agreements must be executed as part of this right of way abandonment request. If the conditions of
the agreements are not met by the applicant within 180 days of effective date of the abandonment,
the right of way will revert back Monroe County.

25 REQUEST:
26 The petitioners, Blake Hill, requested abandonment of portion of the right-of-way of Ed Swift
27 Road, in a part of Government Lot 2, Township 67 South, Range 26 East, on Big Coppitt Key,
28 Monroe County, Florida.

30 The applicant made the request in order to combine six lots into one property for a single family
31 home. The petition requests the entire portion of the right-of-way at the terminus of Ed Swift
32 Drive be vacated. The petitioner owns four lots to the east and two lots to the west of the subject
33 right of way. Abandonment of the right of way will allow the property owner to connect all six
34 lots, as the entire portion of right of way would revert to the applicant. The applicant has
35 indicated access to the property for fire and emergency services will be maintained.

37 The petitioner provided a notarized affidavit certifying all existing utilities will be relocated at
38 the expense. This is further confirmed in two separate Agreements To Relocate
39 Utilities for all Florida Keys Aqueduct Authority utilities within the right of way and a Keys
40 Energy Service pole, which hosts AT&T facilities. The permits required to relocate the utilities
41 will be obtained with the proper entities within 180 days of the road abandonment approval. This
42 is to ensure the vested interest of the utilities in the right of way is not affected.

Proposed Abandonment

11The petitioner has submitted a road abandonment petition in order to consolidate the properties.
12The petitioner owns all of the adjacent properties (RE No. 001201030-000100; 00121300-
13000000; 00121430-000000; 00121440-000000; and 00121510-000000) surrounding the
14proposed abandonment therefore, no additional letters of no objection are required. If the
15abandonment is granted, the petitioner is entitled to the entire 23 feet of right of way width.

4 Although letters of no objection were provided from Keys Energy, Florida Keys Aqueduct
5 Authority and AT&T each of these entities request the existing utilities located in the right of
6 way to be abandoned either be relocated or an easement granted. AT&T facilities are located on
7 the Florida Keys Energy pole. The petitioner has provided Agreements to Relocate Utilities for
8 both Florida Keys Aqueduct Authority and Florida Keys Energy which state the applicant agrees
9 to relocate all utilities within the right of way at his expense. The applicant must submit for
10 appropriate permits to move the utilities within 180 days of the road abandonment approval or
11 the right of way will revert to Monroe County.

13 Monroe County Code Section 19-1 - Abandonment of rights-of-way states:
14
15 (a)No dedicated and accepted right-of-way in the county shall be abandoned where:
16 (1)the right-of-way terminates on a body of open water; or
The platted, undeveloped right-of-way does not terminate on a
17
body of open water.

29 (b) In all other cases of abandonment, no right-of-way shall be abandoned unless there is
30 an agreement to do so by all affected property owners. For purposes of this
31 subsection, an affected property owner is the owner of property which, if the right-of-
32 way is abandoned, will:
33 (1) Have access that is currently used by that property owner eliminated;
The requested abandonment is for right-of-way that bisects the
34
roperty at the terminus of Ed Swift Road. All
35
adjacent properties will continue to Ed Swift Road as it is
36
currently.

38 (2) Have the only platted access eliminated;
The requested abandonment is for a portion of right-of-way at the
39
end of Ed Swift Road, which is not used for accessed by other
40
properties.

42 (3)Have the paved area adjacent to that property increased for turn-around
43 purposes; or
A T-turnaround is not required by Engineering Services given the
44
width of the existing right of way.

1 (4) Be increased in size.
The affected property increased in size by 2,415 square feet (.06

acres) however, there is no objection to this increase.

5 (d) All right of way abandonments shall comply with the County Code and Standard
6 Engineering requirements for road, turn-around and fire-rescue access. If required
7 for safety purposes, as determined by either Fire Marshal or County Engineer, a
8 dedicated turn-around area shall be shown on the submitted survey and shall be
9 agreed to in writing and constructed with payment by the property owner(s)
10 requesting abandonment.
No objections were given from Monroe County Fire Marshal,
11
letter dated September 16, 2015. The Fire Marshal requires any
12
installation of an access gate to the property be a minimum of
13
12ft in width to accommodate emergency vehicles. Additionally
14
the Fire Marshal recommended the applicant install a fire
15
hydrant given the location of the property.

Engineering Services, letter dated February 19, 2014, indicated
17
a T-turnaround is not required given the width of the existing
18
right of way.

20 (e) A right of way may be abandoned only at the terminal portion of the road and in its
21 full width unless one of the following applies;
22 1.An adjacent lot owner has on the platted right-of-way or within a setback a
23 substantial structure which predates the Special Session Law 59-1578
24 pertaining to maps, plats and right-of-way. The term "substantial structure"
25 specifically does not include wood or metal fences, sheds or tiki huts or other
26 items not listed which are accessory structures; or
27 2.The abandonment is requested by a County department or governmental agency
28 for a public use; for purposes of this subsection public use is a public facility
29 and/or public/private utility; or
30 3.The right of way area is unusual in size or shape and after abandonment the
31 remaining right of way width will be the same on both sides of the
32 abandonment as shown in Example 1.
The petitioner has requested the entire width of the right of way
33
at the terminus of Ed Swift Road to be abandoned; therefore, this
34
requirement does not apply.

37 The requested abandonment of a portion of the right-of-way of Ed Swift Road, in a part of
38 Government Lot 2, Township 67 South, Range 26 East, on Big Coppitt Key, Monroe County,
39 Florida meets the criteria cited above and is therefore suitable for abandonment.
