BOARD OF COUNTY COMMISSIONERS AGENDA ITEM SUMMARY Meeting Date: March 21, 2012 Division: Growth Manag-ement Bulk Item: Yes X No _ Department: Planning & Environmental Resources Staff Contact Person/Phone #: Steven Biel Senior Planner, Ext. 8732 AGENDA ITEM WORDING: Request for the BOCC to authorize the County Administrator or his designee to provide a letter of no objection, as an affected property owner of RE# 0084140.000000, in order to complete a road abandonment petition filed by Keys Lake Villas, LLC for the abandonment of a platted, undeveloped right-of-way that is located in Section 1, Township 61 South, Range 39 East and Section 6, Township 61 South, Range 40 East, Key Largo, Monroe County, Florida according to P.F. Jenkins Model Land Company plat (PB1-68). ITEM BACKGROUND: The Keys Lake Villas site was previously known as Lakeview Gardens. Prior to Lakeview Gardens, the site was known interchangeably as the Florida Keys RV Park and the Happy Vagabond, which was developed and utilized as a 126-unit RV park with 13 permanent residential units in the form of mobile homes. The petitioner has submitted a road abandonment petition in order to establish the property line that will insulate the I I0-unit affordable housing project approved by Planning Commission Resolution No. P27-08 from potential traffic and create a vegetative buffer as required by HUD. More specifically, the road abandonment petition is for a 30 foot wide, unnamed, unbuilt and not used, platted road with a length of approximately 455 feet for a total of approximately 13,650 SF. As part of a complete petition, the petitioner must submit letters of no objection from all affected property owners. MCC § 19.1(b) states that no right-of-way shall be abandoned unless there is an agreement to do so by all affected property owners. For purposes of this subsection, an affected property owner is the owner of the property which, if the right-of-way is abandoned , will: 1) have access that is currently used by that property owner eliminated; 2) have the only platted access eliminated; 3) have the paved area adjacent to that property increased for turn -around purposes; or 4) be increased in size. Monroe County owns property (Re No. 00084140.000000) that is currently being leased by Humane Animal Care Coalition and is located adjacent to the west of the Keys Lake Villas, LLC property. If the road abandonment request is granted, the property owned by Monroe County would be increased in size and would gain 15 feet along the approximate 455-foot length of the eastern property boundary for a total of approximately 6,825 SF. The tenant has no objection. PREVIOUS RELEVANT BOCC ACTION: On March 19, 2008, the BOCC entered into a development agreement with Northstar Resort Enterprises Corp., requiring the applicant to construct 110 affordable housing units. CONTRACT/AGREEMENT CHANGES: None STAFF RECOMMENDATIONS: Staff recommends the BOCC authorize the county administrator to submit a letter of no objection so the petitioner can file a complete application in order for the request to proceed with setting a public hearing date. This does not constitute any approval by the BOCC for the actual road abandonment. The Future Land Use Map (FLUM) designations of the subject property are Mixed Use / Commercial (MC), Residential Low (RL) and Residential Conservation (RC). The development shall take place entirely on the portion of the site designated as Mixed Use / Commercial (MC). Policy 101.4.5 of the Monroe County Year 2010 Comprehensive Plan states that the principal purpose of the Mixed Use / Commercial (MC) land use category is to provide for the establishment of commercial zoning districts where various types of commercial retail and office may be permitted at intensities which are consistent with the community character and the natural environment. Employee housing and commercial apartments are also permitted. This land use category is also intended to allow for the establishment of mixed use development patterns, where appropriate. Various types of residential and non- residential uses may be permitted; however, heavy industrial uses and similarly incompatible uses shall be prohibited; and 2. The land use district designations of the subject property are Sub Urban Commercial (SC), Sub Urban Residential (SR) and Native Area (NA). The development shall take place entirely on the portion of the site designated as Sub Urban Commercial (SC). Pursuant to §9.5-206 of the Monroe County Code, the purpose of the SC District is to establish areas for commercial uses designed and intended primarily to serve the needs of the immediate planning area in which they are located; and 3. The tier map overlay designation of the subject property is Tier 3; and 4. Pursuant to §9.5-235 of the Monroe County