AGENDA ITEM WORDING: Approval of a Resolution Consenting to and Authorizing the
Florida Department of Transportation to Undertake a Final Trash and Debris Pick Up on State Road
5/U. S. 1 within Monroe County no later than January 16, 2018.
ITEM BACKGROUND: Hurricane Irma impacted the Florida Keys as a category 4 hurricane on
September 10, 2017, leaving debris in its wake. The Florida Department of Transportation (FDOT)
has agreed to undertake one additional final removal of debris on U.S. 1 /State Road 5. This final
pass will be completed no later than January 16, 2018. The resolution expresses the County's
consent to and authorization for FDOT to conduct this additional work. The resolution also provides
that any further dumping of debris on U.S. 1 /S.R. 5 after January 16, 2018, will be enforces as illegal
activity as provided for under state law and local ordinance.

RESOLUTION NO. -2017
WHEREAS, the STATE OF FLORIDA DEPARTMENT OFT NSPOR ATION (the
"Department") has jurisdictional and maintenance authority over SR5/USI in Monroe County,
Florida; and
WHEREAS, as a result of Hurricane Inna, the Department, as part of its normal
maintenance operations, undertook debris removal activities on SR5/US 1; and
WHEREAS, due to the non-performance by the County's pre-positioned debris removal
contractor, Monroe County (the "County"), in an effort to mitigate its damages, sought the
Department's assistance, and the Department agreed that, as part of the Department's hurricane
debris removal on SR5/USI, the Department would also remove hurricane debris from local
roads;and
WHEREAS, the Department's hurricane debris removal activities concluded on October
28,2017-and
WHEREAS, the Department has discovered that additional debris has subsequently been
discarded along SR5/US I in Monroe County; and
WHEREAS, the County has requested, and the Department has agreed to undertake offl-
final debris removal pass along SR5/US I in Monroe County; and I
WHEREAS, the County is desirous of adopting a forrnal resolution of the County
Commission, consenting to and authorizing the Department to - undertake one final debris
removal operation along SR5/USI in Monroe County, with the understanding that thereafter the
Department will resume its normal maintenance operations along SR5/U S I and will no longer b*
responsible for unwarranted debris or discarding along the state right of way;

3, The County, by this resolution, duly adopted by its Board of County Commissioners
and executed by the Mayor, confirms, acknowledges and ratifies that as the date that
the Department completes its final debris removal pass on any section of SR5/USI,
any dumping or discarding along such section of SR5/US I will be enforced as illegal
activity under state law and the Monroe County Code.
4 A certified copy of this resolution shall be forwarded to the Florida Department of
Transportation, ATT: Rudy Garcia, RE. District Six Director of Transportation
Operations, 1000 NW 111"' Avenue, Miami, FL 32172.
5. This resolution shall be effective upon passage and adoption by the Board of County
Commissioners of Monroe County, Florida.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe Count
Florida, at a special meeting of said Board held on the 4 Ih day of December, 2017. 1
