TIME APPROXIMATE: Presentation of the 10th Annual Monitoring report on the implementation of the Incidental Take Permit and associated Habitat Conservation Plan for Florida Key deer and other protected species on Big Pine Key and No Name Key. ITEM BACKGROUND: In 1998, Monroe County (County), the Florida Department of Transportation, and the Florida Department of Community Affairs signed a Memorandum of Agreement in which they committed to develop a Habitat Conservation Plan (HCP) in accordance with Section 10(2)(A) of the Endangered Species Act for these two Keys. The HCP addresses the incidental take of key deer, eastern indigo snake, and lower keys marsh rabbit that may result from development activities in Big Pine Key and No Name Key over the 20 year period of 2003-2023. In order to determine community needs, the County also carried out a planning effort called the concurrently with the HCP. The LCP was initiated in 2000 and adopted in December 2004. The HCP, together with the LCP for Big Pine Key and No Name Key, provide the basis of a Master Growth Management Plan for development on Big Pine Key and No Name Key. In 2006, the U.S. Fish and Wildlife Service issued an Incidental Take Permit (ITP) to Monroe County, the Florida Department of Transportation, and the Florida Department of Community Affairs (now the Department of Economic Opportunity) which became effective on June 9, 2006 and expires on June 30, 2023. The ITP requires specific land use limitations and protections for Big Pine Key and No Name Key, including, but not limited to: The total impact of commercial, institutional, and residential development over the 20 year life H=1.1 of the HCP shall not exceed . For each H value unit of development, three H units of conservation lands shall be acquired, cumulative H restored, and protected in perpetuity. Over the term of this permit, lands with a value of 3.3 shall be acquired. 4EGOIX4K . The H for the present impact 0.0283 Reporting Year 10, from January 1, 2015 to December 31, 2015, is mitigation credit acquired through 2015 (Reporting Year 10) is As you can see, the impact has been .4208 (38.25%), while the mitigation acquired has been 2.9462 (89.28%). On July 18 2013 BOCC meeting, there was a discussion item on the status of the implementation of the Incidental Take Permit and associated Habitat Conservation Plan for the Florida Key Deer and other protected species on Big Pine Key and No Name Key. At that time, the BOCC directed staff to rely on the U.S. Fish and Wildlife Service (USFWS) to update the biological opinion and the Species Assessment Guides where they would include the requirements from the HCP/ITP into the updated biological opinion. Further, that County staff would process an amendment to the Comprehensive Plan and the Code to address the Tier I issue and the end result would be elimination of the HCP/ITP. Staff included amendments to address the Tier I issue in the 2030 Comprehensive Plan Update and the Land Development Code. Staff has also participated in regular coordination meetings with USFWS for at least a year to update the biological opinion. Unfortunately, to date, the County and USFWS have not reached consensus on the best approach for moving forward. USFWS has repeatedly requested that the County develop a countywide HCP to cover all federally listed species. PREVIOUS RELEVANT BOCC ACTION: The BOCC adopted Resolution 562-2003 approving the Livable Communikeys Master Plan for Big Pine Key and No Name Key. This plan incorporates the development conditions of the HCP The BOCC adopted Resolution 119-2003 authorizing submittal of the HCP to the U.S. Fish & Wildlife Service. On July 18 2013, the BOCC directed staff to rely on U.S. Fish and Wildlife Service (USFWS) to 4EGOIX4K . update the biological opinion and the Species Assessment Guides where they would include the requirements from the HCP/ITP into that biological opinion. For January 1, 2015 to December 31, 2015 Average count for full year = 52 The Key deer road-count index value is the average count from multiple road-count surveysthroughout the year on Big Pine Keyand No Name Key. It has also been referred to as the Key deer “census,” “road count,”and“count index”; these labels are often used interchangeably. The road counts are conducted on the USFWS SurveyRoute, monthly in most years. The 2015 road-countindex value was derived from fivestandardized count surveys,one each from February, April, July, September, and November. The totalnumber of deer counted during this period was262, with 68 (26%) identified as males, 155 (59%) as females, and the remaining 39 (15%) were unidentified. For the period January through December2015, the road-count index value (themean of the five roadcounts) was 52. Summaries of the road-count index for 2015 and values