ITEM BACKGROUND: ITEM BACKGROUND: This property is the subject of a Code Compliance case for unpermitted land clear and fill. As of June 28, 2016, the total amount of the lien is $415,658.12 ($415,000.00 fines and $658.12 costs), and the fine(s) will continue to accrue at $200.00 per day until compliance is achieved. CE13040011: The property owners entered into a "Stipulation to Code Violation and For Time To Comply For First Time Offenses" agreement with Monroe County, admitting to the violations of Monroe County Code as cited; agreeing to a compliance date of October 21, 2010. Compliance was not achieved and daily fine(s) of $200.00 began accruing on October 22, 2010. The Final Order was recorded as a lien on November 17, 2010. The code case remains open for non-compliance and failure to pay outstanding fines and costs. The property is homesteaded and there are no pending foreclosure actions at this time. However, the owner owns a property on 562 Palm Drive, Key Largo, FL (AK1567442), which is not subject to homestead protections. Under the policy adopted in Resolution 057-2014 the available legal options in regard to the County's lien on this property are: 1. Initiate litigation against the property owner for foreclosure, injunction and money judgment; 2. Allow the liens to remain against the property owner, the subject property and any other property owned by the property owner; and/or 3. Reduce the amount of the fines. PREVIOUS RELEVANT BOCC ACTION: On October 22, 2014 Mr. Andrew Tobin contacted Ms. Granger, Assistant County Attorney, requesting a release of the lien in this case. On November 18, 2014 the BOCC heard the item and denied the request until compliance is achieved on the two sewer open code cases, mitigation in the amount of $5,325.82 is paid on the fill and land clearing case, and payment of ten percent of the outstanding fine on the fill and land clearing case is made to the County. SUBJECT PROPERTY: 438 LIME DR KEY LARGO Board of County Commissioners Mayor Heather Carruthers, Dist. 3 Mayor Pro Tern George Neugent, Dist. 2 Danny Kolhage, Dist. 1 David Rice, Dist. 4 Sylvia Murphy, Dist. 5 SUMMARY: As a result of the code compliance case CE10060200, daily fines in the amount of $200.00 per day have accrued for approximately 2075 days for a total of $415,000.00 and continue to accrue. The subject property was purchased by Mr. Mikalson on June 28, 2010 and remains in violation of Monroe County Codes. CASE CE10060200 BACKGROUND: On June 28, 2010 a Monroe County biologist responded to a complaint for unpermitted land clear and filling on this property. A code case ensued and Code Compliance staff posted a Stop Work Order at the property on June 29, 2010. A Notice of Violation/Notice of Hearing was mailed to the property owner on the tax records on July 6, 2010, however prior to the hearing, research revealed that property had been purchased by Travis Mikalson on June 28, 2010, therefore a subsequent notice was mailed to Mr. Mikalson to appear at the hearing on August 26, 2010. On August 10, 2010 the property owner entered into a "Stipulation to code violation and for time to comply for first time offenses" agreement with Monroe County admitting to the violations of Monroe County Code as cited: • MCC Sec. 110-140(1) - THE PLACEMENT OF FILL ON THE PROPERTY REQUIRES PERMITS, APPROVALS AND INSPECTIONS, and • MCC Sec. 114-103 - THE CLEARING AND REMOVAL OF NATIVE TREES REQUIRES A PERMIT. agreeing to a compliance date of October 21, 2010 and further agreeing that a daily fine of $100.00 per count will accrue if compliance is not achieved. Compliance was not achieved by October 21, 2010 and the Final Order was recorded as a lien on November 17, 2010. On October 22, 2014 Mr. Andrew Tobin contacted Ms. Granger, Assistant County Attorney, requesting a release of the lien in this case. On November 18, 2014 the BOCC heard the item and denied the request until compliance is achieved on the two sewer open code cases, mitigation in the amount of $5,325.82 is paid on the fill and land clearing case, and payment of ten percent of the outstanding fine ($29,380.00) on the fill and land clearing case is made to the County. On March 23, 2015 research revealed that that the violation remained, there was no permit application on file for the mitigation and/or restoration of the parcel. Therefore a "Notice of Motion to Authorize Collection Proceedings and Notice of Hearing" was mailed to the property owners. The return receipt was signed on March 25, 2015. A hearing was held on April 30, 2015 and Mr. Mikalson was present and addressed the Special Magistrate. The Special Magistrate granted the motion and issued an "Order Authorizing Foreclosure ". On September 29, 2015 the County received an application for the After -the -fact hammock land clear (3000 SF) and After -the fact fill (75 Cubic Yards). As of June 28, 2016 that application remains unissued. As of June 28, 2016, the total amount of the lien is $415,658.12 ($415,000.00 fines and $658.12 costs), and the costs and fines will continue to accrue until compliance is achieved and the lien is paid. Additionally both sewer connection permits are closed. ITEM BACKGROUND: In addition to his residence at 438 Lime Drive, Mr. Mikalson owns two non - homesteaded properties located at 562 Palm Drive and Block 5 Lot 26 Pamela Villa ("Pamela Villa"), Key Largo, Florida. While all three properties are or have been the subject of code compliance actions, only one of those cases has progressed to a code lien at this point. The County holds a lien which currently totals $293,800.00 on the Pamela Villa property. This lien arose from code case CE10060200 for the placement of fill and land clearing without a permit, inspections and approvals. The County's lien attaches by operation of law to all properties in Monroe County that are owned by Mr. Mikalson, including his residence. Mr. Mikalson wishes to refinance his mortgage on his residence (438 Lime Drive - homesteaded) but is prevented from doing so by the lien imposed due to violations on the Pamela Villa property. Under Resolution 148-2008, the County Attorney's authority to negotiate and settle code liens is limited to those properties on which compliance has been achieved. Since Mr. Mikalson's property is not in compliance, Mr. Mikalson's request for a partial release of lien is being brought to the Board for consideration. Mr. Mikalson's residence (438 Lime Drive) is the subject property of code compliance action CE14090018 for failing to connect to the KLWTD's sewer system. That case has a compliance date of May 1, 2015 so no lien has been recorded yet. His property located at 562 Palm Drive is under violation for the same offense. The compliance date on that property is February 2, 2015. While the Florida Constitution prohibits the County from seeking to foreclose the lien on the Lime Drive property as long as it is homesteaded, the law allows the lien to remain in place. Mr. Mikalson's title company will not provide a commitment unless this lien is satisfied.
