitate stranded and injured marine mammals under the
Marine Marimal Protection Act.

After 5 years, MMC is working with its lenders to restructure the loans so that MMC can continue to support
Monroe County in the future.
During the restructuring of its loans, MMC discovered the substantial fines that had accrued while MMC was
completing construction on the property and obtaining the Certificate of Occupancy.
It took a long time for MMC to complete the construction on its property. MMC relies completely on donations
and does not receive government funds. Therefore, construction could only be done as money became
available. There were substantial delays incurred after strandings while animals were undergoing rehabilitation
on the property. During these periods, construction had to be halted completely due to the potential presence of
the a virus in soil that could kill the animals being rehabilitated.
And there was always the problem of having enough money for construction. Strandings depleted whatever
funds MMC had on hand as substantial money was needed to provide food for the stranded animals and minor
comfort for the often dozen volunteers that worked around the clock with the animals.

The real essence of the continuing violation on the property was the inability of MMC to complete construction
and obtain a Certificate of Occupancy. That condition was in turn a direct consequence of MMC's lack of
money.
MMC told the special master that MMC believed that it could get the necessary funding to complete
construction with 6 months. Unfortunately, MMC was not able to meet that time projection and it took until
May, 2012 to obtain the Certificate of Occupancy, in part due to the additional requirement of hook up to the
new sewer system.

The huge bulk of the fines pending against the MMC property were for the delay in obtaining the Certificate of
Occupancy, in other words for having an open building permit, frankly for a long time. That in turn was a
product of MMC being a purely voluntary organization that relies totally on volunteers and donors to
accomplish its mission.
In all reality, if Monroe County does not grant relief from the fines, MMC will not be able to restructure its
mortgages. The lien holders will foreclose and sell the property and MMC will lose its stranding agreement
with National Marine Fisheries Service.
A brief, and partial, history of MMC's stranding activities follows. MMC will be pleased to provide a more
detail description of its activities, complete with videos and photos of some of the animals that it has
successfully rehabilitated and released.

On March 2nd, 2005 over 80 rough -toothed dolphins stranded themselves on the sand flats off of Marathon,
Florida with little hope of survival. Some were able to maneuver back into deep water, but many more were
sick, trapped, dehydrated, and beaten by the surf. MMC, along with help from other local agencies, responded
to the animals in distress. With darkness approaching, volunteers began evaluating, moving and assembling as
many animals as possible into central locations. However, rescuers had a difficult time walking across the
muddy bottom, often sinking into the thick substrate up to their thighs. This made the task of moving and
gathering the animals together more laborious and time consuming. Many volunteers spent long hours in the
cold water, putting their own needs aside, while physically supporting the animals so that they could breathe.

to the stabilization area throughout the following day.
The next two days were devoted to triage and stabilization. Through health assessments, dolphins were
identified and treated. Animals that were strong enough were thrown fish, while others were caught and fed by
hand. Meanwhile, plans for transfer to better suited rehabilitation sites were already underway. A total of 32
animals were transqorted to rehabilitation sites from Marathon,. 26 of those ace 9-ted by
breaking number!)' Days prior, volunteers had been preparing the MMC site for the arrival of the dolphins.
Three, different rehabilitation areas were set up: two critical care pools, a guarded area off the bay, and a deep
water lagoon for the healthier animals. After transport in a refrigerated truck, the dolphins arrived at MMC and
were distributed amongst the rehabilitation areas. At this point, staff members and veterinarians were able to
conduct more thorough evaluations to determine a detailed health status for each individual. Although some

stay afloat. Therefore, volunteers were needed around the clock to physically support the animals so that they
could breath.
The large number of animals required constant care and attention. There was so much work to accomplish;
MMC had the support of at least 300 volunteers each day. Volunteers spent seemingly endless hours in the
water supporting individual animals, which created intense feelings of awe, inspiration, and dedication. The
ability to assist such an incredible being in its time of need is often a life changing experience.
All of the rehabilitation efforts were focused on the eventual release of the dolphins back into the wild.
Preparations and treatments continued, and those individuals that were healthy enough were moved into our
deep water lagoon. In the lagoon, the dolphins had more room to move around and exercise their muscles. As
the release date approached, the animals were desensitized to human interaction, exposed to a live diet, and
exhibited an ever increasin f wild behaviors.

