AGENDA ITEM WORDING: Approval of a waiver of approximately $30,418.06 in building
permit fees for six affordable housing units for the Henderson building project to be built at a
property located on Big Pine Key, Florida, having real estate number 00111560- 000000, contingent
on final deed restrictions on the units not to exceed 120% of the median annual adjusted gross
income consistent with County Code, Section 6 -108.
Monroe County Code Section 6- 108(e) allows BOCC approval for waivers of building permit fees
for affordable housing.
Sec. 6 -108. -Fees.
(e) Waivers. Any entity may apply to the board of county commissioners for fee waivers from the
building permit and building permit application fees for construction or renovation of affordable,
low or very low income housing intended for occupancy for those households with income up to 120
percent of the median annual adjusted gross income as defined by Monroe County. Persons or
entities which have a development order in effect as of February 17, 2010 for affordable housing
may apply for such fee waivers. Persons or entities building affordable housing which uses a higher
percentage median income than 120 percent for qualification for occupancy may apply for a waiver
from building permit and permit application fees only if the specific project for development is being
subsidized with or is leveraging state or federal funding. All such waivers apply only to the
individual housing units being constructed. There are no other waivers of permit fees.
Carico Inc. has submitted a proposed building permits for an 8,000 square foot, two -story building
consisting of 2,600 square feet of office and /or low intensity retail uses(s) and 5,400 square feet of
residential use comprised of six apartments designated as employee housing (3, one - bedroom
apartments @ 80% and 3 two- bedroom apartments @ 120 %). This development is consistent with
Monroe County Development Order ( #01 -17) issued on March 16, 2017.
To provide the BOCC an estimate of the requested building permit fee waiver, the attached Building
Department fee estimator tool printouts with the estimation is provided. Fees are estimated at
$30,418.06. Fund 180 should be reimbursed for these fees from an alternative revenue source to
assure compliance with Florida Statute 553.80.

SCOPE OF WORK
On March 16, 2017 Monroe County issued Development Order # 01 -17 - a request for a Minor
Conditional Use Permit for CARICO inc. The approved project is for an 8,000 square foot , two -
story, building consisting of 2,600 square feet of office and /or low intensity retail use(s) and
5,400 square feet of residential use. The residential use is comprised of six apartments
designated as employee housing.
The site is located on US Highway 1 on Big Pine Key at approximately Mile Marker 30. It is the
site of the a restaurant that was destroyed by fire in 2003. The non - residential floor area
required for the project is exempt from the Rate of Growth Ordinance as it replaces existing
square footage. The six affordable apartments require affordable housing ROGO allocations.

A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY
COMMISSIONERS APPROVING THE RESERVATION OF SIX (6)
AFFORDABLE HOUSING DWELLING UNIT ALLOCATIONS, PURSUANT TO
LAND DEVELOPMENT CODE SECTION 138- 24(B)(6) FOR A PROJECT
APPROVED BY DEVELOPMENT ORDER NO. 01 -07; A MINOR
CONDITIONAL USE PERMIT FOR THE DEVELOPMENT OF A 8,000 SQUARE
FOOT BUILDING WITH 2,600 SQUARE FEET OF LOW- INTENSITY
COMMERCIAL RETAIL AND OFFICE USES AND SIX ATTACHED
DWELLING UNITS DESIGNATED AS EMPLOYEE HOUSING, ON PROPERTY
LOCATED NEAR U.S. 1 MILE MARKER 30 BAYSIDE AND EAST SANDY
CIRCLE, AND LEGALLY DESCRIBED AS A PARCEL OF LAND IN SECTION
26, TOWNSHIP 66 SOUTH, RANGE 29 EAST, BIG PINE KEY, MONROE
COUNTY, FLORIDA, ALSO KNOWN AS LOTS 12 AND 13 OF AN
UNRECORDED PLAT OF SURVEY BY C. G. BAILEY, REG. FLORIDA LAND
SURVEYOR, NO. 620 AND DATED SEPTEMBER 19, 1952, AND HAVING REAL
ESTATE NUMBER 00111560- 000000, UNTIL JANUARY 17, 2019.
WHEREAS, the State of Florida and all local governments in the Florida Keys (each subject to
Area of Critical State Concern mandates relating to housing affordability) recognize the need for
affordable housing throughout the state and particularly in the Florida Keys where developable land for
housing is extremely limited and expensive; and
WHEREAS, the challenge of providing affordable housing opportunities in the Florida Keys is
one requiring sensible and responsive use of residential unit allocations, including implementation of
long -term preservation mechanisms; and
WHEREAS, due consideration should be given to relevant factors such as the capacity for
allocation recipients to promptly transform allocation awards /reservations into finished and occupied
affordable housing units; and
WHEREAS, the developers have legitimate needs for some assurance that allocations are in fact
and will remain available and/or justified for a reasonable time so that follow - through on initial
commitments will in fact be justified; and
WHEREAS, in accordance with Section 138- 24(b)(6) of the Monroe County Land Development
Code allows the BOCC to authorize reservations for "Rental employee housing projects situated on the
same parcel of land as the nonresidential workplace for the tenants of these projects, upon written
request from the property owner and approved by resolution of the BOCC," and
WHEREAS, the reservation of affordable housing allocations for the anticipated Project does
not exempt the project from applicable requirements in the Monroe County Comprehensive Plan, Land
Development Code, Building Code, and other regulatory requirements; and

