ITEM BACKGROUND:
The Monroe County Mayor declared a State of Local Emergency on September 5, 2017 due to
Hurricane Irma, a "threat of danger to the populace inhabiting Monroe County" and that the County
"may require expedient action in order to protect the health, safety and welfare of the community."
Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys on September 10, 2017,
causing substantial damage to and loss of property.
The substantial damage to and loss of property caused by the high winds and storm surge from
Hurricane Irma resulted in large amounts of accumulated debris and this debris must be collected
and stored pending disposal
The County Commission has declared that in the event of a state of emergency, certain work shall be
exempted from requiring a permit, to provide expedient action in order to protect the health, safety
and welfare of the community.
This Resolution authorizes temporary emergency debris removal staging areas on tier 3 parcels of
land, as approved by Monroe County, for the collection, storage, and transfer of debris related to
Hurricane Irma, effective September 11, 2017, for a duration of up to 180 days.

19 WHEREAS, the Board of County Commissioners is the legislative body of Monroe
20 County, Florida; and
21
22 WHEREAS, the Monroe County Mayor declared a State of Local Emergency on
23 September 5, 2017 due to Hurricane Irma, a "threat of danger to the populace inhabiting Monroe
24 County" and that the County "may require expedient action in order to protect the health, safety
25 and welfare of the community;" and
26
27 WHEREAS, Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys
28 on September 10, 2017, causing substantial damage to and loss of property; and
29
30 WHEREAS, the Monroe County Mayor issued another declaration of a State of Local
31 Emergency on September 12, 2017 due to Hurricane Irma, a "threat of danger to the populace
32 inhabiting Monroe County" and that the County "may require expedient action in order to protect
33 the health, safety and welfare of the community;" and
34
35 WHEREAS, the substantial damage to and loss of property caused by the high winds
36 and storm surge from Hurricane Irma resulted in large amounts of accumulated debris; and
37
38 WHEREAS, the debris resulting from Hurricane Irma must be collected and stored
39 pending disposal; and
40
41 WHEREAS, governmental agencies are coordinating efforts to remove debris related to
42 Hurricane Irma and require staging areas for the collection, storage, and transfer of such debris;
43 and
44
45 WHEREAS, all parcels listed above have Tier designations of Tier III, and use as debris
46 removal staging areas is not anticipated to have a negative impact on the environment; and

2 WHEREAS, additional parcels designated as Tier III may be established pursuant to the
3 criteria below; and

5 WHEREAS, in the event of a state of emergency, certain work shall be exempted from

9 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY

15 identified as available areas for such emergency debris removal staging areas:

10 Additional emergency debris removal staging areas shall be authorized based on the following.
11 Notwithstanding the permitted uses established in Chapter 130, Land Use Districts, of the
12 Monroe County Land Development Code, temporary emergency debris removal staging areas
13 may be established by Monroe County, for a period not to exceed 180 days, effective September
14 11, 2017, for the collection, storage, and transfer of debris related to Hurricane Irma subject to
15 the following conditions:
16
17 (1) The temporary emergency debris removal staging area shall be authorized by the
18 County Engineer, Building Official and/or Planning Director;
19 (2) Temporary emergency debris removal staging areas shall be located on Tier 3
20 designated areas;
21 (3) No clearing of native vegetation or filling shall occur to accommodate the temporary
22 emergency debris removal staging areas;
23 (4) Only fencing, as a temporary structure associated with a temporary emergency debris
24 removal staging area, may be located in any required setback, unless the BOCC
25 determines a temporary structure associated with emergency debris removal staging
26 area may occur temporarily within the setbacks to alleviate increased public
27 expenses; avoid threats to public health and safety; or the work cannot be readily
28 performed otherwise;
29 (5) The County Engineer, Building Official and/or Planning Director may require
30 conditions to a specific temporary emergency debris removal staging area to a) avoid
31 substantial harm to public health or safety; b) avoid substantial harm to, or
32 impairment of the normal use of, a public place; and/or c) avoid substantial harm to
33 the environment;
34 (6) Use of these sites as temporary emergency debris removal staging areas shall be
35 limited to a period not to exceed 180 days from the effective date, September 11,
36 2017, unless extended by a subsequent resolution by the BOCC; and
37 (7) Each site shall be restored to its prior condition following termination of use as a
38 temporary emergency debris removal staging area.