On May 3rd, 2005, the Marine Mammal Conservancy once again made history, successfully completing the
world's largest, simultaneous release of marine mammals. In hundreds of feet of water, 7 rough -toothed
dolphins were returned to their home after 62 days in rehabilitative care. As perfectly as we could have hoped
for, the dolphins hit the water and took off without ever looking back. Days later, the pod was spotted off
Andros Island in the Bahamas, with all 7 dolphins still together. In total, the pod was tracked for 41 days
following their release, during which time they traveled over 1500 miles, resuming their natural lives.
However, the story doesn't end there. Although this was an incredible accomplishment, MMC's work was not
yet complete. The volunteers still had a job to do. Other animals that were not yet healthy enough for release
still needed MMC's help. The calf that had been bottle-fed by volunteers had grown tremendously in size and
health. Deemed by the National Marine Fisheries Service and MMC to be unsuitable for release due to her
wouna K at the time of the strandin-, the calf was transferred to Gulf World. a managed care facilito where she
is now in the company of their growing population of rough -toothed dolphins. Rehabilitation continued for
months longer until two more animals were healthy enough for release. On September 12th, the remaining
members of the group were finally returned to the ocean! In total, MMC successfully rehabilitated 10 animals
from the original 26 brought into care, putting our success rate well above the national average.
The Castaway Story:
The beautiful, adult, female Atlantic bottlenose dolphin we have come to know as "Castaway" stranded in Ve
Beach, Florida on November I 11h , 2006. She was rescued by Harbor Branch Oceanographic Institute (HBOI)
and brought to Mote Marine Laboratory, where she spent 79 days in rehabilitation. At the time, she was treat
for medical complications. Once deemed healthy, she was transported by HBOI to the open waters of the
Atlantic Ocean and released four times, once into a wild dolphin pod, all of which were unsuccessful. At thi

January 31, 2007, MMC finalized preparations in order to receive Castaway for further rehabilitation. During
her first few days at MMC, it became obvious that she wasn't responding normally to auditory
stimuli. Castaway seemed oblivious to loud noises, the "tinging" of a bucket, and people entering the water o
of her range of vision. So, MMC personnel and veterinarians decided to have Castaway's hearing tested. Dr.
David Mann, from the University of South Florida, conducted 2, complete hearing tests which determined tha�
Castaway was indeed deaf and incapable of hearing any sounds. Dolphins use sound to echolocate, which I

The rehabilitation staff spent 24-hours a day watching over and caring for Castaway in her seawater lagoon, and
she immediately captured the hearts of everyone she met! The staff noticed early that Castaway seemed to
benefit with TLC from her human friends, and staff began introducing her to enrichment toys as well as
behavior modification activities to keep her stimulated. It wasn't long before Castaway showed an affinity for
her caretakers by lying in their laps, rubbing on their snorkels and fins, and swimming alongside them in her
seawater home.
Castaway gave birth to a male calf "Wilson" on June 1 It", 2007. Wilson was born at 41 pounds and was 42
inches long. Wilson came out of the womb whistling and clicking, MMC researchers recording the event for
posterity. Unfortunately, Castaway would not let Wilson fall back to nurse. Staff took over the nursing duties
but without the immunizing agents within Castaway's milk, Wilson failed to thrive and died in our arms on
June 15th.

MMC. Specifically, 2 young women from Dolphins Plus had developed extremely strong bonds with this
'unique mammal, and this relationship of trust and dedication played an important role in the decision to move
her to Dolphins Plus permanently.
Castaway arrived at Dolphins Plus in July of 2007 to a warm welcome and an exuberant, excited staff. Her new
pod was very interested in her, though she didn't pay much attention to them. She tends to spend a great deal
time floating at the surface of the water, instead of swimming with the other dolphins. Our guess at why she
does this is partially attributed to her hearing loss, as well as some neurological abnonnalities. When she does
swim, we quite often notice that she likes to swim backwards. In fact, until Castaway arrived at MMC, the
industry thought that dolphins did not have the ability to swim backwards at all! She also makes up for her lack
of interaction with dolphin friends by spending a lot of time with the human variety. She has been deemed the
Labrador retriever of dolphins and loves beinA "scratched" with a bristle brush. havmN_L9W- i ORWO

