ITEM BACKGROUND: The applicant has requested a special permit to utilize the subject property for a temporary construction staging area. The staging area would facilitate a canal restoration /water quality improvement project (Canal #75) being carried out by Monroe County. If approved, the expected commencement date of the staging area is August 30, 2017 and shall Packet Pg. 2891 03 expire August 30, 2018. The equipment and materials to stored include: 1) Conveyor belt system to place the material on the barge located within the canal 2) Clean fill material 3) Trucks and other equipment will enter the property to move the fill but will not be stored on the site PREVIOUS RELEVANT BOCC ACTION: At the December 10, 2014 meeting, the BOCC approved an ordinance establishing §6 -3 of the Monroe County Code, which provides the approval process for temporary construction staging areas with a special permit granted by the BOCC. A special permit may be granted by resolution by the BOCC to allow a property to be used as a construction staging area for an off -site project. The BOCC shall hold a public hearing on the request for a temporary construction staging area and shall issue a resolution granting, granting with conditions or denying the request. The resolution shall take effect on the date of enactment by the BOCC. Applicability. A temporary construction staging area for an off -site project is a permitted activity in any land use (zoning) district, provided it is approved by a special permit and meets the criteria set forth in MCC §6 -3. This special permit shall approve the temporary construction staging area location and use and shall not override or substitute for any other provision of the Florida Building Code and Monroe County Code that require an additional type of building permit, certification or approval. Criteria. Approval of such a special permit shall be granted only if the following criteria are met: (1) The temporary construction staging area shall serve a project being carried out in the vicinity of the construction staging area: In compliance. The proposed staging area is adjacent to the canal (Canal #75) which is subject to the canal restoration project. (3) The temporary construction staging area shall not be located in a tier I designated area: In compliance. The proposed staging area would be located on a property that is in a tier III designated area (Lot 58) and a portion of undesignated common area (Tract A, Clubhouse). (4) The property subject to the request shall be posted and surrounding property owners within 300 feet shall be notified in writing at least 15 days prior to the BOCC public hearing, with the notice located so it shall be easily visible from all public streets and public ways abutting the property: Compliance to be determined prior to public hearing. Planning & Environmental Resources Department staff shall carry out the notification as required. (5) Prior to establishment of the temporary construction staging area, a special building permit approving any associated temporary structure shall be issued in accordance with MCC §6 -112: In compliance. The proposed staging area will not have any structure requiring a building permit other than temporary structures permitted in accordance with §6 -112. (6) No clearing or filling shall occur to accommodate the temporary construction staging area: In compliance. The proposed staging area would be located on a property that is developed. No clearing of native vegetation or filling shall occur to accommodate the staging area. (7) Other than fencing, no temporary structure associated with a temporary construction staging area shall be located in any required setback: In compliance. According to the plans submitted with the application, other than fencing, no structure or storage will be located in a required setback. (8) The temporary construction staging area shall be compatible with existing uses on surrounding properties, as determined by the BOCC. If necessary, prior to issuance of a special permit allowing the temporary construction staging area, the board may attach conditions to any special permit approval to a) avoid substantial harm to public health or safety; b) avoid substantial harm to, or impairment of the normal use of, a public place; and /or c) avoid substantial harm to the environment. (the "Property Owner "), whose business address is 59 Ocean Drive, Key Largo, Florida 33037. WHEREAS, the Property Owner owns that certain real property located at 59 Ocean Drive, Key Largo FL 33037, whose Parcel Identification Number is 555011.0058, which property abuts that body of water commonly known as Canal #75 (the "Canal ") more specifically identified in Exhibit "A" attached hereto and incorporated herein (the "Property "); and WHEREAS, the Property Owners have agreed to assist the County with this demonstration project to aid in the improvement of water quality within the Canal (the "Backfilling Project "); and WHEREAS, as part of the Backfilling Project, the County will utilize the Property to store backfill material and equipment, and will make other modifications as required or allowed by permit, for a period of up to 120 days or until the project is completed, more specifically identified on Exhibit "B" attached hereto and incorporated herein; and WHEREAS, All work on the Property shall be accomplished under permits acquired by the COUNTY or its agents, the State or other regulating agencies; and WHEREAS, from time to time the Property Owner may be required to sign