41 WHEREAS, governmental agencies are coordinating efforts to remove debris related to
42 Hurricane Irma and require staging areas for the collection, storage, and transfer of such debris;
43 and
44 WHEREAS, the following initial sites have been identified as available areas for such
45 emergency debris removal staging areas:

23 WHEREAS, all parcels listed above have Tier designations of Tier III, and use as debris
24 removal staging areas is not anticipated to have a negative impact on the environment; and
25
26 WHEREAS, additional parcels designated as Tier III may be established pursuant to the
27 criteria below; and
28
29 WHEREAS, in the event of a state of emergency, certain work shall be exempted from
30 requiring a permit, to provide expedient action in order to protect the health, safety and welfare
31 of the community;

33 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
34 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

36 Section 1:

38 Notwithstanding the permitted uses established in Chapter 130, Land Use Districts, of the
39 Monroe County Land Development Code, temporary emergency debris removal staging areas
40 may be established by Monroe County, for a period not to exceed 180 days, effective September
41 11, 2017, for the collection, storage, and transfer of debris related to Hurricane Irma subject to
42 the following conditions:
43
44 (1) The temporary emergency debris removal staging area shall be authorized by the
45 County Engineer, Building Official and/or Planning Director;

1 (2) Temporary emergency debris removal staging areas shall be located on Tier 3
2 designated areas;
3 (3) No clearing of native vegetation or filling shall occur to accommodate the temporary
4 emergency debris removal staging areas;
5 (4) Only fencing, as a temporary structure associated with a temporary emergency debris
6 removal staging area, may be located in any required setback, unless the BOCC
7 determines a temporary structure associated with emergency debris removal staging
8 area may occur temporarily within the setbacks to alleviate increased public
9 expenses; avoid threats to public health and safety; or the work cannot be readily
10 performed otherwise;
11 (5) The County Engineer, Building Official and/or Planning Director may require
12 conditions to a specific temporary emergency debris removal staging area to a) avoid
13 substantial harm to public health or safety; b) avoid substantial harm to, or
14 impairment of the normal use of, a public place; and/or c) avoid substantial harm to
15 the environment;
16 (6) Use of these sites as temporary emergency debris removal staging areas shall be
17 limited to a period not to exceed 180 days from the effective date, September 11,
18 2017, unless extended by a subsequent resolution by the BOCC; and
19 (7) Each site shall be restored to its prior condition following termination of use as a
20 temporary emergency debris removal staging area.

23 The BOCC hereby approves the following sites have been identified as available areas
24 for such emergency debris removal staging areas:
25
26 (1) Parcels of land on Rockland Key owned by Rockland Operations LLC, having real
27 estate numbers 00121980 - 000500, 00122081 - 000200, 00122080 - 000000, and
28 00121980- 000600;
29 (2) Parcels of land on Cudjoe, having real estate numbers 00115950- 000100 and
30 00115940- 000100;
31 (3) A parcel of land on Summerland Key commonly known as the "Shrimp Farm,"
32 having real estate number 00114840- 000000;
33 (4) A parcel of land on Summerland Key owned by Summerland Resort Properties, Inc.,
34 having real estate number 00200610 - 000000;
35 (5) Parcels of land on Big Pine Key commonly known as the `Big Pine Flea Market,"
36 having real estate numbers 00111670 - 000101, 00111420 - 002100, 00111420- 001600,
37 00111420 - 001800, 00111700 - 000000, 00111420- 002200, 00111420 - 001700,