During the early evening hours of February 14, 2009 a young Atlantic spotted dolphin we have come to know
affectionately as "Cutter" was rescued and brought to MMC in Key Largo, FL for rehabilitation. This is his
story.
a short period of time, NMFS, a panel of experts, and MMC made the decision on February I Ith that this young
animal — underweight, peculiarly out of habitat and alone — needed rescue. Shortly before MMC's rescue

shallow waters in another area of the Naval Base. While MMC personnel watched, a pod of Atlantic bottlenose
dolphins approached Cutter, and he joined them. Although known to intermingle for brief periods of time in the
wild, spotted dolphins and bottlenose dolphins do not typically form permanent associations. Thus, MMC
personnel followed the group for approximately 4 hours until darkness set in, hoping that the young dolphin
would be permanently adopted by the bottlenose pod.
The next confirmed sighting of Cutter was on February 14th, where he was located in the basin of the Key West
Yacht Club swimming alone once again. MMC was alerted, and we gathered our gear to head to Key West. An
MMC staff member based in the Key West area had already entered the water with Cutter to start desensitizing
him to human presence, and when we arrived, Cutter was swimming circles around Mike as if he had always
been there.

a sound "given" to each newborn dolphin just as humans are given names. During Cutter's stay with us, he
shared his signature whistle time and time again, and it was always heartwarming to hear.
It wasn't long before Cutter trusted the husbandry staff enough to begin eating the fish we offered to him, and
his personality and spirit flourished each day as the nourishment and medication he needed took effect and
began to help his young body feel better again.
Initially placed into a critical care pool, Cutter regained enough strength within 7 days to be placed into MMCs
natural seawater basin, where he could once again hear all of the sounds of the ocean. Soon, he was breaching
and playing "seaweed games" with turtle grass, Sargassurn seaweed, and floating leaves, as he would normally
do in the wild. Cutter was a typical young, male dolphin, He was mischievous, playful, inquisitive, and even
shy at times, looking to caregivers for protection as he would look for support from his mother and podmates in
the wild.
From his first days with MMC, Cutter captured the hearts of hundreds, if not thousands of people who have
heard his story or have had the pleasure of observing him at MMC as part of their volunteer responsibilities.
Cutter also grew noticeably in his short time with us. Thirty-five pounds and a healthy status have not been his
only gains; his personality, too, expanded into a joyful repertoire of normal, healthy dolphin :.-
On May 12, 2009, after spending nearly three months in rehabilitation at MMC, Cutter was successfully
returned to the wild off the coast of Key West!
After searching for more than 2 days to locate a pod of Atlantic spotted dolphins, a pod of approximately
22 Stenellafrontalis were located 4 miles due West of Key West in 130 feet of water. MMC Staff Veterinarian
Dr. Robert 0. Stevens placed Cutter onto the "Sea Breeze", a 45' Corinthian and the team headed out to meet
the R/V Stenella and the pod of Stenellafrontalis they were tracking. A small VBF radio transmitter was
attached to Cutter's dorsal fin to help researchers aboard the RN Stenella track him after his release.
About 10 miles to the southwest of the island, the Sea Breeze slowly approached the starboard side of the RN
Stenella, and both vessels traveled in tandem. The pod quickly took to bow riding off the release boat.
After several minutes of observing their behavior to make sure that they were comfortable with the new vessel's
presence, the R/V Stenella remained slightly behind the release vessel to allow the pod of adults, juveniles, and
calves to join the boat alone, playing in her bow wake or just ahead of her.
Cutter was placed into position for release, and the boat engines were idled. With one, large, adult Stenella
frontalis on the port bow and two, large, adult Stenellafrontalis on the starboard bow, Cutter was released into
the water between them.
After the release, the pod split into smaller groups, swimming in different directions. While the release boat
stayed with one group, the RIV Stenella followed Cutter's signal. The signal allowed the research team to track
Cutter into the night.
Cutter's signal was lost that same night when the research vessel "Stenella" could not follow because of shallow
water. Maritime and aerial surveillance continued throughout the duration of the tracking period, but neither
Cutter's signal nor any of the pod were spotted again. We are all hoping that Cutter is still living life with the
zest we observed at MMC and doing well with his new family!
Cutter's care and release efforts involved the dedication and compassion of hundreds of volunteers and
donors. The costs involved in these efforts were considerable, including the creation and maintenance of a
temporary rehabilitation site in Key West, tagging and tracking equipment, food and medication needed to help
Cutter get better, and fuel for the research and release vessels, as well as the aerial tracking and surveillance
planes and boats.