applications or other documents so that appropriate permits, or approvals may be obtained and the Property Owner agrees to sign such documents; and WHEREAS, the Property Owner has requested the Backfilling Project to go forward, and NOW, THEREFORE, for and in consideration as set out below and other mutual covenants herein provided and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties hereby agree as follows: 1. Property Owner shall release, indemnify, defend (with counsel acceptable to the County) and hold harmless the County, their officials, agents, and employees from and against any and all claims, suits, judgments, demands, liabilities, damages, cost and expenses 1I (including but not limited to attorneys' fees, paralegals' fees, consultants' fees and costs at all administrative, pretrial, trial and appellate levels) of any kind or nature whatsoever arising out of or related in any way to the County's backfilling of the Canal for water quality improvement purposes, including without limitation all claims relating to injury to persons (including death) or to property. This provision survives the termination of this Agreement. 2. During the Backfilling Project, fill material will be placed on the subject property using heavy equipment and will be transported from the property via trucks to the canal. The Property Owner, for and in consideration of the mutual covenants previously acknowledged, and of the benefits accruing to Property Owner by the placement of fill material and equipment as referenced above, hereby grants and conveys to the County, its agents and assigns, a temporary construction easement and right of entry, attached hereto and made a part hereof as Exhibit "C" over the Property to access and construct the Backfilling Project as identified in Exhibit "B." This easement shall expire upon the completion of the construction of the Backfilling Project. 3. The County may terminate this Agreement and Easement at any time prior to the beginning of storage on the property upon written notice to the Property Owner. if the County terminates the Agreement the Property owner will not receive monetary consideration under the Agreement; however if the property has been disturbed by the County the property will be replaced to its condition before the County made use of the property. Accordingly, based upon the mutual covenants contained herein, Property Owner may not terminate this Agreement. Owner shall furnish and maintain the easement area free of any obstruction and shall not construct, place, or allow the placing or construction of any obstruction which would interfere with County's safe or proper installation, operation, maintenance, inspection, or staging and use of equipment located in the easement area. Owner affirms that the Property is, on the date of execution of this document, vacant land and contains no obstruction to the Proposed Work, other than those listed in paragraph 6 below, contemplated in this Easement. Any obstruction to the safe or proper operation, maintenance, or staging of equipment located on the land at the beginning of the Project or during the Project not placed on the land by the County or its agents, may be removed by the County at Owner's expense. The Authority shall notify Owner of any such obstruction prior to any action in this regard and allow Owner time to remove obstruction; except for emergency conditions during which the County may require immediate, unobstructed access to the Facilities. 6. The County will erect a construction fence on the Property, as necessary, for the duration of the Backfilling Project. The County will remove palm tree and other ornamental shrubs scattered throughout the Property. Once the Backfilling Project is complete, the County will replace the Property Owner's property to its original or better condition which includes re- grading and/or re- sodding of disturbed areas. 7. The purpose of the project is to place clean fill material to promote flushing within the unnamed manmade canal located between Ocean Drive and Coral Way in Key Largo, Florida. The placement of clean fill material to -6 feet Mean Low Water will be placed on the limestone canal bottom to assist in promoting seagrass growth and flushing. Commencement and Termination Dates of Construction Staging Area: August 1, 2017 through December 1, 2017 Hours of Operation: 8 AM — 6 PM Monday through Friday Types of Equipment and Materials to be stored in Staging Area: 1. Conveyor belt system to place the material on the barge located within the canal. 2. Clean fill material 3. Additionally, trucks and other equipment will need to enter the property to place the clean fill material but will not be stored on site. Proposed Fencing, Screening or Landscaping: A temporary construction fence consisting of 6 foot high chain link fence with canvas privacy screening will be placed around the perimeter of the staging area. Any Proposed Surface Water Management Improvements: The Contractor will be required to implement best management practices within the staging area to control all storm water runoff. The Contractor will provide a final Erosion and Sediment Control plan based upon the Sediment and Erosion Control Plan presented on the Design Drawings. The final Erosion and Sediment Control plan will be sent to Monroe County and Engineer of Record for review /approval before commencement of construction activities. Current Vegetation: The property is predominantly manicured with sod, hedges, and palm trees along the community center.
