ITEM BACKGROUND: The Monroe County Mayor declared a State of Local Emergency on September 5, 2017 due to Hurricane Irma, a "threat of danger to the populace inhabiting Monroe County" and that the County "may require expedient action in order to protect the health, safety and welfare of the community." Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys on September 10, 2017, causing substantial damage to and loss of property. The substantial damage to and loss of property caused by the high winds and storm surge from Hurricane Irma resulted in large amounts of accumulated marine debris and this debris must be collected and stored pending disposal The County Commission has declared that in the event of a state of emergency, certain work shall be exempted from requiring a permit, to provide expedient action in order to protect the health, safety and welfare of the community. This Resolution authorizes temporary emergency marine debris removal staging areas on parcels of land, as approved by Monroe County, for the collection, storage, and transfer of vessels and marine debris related to Hurricane Irma, effective September 11, 2017, for a duration of up to 180 days. Notwithstanding the permitted uses established in Chapter 130, Land Use Districts, of the Monroe County Land Development Code, temporary emergency debris removal staging areas may be established by Monroe County, for a period not to exceed 180 days, effective September 27, 2017, for the collection, storage, and transfer of debris related to Hurricane Irma subject to the following conditions: 2 of 4 1 (1) The temporary emergency debris removal staging area shall be authorized by the 2 County Engineer, Building Official and /or Planning Director; 3 (2) Temporary emergency debris removal staging areas shall be located on Tier 3 4 designated areas; 5 (3) No clearing of native vegetation or filling shall occur to accommodate the temporary 6 emergency debris removal staging areas; 7 (4) Only fencing, as a temporary structure associated with a temporary emergency debris 8 removal staging area, may be located in any required setback, unless the BOCC 9 determines a temporary structure associated with emergency debris removal staging 10 area may occur temporarily within the setbacks to alleviate increased public 11 expenses; avoid threats to public health and safety; or the work cannot be readily 12 performed otherwise; 13 (5) The County Engineer, Building Official and/or Planning Director may require 14 conditions to a specific temporary emergency debris removal staging area to a) avoid 15 substantial harm to public health or safety; b) avoid substantial harm to, or 16 impairment of the normal use of, a public place; and/or c) avoid substantial harm to 17 the environment; 18 (6) Use of these sites as temporary emergency debris removal staging areas shall be 19 limited to a period not to exceed 180 days from the effective date, September 27, 20 2017, unless extended by a subsequent resolution by the BOCC; and 21 (7) Each site shall be restored to its prior condition following termination of use as a 22 temporary emergency debris removal staging area. 23 3 of 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 - 1 - z F004 �-- X� - oo /: - PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a special meeting held on the day of , 2017.
