Approval of settlement agreement for a code compliance lien
foreclosure case styled Monroe County v. James Howard and Patrick Howard, case number CA-P-
16-239, regarding real property located at 29 Hibiscus Lane, Key Largo, FL 33037.
ITEM BACKGROUND:
On August 14, 2014, the County initiated Code Enforcement Case CE14050075, regarding the
Defendants non-homestead property at 29 Hibiscus Lane, for Defendants failure to connect the
property to the central sewer system. A compliance date of February 1, 2015 was ordered by the
Special Magistrate; Defendants gained compliance on March 4, 2016, accruing fines of $100 per day
for 396 days, for a fine of $39,600.00 plus costs of $1,200.70, totaling $40,800.70 due to the County.
The BOCC approved on October 21, 2015 institution of a civil action against Defendants.
The civil action was filed on May 5, 2016. A tentative agreement was reached between the parties on
June 14, 2016, by which the Defendants will pay a total of $2,401.40 in six equal monthly
installments, which figure includes Plaintiff's hard costs, until sum is paid in full. The basis for the
reduction is extreme financial hardship. The County will dismiss the civil action against Defendants
and discharge the Lis Pendens.
