A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY
COMMISSIONERS AUTHORIZING TEMPORARY EMERGENCY
DEBRIS REMOVAL STAGING AREAS ON PARCELS OF LAND, AS
APPROVED BY MONROE COUNTY, FOR THE COLLECTION,
STORAGE, AND TRANSFER OF DEBRIS RELATED TO HURRICANE
IRMA, EFFECTIVE SEPTEMBER 11, 2017, FOR A DURATION OF UP
TO 180 DAYS.
WHEREAS, the Board of County Commissioners is the legislative body of Monroe
County, Florida; and
WHEREAS, the Monroe County Mayor declared a State of Local Emergency on
September 5, 2017 due to Hurricane Irma, a "threat of danger to the populace inhabiting Monroe
County" and that the County "may require expedient action in order to protect the health, safety
and welfare of the community;" and
WHEREAS, Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys
on September 10, 2017, causing substantial damage to and loss of property; and
WHEREAS, the Monroe County Mayor issued another declaration of a State of Local
Emergency on September 12, 2017 due to Hurricane Irma, a "threat of danger to the populace
inhabiting Monroe County" and that the County "may require expedient action in order to protect
the health, safety and welfare of the community;" and
WHEREAS, the substantial damage to and loss of property caused by the high winds
and storm surge from Hurricane Irma resulted in large amounts of accumulated debris; and
WHEREAS, the debris resulting from Hurricane Irma must be collected and stored
pending disposal; and
WHEREAS, governmental agencies are coordinating efforts to remove debris related to
Hurricane Irma and require staging areas for the collection, storage, and transfer of such debris;
and
WHEREAS, all parcels will be used as debris removal staging areas and are not
anticipated to have a negative impact on the environment; and

WHEREAS, in the event of a state of emergency, certain work shall be exempted from
requiring a permit, to provide expedient action in order to protect the health, safety and welfare
of the community;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1•
Under this state of emergency, the BOCC hereby approves the following sites that have
been identified as available areas for such emergency debris removal staging areas:
1) A parcel of land on Stock Island, commonly known as the "Bernstein Park," having
real estate number 00127300 - 000000;
2) Parcels of land on Rockland Key, having real estate numbers 00121980- 000500,
00122081 - 000200, 00122080 - 000000, and 00121980- 000600;
3) A parcel of land on Rockland Key, having real estate numbers 00122070 - 000700;
4) Parcels of land on Saddlebunch, commonly known as the "Bay Point Park," having
real estate numbers 00160060 - 000000, 00160070 - 000000, 00160080 - 000000,
00160090- 000000, 00160100- 000000, 00160110- 000000, 00160120- 000000,
00160130- 000000, and 00159820- 000000;
5) Parcels of land on Cudjoe, having real estate numbers 00115950- 000100 and
00115940- 000100;
6) A parcel of land on Summerland Key, commonly known as the "Shrimp Farm,"
having real estate number 00114840- 000000;
7) A parcel of land on Summerland Key, having real estate number 00200610 - 000000;
8) A parcel of land on Big Pine Key, commonly known as the "Big Pine Park," having
real estate number 00286360 - 000000;
9) Parcels of land on Big Pine Key commonly known as the "Big Pine Flea Market,"
having real estate numbers 00111670- 000101, 00111420- 002100, 00111420- 001600,
00111420- 001800, 00111700- 000000, 00111420- 002200, 00111420 - 001700,
00111420 - 001500, and 00111420- 001400;
10) Parcels of land on Big Pine Key commonly known as "Seahorse RV Park," having
real estate numbers 00300590- 000000, 00300180 - 000000, 00300670 - 000000, and
00300090 - 000000;
11) A parcel of land on Key Largo, commonly known as the "CEMEX site," having real
estate number 00089490 - 000000; and
12) Parcels of land on Key Largo, commonly known as "Harry Harris Park," having real
estate numbers 00453474- 000312; 00446270 - 000000, 00446280 - 000000, 00446290-
000000, 00446300 - 000000, 00446310 - 000000, 00446320 - 000000, and 00446330-
000000;

1 13) Parcels of land on Key Largo, commonly known as the "Rowell's Marina," having
2 real estate numbers 00508210- 000000 and 00508200- 000000;
3 14) A parcel of land on Key Largo, commonly known as "Key Largo Community Park,"
4 having real estate number 00453474- 000312; and
5 15) Parcels of land on Ramrod, having real estate umbers 00114090- 000000 and
6 00114150- 000000.

10 Additional emergency debris removal staging areas shall be authorized based on the following.
11 Notwithstanding the permitted uses established in Chapter 130, Land Use Districts, of the
12 Monroe County Land Development Code, temporary emergency debris removal staging areas
13 may be established by Monroe County, for a period not to exceed 180 days, effective September
14 11, 2017, for the collection, storage, and transfer of debris related to Hurricane Irma subject to
15 the following conditions:

17 (1) The temporary emergency debris removal staging area shall be authorized by the
18 County Engineer, Building Official and/or Planning Director;
19 (2) Temporary emergency debris removal staging areas shall be located on Tier 3
20 designated areas;
21 (3) No clearing of native vegetation or filling shall occur to accommodate the temporary
22 emergency debris removal staging areas;
23 (4) Only fencing, as a temporary structure associated with a temporary emergency debris
24 removal staging area, may be located in any required setback, unless the BOCC
25 determines a temporary structure associated with emergency debris removal staging
26 area may occur temporarily within the setbacks to alleviate increased public
27 expenses; avoid threats to public health and safety; or the work cannot be readily
28 performed otherwise;
29 (5) The County Engineer, Building Official and/or Planning Director may require
30 conditions to a specific temporary emergency debris removal staging area to a) avoid
31 substantial harm to public health or safety; b) avoid substantial harm to, or
32 impairment of the normal use of, a public place; and/or c) avoid substantial harm to
33 the environment;
34 (6) Use of these sites as temporary emergency debris removal staging areas shall be
35 limited to a period not to exceed 180 days from the effective date, September 11,
36 2017, unless extended by a subsequent resolution by the BOCC; and
37 (7) Each site shall be restored to its prior condition following termination of use as a
38 temporary emergency debris removal staging area.