Code, in the Sub Urban Commercial (SC) District, the development shall require major conditional use permit approval; and 5. §9.5-65 of the Monroe County Code provides the standards which are applicable to all conditional uses. When considering applications for a conditional use permit, the Planning Commission shall consider the extent to which: Resolution No. P27-08 Page 3 of 6 File 27050 (a) The conditional use is consistent with the purposes, goals, objectives and standards of the Monroe County Year 2010 Comprehensive Plan and Monroe County Code; and (b) The conditional use is consistent with the community character of the immediate vicinity of the parcel proposed for development; and (c) The design of the proposed development minimizes adverse effects, including visual impacts, or the proposed use on adjacent properties; and (d) The proposed use will have an adverse effect on the value of surrounding properties; and (e) The adequacy of public facilities and services, including but not limited to roadways, park facilities, police and fire protection, hospital and Medicare services, disaster preparedness program, drainage systems, refuse disposal, water and sewers, judged according to standards from and specifically modified by the public facilities capital improvements adopted in the annual report required by the Monroe County Code; and (f) The Applicant for conditional use approval has the financial and technical capacity to complete the development as proposed and has made adequate legal provision to guarantee the provision and development of any open space and other improvements associated with the proposed development; and (g) The development will adversely affect a known archaeological, historical or cultural resource; and (h) Public access to public beaches and other waterfront areas is preserved as a part of the proposed development; and (i) The proposed use complies with all additional standards imposed on it by the particular provision of this chapter authorizing such use and by all other applicable requirements of the Monroe County Code; and 6. Developments requiring a major conditional use permit shall be consistent with the Principles for Guiding Development in the Florida Keys Area of Critical State Concern; and 7. A development agreement was entered into between the Hoard of County Commissioners of Monroe County and Northstar Resorts Enterprises, Inc, concerning the redevelopment of the subject property as set forth in this resolution; and 8. Planning & Environmental Resources Department staff found that the applicant has demonstrated that all of the required standards shall be met and recommended approval of the amendment to a major conditional use permit application with conditions; and WHEREAS, based upon the information and documentation submitted, the Planning Commission makes the following Conclusions of Law: The amendment to a major conditional use permit request is consistent with the provisions and intent of the Monroe County Year 2010 Comprehensive Plan. The redevelopment is consistent with the purpose of the Mixed Use / Commercial (MC) future land use category, as set forth in Policy 101.4.5 of the Monroe County Year 2010 Comprehensive Plan; and 2. The amendment to a major conditional use permit request is consistent with the provisions and intent of Chapter 9.5 of the Monroe County Code. a. The redevelopment is consistent with the purpose of the Sub Urban Commercial (SC) District designation, as set forth in §9.5-206 of the Monroe County Code. b. The land uses of the redevelopment are permitted uses in the Sub Urban Commercial (SC) District, as set forth in §9.5-235 of the Monroe County Code. c. The redevelopment shall meet all of the standards for a conditional use permit as set forth in §9.5-65 of the Monroe County Code; and The amendment to a major conditional use permit request is consistent with the Principles for Guiding Development in the Florida Keys Area of Critical State Concern; and 4. The amendment to a major conditional use permit request is consistent with the development agreement that was entered into between the Board of County Commissioners of Monroe County and Northstar Resorts Enterprises, Inc.; and NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF MONROE COUNTY, FLORIDA, that the preceding Findings of Fact and Conclusions of Law support its decision to APPROVE the request the request by Northstar Resort Enterprises Corp. for an amendment to a major conditional use permit subject to the following conditions: 1. Prior to the issuance of a building permit, the proposed development and buildings shall be found in compliance by the Monroe County Building Department, the Monroe County Floodplain Administrator, the Monroe County Engineer and the Monroe County Office of the Fire Marshal. 2.
