AGENDA ITEM WORDING: Approval of a waiver of approximately $615,519.32 in building
permit fees for 208 affordable housing units for the Quarry Apartments project to be built at a
property located on Big Coppitt, Monroe County, Florida, having real estate numbers 00120940-
000100, 00120940 - 000302, and 00120940 - 00201; contingent on final deed restrictions on the units
not to exceed 120% of the median annual adjusted gross income consistent with County Code,
Section 6 -108.
ITEM BACKGROUND:
Monroe County Code Section 6- 108(e) allows BOCC approval for waivers of building permit fees
for affordable housing.
Sec. 6 -108. -Fees.
(e) Waivers. Any entity may apply to the board of county commissioners for fee waivers from the
building permit and building permit application fees for construction or renovation of affordable,
low or very low income housing intended for occupancy for those households with income up to 120
percent of the median annual adjusted gross income as defined by Monroe County. Persons or
entities which have a development order in effect as of February 17, 2010 for affordable housing
may apply for such fee waivers. Persons or entities building affordable housing which uses a higher
percentage median income than 120 percent for qualification for occupancy may apply for a waiver
from building permit and permit application fees only if the specific project for development is being
subsidized with or is leveraging state or federal funding. All such waivers apply only to the
individual housing units being constructed. There are no other waivers of permit fees.
Quarry Partners, LLC., have submitted a proposed development agreement for the development of
208 attached residential dwelling units designated as affordable housing (separate BOCC agenda
item on the January agenda). The development agreement includes provision Section 111.N. that the:
"County also agrees that the building permit fees for the dwelling units are waived..."
To provide the BOCC an estimate of the requested building permit fee waiver in the development
agreement, the attached Building Department fee estimator tool with the estimation is provided. Fees
are estimated at $615,519.32. Fund 180 should be reimbursed for these fees from an alternative
revenue source to assure compliance with Florida Statute 553.80.
PREVIOUS RELEVANT BOCC ACTION:
February 10, 2016 - Ordinance No. 003 -2016 amending the Monroe County Future Land Use Map
from Mixed Use /Commercial Fishing (MCF) and Industrial (I) to Mixed Use /Commercial (MC);
creating Policy 107.1.6 Big Coppitt Mixed Use Area 1, to provide limitations on development and
specific restrictions for the subject property as proposed by Rockland Operations, LLC and
Rockland Commercial Center, Inc. The amendment became effective on November 29, 2016.
February 10, 2016 - Ordinance No. 004 -2016 amending the Monroe County Land Use District
(Zoning) Map from Industrial (I) and Commercial Fishing Area (CFA) to Mixed Use (MU) for the
subject property, as proposed by Rockland Operations, LLC and Rockland Commercial Center, Inc.
The amendment became effective on November 29, 2016.
December 14, 2016 - Resolution No. 323 -2016 approving the reservation of 96 affordable housing
dwelling unit allocations consisting of 44 low income, 20 median income and 32 moderate income
allocations, for a proposed affordable dwelling unit development by Rockland Operations, LLC until
December 15, 2017.
September 27, 2017 - Resolution No. 212 -2017 approving the reservation of 104 affordable housing
dwelling unit allocations consisting of one (1) very low income, 51 low income, 20 median income
and 32 moderate income allocations, for a proposed affordable dwelling unit development by Quarry
Partners, LLC until July 1, 2018. The affordable housing units developed with the 51 low income
ROGO allocations reserved by this resolution must have rent rates limited to 60% median income.
September 27, 2017 - Resolution No. 213 -2017 approving the reservation of 104 dwelling unit
allocations, pursuant to the 380 Agreement with the state and municipalities to transfer 104 Key
West BPAS units to Monroe County for the proposed affordable housing project known as "The
Quarry," by Quarry Partners, LLC until July 1, 2018. The allocations will be reserved upon the
effectiveness of the Comprehensive Land Use Plan of Key West and the execution of the Section
380.032 Agreement by all the Parties.