from previous years for comparison are presented in Tables 1 and 2. The other index of Keydeer abundance is the mortalityindex (deer deaths documentedon Big Pine and No Name keys). In 2015the total mortalitycount (all known mortalities from all causes) on Big Pine Key and No Name Key was 104. There were 75 mortalities caused bydeer-vehicle collisions (DVCs), or 72% of total reported mortalities. Forty-twoor 56% of DVCs occurred on US-1. The remaining 20 mortalities are attributed to various causes such as combat- inflicted injuries, natural disease, or undetermined causes. This number is lower than the previous five years, and represents a 22% reduction in the average number of observed deer. While this appears as a significant reduction, it is not unprecedented in the census history. In 2001 and 2002, we observed census averages of 44 and 48, respectively. The number of total deer counted was similarly down 35%, from counts of 401 in 2014 to 262 in 2015.Speculatively, this variation in detections may bedue to a combination of low availabilityof fresh water during the unusually dry summer months of 2015, disease prevalence, and observer bias.Monthlyroad-countsurveytotals in the last fiveyears have ranged from 30 to 93, with no apparent correlation with seasonality. The total number of mortalities, DVC mortalities, and overall anthropogenic mortalities were substantially lower than previous years. This dramatic reduction in mortalities maynotrepresentan actual reduction in Key deer mortalities, butrather result frominconsistencies in reporting throughout 2015. Refuge staff was dramaticallyreduced byscheduled staff transitions during the beginning of 2015, and the introduction of replacement staff was gradual throughout the year. In addition, a cooperative agreement with both Countyand state law enforcement officials to augment and improve the response to calls regarding deer injury and mortality was being developed. IV.SUMMARY OF HABITAT MANAGEMENT ACTIVITIES The Monroe County Land Steward is responsible for managing all of the County’s conservation lands, including the County’s mitigation properties on Big Pine and No Name keys.Over the past year, the LandSteward, with the assistance of the County’s contracted crew of invasive exotic plant technicians and other contractors, has conducted numerous invasive exotic plant removal projects, site cleanup projects, and native plantings on Countymitigation properties.Larger-scale work sites included parcels within Sands, Eden Pines, Whispering Pines, and Doctor’s Arm subdivisions. V.KEY DEERMORTALITYRATIO An assessment of the ratio of the number of anthropogenic (human-caused) deaths to average deer seen In 2015, the ratio of human-related deaths (mortalityindex, 84) to average number of deer seen (count index, 52) was 1.6, which is the lowest value recorded over the last sixyears butisnonethelessgreater than the upper boundary of the 95% confidence interval (1.53) defined in the HCP. These are areas where development is allowed by the ITP due to the presence of canals and other barriers to the species. Twoof the tenpermits, however,are for parcels(RE numbers00111420-000500and 00111420-000100)thatarelocated outside of the green- hatched areas, but within the LKMR 500-meter habitat buffer where development is prohibited. The projects consistofa new commercial buildingon each parcel.A precedent for the issuance of these two permits can be found in the issuance of three2014permitsfor an adjacent parcel (RE number 00111420-001300) for a replacement commercial buildingwithtwo residential units. The2014 permits’ issuancewas supported bythe Service in an email dated January15, 2015 that references guidance under the June 14, 2013 letter (2013-CPA-0212) (see Exhibit6).Thesedocumentssupport the issuance of the2015 permits as well. VIII.LOWER KEYS MARSH RABBIT ROAD MORTALITY A summary of reported Lower Keys marsh rabbit road mortality. There were no reported road mortalities of Lower Keys Marsh Rabbits within the HCP area. One mortality due to predation bya free-roaming cat was documented on Big Pine Key bytrail camera on January 20, 2015. These observations indicate, as per the literature on Lower Keysmarsh rabbits(Forys 1995*, Forys and Humphrey1999**), that cats continue to represent a threat to marsh rabbit populations. *Forys, E.A. 1995. Acquired parcels are summarized below: March 13, 1995 –December31,2014 For the reporting period of March 13, 1995 through December 31, 2014(the end of Reporting Year 9), Monroe County acquiredparcels with a total H-value of 2.8419“H”. XV.ACQUISITIONS FOR 2015 January 1, 2015–December 31, 2015 During Reporting Year 10,Monroe County acquired27parcels(6.76acres)with a total “H”of0.0549. XVI.CUMULATIVE “H” ACQUIRED Totalcumulative“H”mitigation credit acquiredthrough 2015 (Reporting Year 10)is2.8968. However, 48ROGO dedication acquisitionswith a combined H-mitigation credit of 0.0494were recently identified froma thorough review of all parcels dedicated to the Countyfor ROGO points. XVIII.ASSESSMENTOFALL MITIGATION PARCELS There are 1,340 mitigation parcels on Big Pine and No Name keys.Manyof these parcels are individual lotswithin developed subdivisions, a situationthatcreates a large amount of shared boundariesbetween developed parcels and mitigation lands.Theeffects of the extensive amount of shared edgesinclude the constant threat of invasive exotic plant invasion and the potential for dumping and encroachment by neighboring residents.The Monroe County Land Steward is working to address these management issues byconducting invasive exotic plant removal projects (with the assistance of the County’s contracted crew of invasive exotic plant technicians and other independent contractors), notifying residents of encroachment issues, andworking with Monroe CountySolid Waste to clean up dumped debris.Additionally, the Land Steward has created an informational brochure for homeowners that provides information regarding invasive exotic plant species, native plants, and the proper disposal of landscape debris. XIX.EXOTIC / NUISANCE PLANT CONTROL PROGRAM MONITORING REPORT Site visits were conducted and aerial photo interpretation was used to determine the level of infestation of invasive exotic vegetation. For the purposes of this report, an “invasive exotic plant” is one that is listedbythe Exotic Pest Plant Council as either a Category I or a Category II species.A total of 64 parcels were found to have aninvasive exotic infestation level greater than 10 percent aerial coverage. These parcels comprise approximately4.8 percent of the total number of parcels (1,340). Eleven of the 64 parcels (17 percent) that are infested with invasive exotic vegetation were acquired byMonroe County within the current 2015 reportingperiod. Therefore, the Countyhas not yet had the opportunity to restore these parcels. The greatest concentration of invasive exoticspecies occurring on Monroe Countymitigation lands is found in Sands Subdivision. However, Monroe County continues to make progress on the eradication of exotics in Sands. Additional invasive exotic plantremoval projects are planned for the coming years, subject to available funding. The Monroe County Land Steward, with the assistance of independent contractors, continues to monitor and treat invasive exotic plant species on Monroe County mitigation lands.Please see Appendix Ifor the“Invasive Exotic Vegetation Status Report” for additional information. These lands are managed by the Monroe CountyLand Steward and, in some instances, the US Fish and Wildlife Service KeyDeer Refuge staff. The typical subdivision lot measures approximately50 ft.x 100 ft. The size and the location of these lots create unique land management challenges, including increased edge effect and potential for encroachment from neighboring residences. For the purposes of this report, an “invasive exotic plant” is one that is listed on the Exotic Pest Plant Council’s list as either a CategoryI or a CategoryII species (list attached). The percent cover of invasive exotics was classified as follows: Level of Infestation% Cover of Invasive Exotics 0Not present 1Less than 10 % 210-20% 320-50% 450-75% 575-100% The complete parcel-by-parcel results of the surveymaybe found in the attached spreadsheet titled “Monroe County Mitigation Lands”. The results are summarized as follows: Level of InfestationNumber of Parcels 01087 1189 225 314 410 515 A total of 64 parcels were found to have invasive exotic infestation level greater than 10 percent. These parcels comprise approximately4.8 percent of the total number of parcels (1,340). Eleven of the 64 parcels containing invasive exotic infestations (or 17 percent) are recent purchases by the County. Therefore, the County has not yet had an opportunity to restore these parcels. New acquisitions are highlighted in yellow on the attached spreadsheet. The greatest concentration of invasive exotics occurring on Monroe CountyMitigation Lands was found in Sands Subdivision. However, Monroe Countycontinues to make progress on the eradication of exotics in Sands. Within the past year, the County hired contractors to conduct invasive exotic removals on several lots within this subdivision. The invasive exotic removals were followed by site cleanup and native vegetation planting as needed. Additional invasive exotic removal projects are planned for the coming years, subject to available funding. The Monroe County Land Steward and the contracted team of Invasive Exotic Plant Technicians continue to monitor and treat invasive exotic plant species on Monroe County Mitigation Lands.
