Resolution 290-20171 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 MONROE COUNTY, FLORIDA MONROE COUNTY BOARD OF COUNTY COMMISSIONERS RESOLUTION NO,290 -2017 A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS WAIVING THE PLANNING AND ENVIRONMENTAL RESOURCES DEPARTMENT APPLICATION FEE FOR A LETTER OF ROGO EXEMPTION, ADOPTED VIA RESOLUTION 152 -2016, FOR A PERIOD OF 180 DAYS, FOR ROGO EXEMPTION LETTER APPLICATIONS SUBMITTED ON OR AFTER SEPTEMBER 25, 2017, RELATED TO A DWELLING UNIT(S) THAT SUSTAINED DAMAGE DUE TO HURRICANE IRMA, TO FACILITATE RECOVERY FROM IMPACTS ASSOCIATED WITH HURRICANE IRMA. WHEREAS, the Board of County Commissioners is the legislative body of Monroe County, Florida; and WHEREAS, the County protects the life and safety of County residents and visitors through the adopted policies and regulations of the Monroe County Comprehensive Plan and Land Development Code; and WHEREAS, the Monroe County Mayor declared a State of Local Emergency on September 5, 2017 due to Hurricane Irma, a "threat of danger to the populace inhabiting Monroe County" and that the County "may require expedient action in order to protect the health, safety and welfare of the community;" and WHEREAS, Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys on September 10, 2017, causing substantial damage to and loss of property; and WHEREAS, the Monroe County Mayor issued another declaration a State of Local Emergency on September 12, 2017 due to Hurricane Irma, a "threat of danger to the populace Page 1 of 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 inhabiting Monroe County" and that the County "may require expedient action in order to protect the health, safety and welfare of the community;" and WHEREAS, on September 27, 2017, the Monroe County Board of County Commissioners adopted Resolution 214 -2017, temporarily suspending the acceptance and processing of applications to the Planning and Environmental Resources Department, except for ROGO Exemption Requests and Requests for Letters of Development Rights Determinations; and WHEREAS, per Section 138 -22 of the Monroe County Land Development Code, a ROGO Exemption determination is required to establish the lawfulness of a dwelling unit prior to redevelopment of the dwelling unit on site; and WHEREAS, the Monroe County Board of County Commissioners wishes to provide the citizens of the County with the best possible service in the most cost effective and reasonable manner; and WHEREAS, Monroe County opened its offices on September 25, 2017 for emergency permitting services; NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Monroe County is enacting a 180 -day temporary suspension of the Planning and Environmental Resources Department application fee for a Letter of ROGO Exemption, for ROGO Exemption Letter applications associated with a dwelling unit(s) that sustained damage due to Hurricane Irma. The temporary suspension begins on September 25, 2017 and ends on March 24, 2018. Section 2. The 180 -day temporary suspension of application fees is limited to ROGO Exemption Letter requests for dwelling units that have sustained damaged due to Hurricane Irma. Section 3. The Planning and Environmental Resources Department shall issue refunds for qualifying ROGO Exemption Letter application fees collected between the retroactive effective date of this resolution, September 25, 2017, and its adoption. Section 4. Effective Date This resolution shall become effective retroactive to September 25, 2017.
