Resolution 217-20171 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 MONROE COUNTY, FLORIDA MONROE COUNTY BOARD OF COUNTY COMMISSIONERS RESOLUTION NO. 217 -2017 A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS ENACTING A TEMPORARY SUSPENSION OF THE EXPIRATION OF ROGO AND NROGO ALLOCATION AWARDS, ISSUANCE OF ALLOCATION AWARD LETTERS, AND DEFERRING THE PROCESSING OF NEW AND EXISTING ROGO AND NROGO APPLICATIONS AND PLANNING COMMISSION REVIEW FOR QUARTER 1 OF THE ROGO/NROGO YEAR 26 (7/13/17 - 10/12/17). WHEREAS, the Board of County Commissioners is the legislative body of Monroe County, Florida; and WHEREAS, the Monroe County Mayor declared a State of Local Emergency on September 5, 2017 due to Hurricane Irma, a "threat of danger to the populace inhabiting Monroe County" and that the County "may require expedient action in order to protect the health, safety and welfare of the community;" and WHEREAS, Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys on September 10, 2017, causing substantial damage to and loss of property; and WHEREAS, the Monroe County Mayor issued another declaration a State of Local Emergency on September 12, 2017 due to Hurricane Irma, a "threat of danger to the populace inhabiting Monroe County" and that the County "may require expedient action in order to protect the health, safety and welfare of the community;" and WHEREAS, during the initial recovery phase, County staff are prioritizing the acceptance, review and issuance of emergency building permits in order to provide expedient action in order to protect the health, safety and welfare of the community; and WHEREAS, as such, the Planning & Environmental Resources Department must shift its focus to assist in the processing of emergency building permits and will temporarily suspend the processing of the Department's other applications, including ROGO/NROGO applications and allocation award deadlines; and WHEREAS, enacting a temporary suspension of the expiration of ROGO and NROGO allocation awards, which were awarded prior to September 5, 2017, and not already expired, to 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 C 32 Lv 33 34 0 35 L- 36 Uj 37 -_-' 38 �`' provide for a period of 180 days to obtain building permits due to the impacts of Hurricane Irma, is necessary to protect the general welfare of the county; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Monroe County is enacting a 180 -day temporary emergency suspension of the expiration of ROGO and NROGO allocation awards, due to the impacts of Hurricane Irma. For those allocation awards for which award letters were issued prior to September 5, 2017, and not already expired, building permits must be issued within 180 days of September 5, 2017 (on or before March 4, 2018), notwithstanding the deadline specified in the award letter. Section 2. Monroe County is deferring the issuance of allocation award letters. Upon issuance of the award letters, applicants will be given 180 days to pick up building permits. Section 3. Monroe County is deferring the processing of new and existing ROGO and NROGO applications and Planning Commission review for Quarter 1 of the ROGO/NROGO Year 26 (7/13/17- 10/12/17). Quarter 1 of the ROGO/NROGO Year 26 (7/13/17- 10/12/17) and Quarter 2 of the ROGO/NROGO Year 26 (10/13/17- 1/12/18) shall be combined for evaluation and award of allocations. Section 4. Effective Date This resolution shall become effective retroactive to September 5, 2017.