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1: Six (6) total ROGO allocations, consisting of three (3) low income allocations (80%
of median income) and three (3) moderate income allocations (120% of median income) for the
development of employee housing units, are reserved for property located near U.S. 1 mile
marker 30 bayside and East Sandy Circle, and legally described as a parcel of land in section 26,
Township 66 South, Range 29 East, Big Pine Key, Monroe County, Florida, also known as lots
12 and 13 of an unrecorded plat of Survey By C. G. Bailey, Reg. Florida Land Surveyor, No. 620
and dated September 19, 1952 until January 17, 2019.
Section 2: The allocations shall be reserved upon the effectiveness of this Resolution.
Section 3: The developer must obtain the building permits for the six (6) employee housing units
on or before January 17, 2019.
Section 4: The developer shall comply with all Monroe County requirements, all applicable
Building Code requirements, and any other oversight agencies.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida at a regular
meeting of the Board held on the 17th day of January 2018.

RE: Henderson Building - Request for Affordable Employee ROGO allocation reservation
Dear Commissioner Neugent,
Since 2015, my development team has been working with your staff to for development approval to
redevelop the two parcels of land on Big Pine Key where the Montego Bay Restaurant was located prior
to its destruction by fire in 2003. The proposed development is for a two story building which includes
both a commercial office (2,600 s.f.) and six affordable employee housing apartments. The office
component of the project will reuse editing nonresidential floor area available from the restaurant use.
The six rental apartments consist of three two bedroom and three one bedroom units. The site plan has
been designed to protect the Pineland habitat located on the northern end of the property. This site, as
you are aware is located on US Highway #1, the required utilities are existing.
Our Conditional Use application was submitted to Monroe County Growth Management in November
2015. Due to several Land Development Code changes, we were delayed in the hearing process whilst
we waited for revisions /rewrite of the LDC to become effective. The initial Development Review
Committee meeting (February 2016) was postponed. The project was heard and approved at the
February 21, 2018 DRC. Since that time, the construction documents have been prepared and the
Building Permit application(s) submitted to the Building Department in December 2017. Today, the
County Commission kindly approved my request to waive the Impact Fees required for the housing
component of the development.
In order to provide for a cost effective and timely construction process, I am asking the BOCC to reserve
six employee ROGO allocations for my project. The three one bedroom units shall be restricted to 80% of
the median income and the three two bedroom units shall be 120% of the median income. I believe this
will serve the needs of the local community - albeit it is just a drop in the bucket to the total demand for
the area. It is our intention to provide these units first to our employees of the real estate office. However,
given the incredible demand for affordable employee housing, we would then offer these apartments to
other County eligible residents.
