AGENDA ITEM WORDING:
Approval to proceed with litigation to compel the property owner,
George Secchiaroli, to comply with various county ordinances and correct the code violations of
Code Compliance Case CE11070030.
ITEM BACKGROUND:
As a result of the code compliance case CE11070030, daily fines in the
amount of $400.00 per day have accrued for approximately 808 days for a total of $323,200.00 and
continue to accrue. The subject property was purchased by Mr. Secchiaroli on August 24, 2009 and
remains in violation of Monroe County Codes.
PREVIOUS RELEVANT BOCC ACTION:
Following complaints regarding the activities on this property, including unlawful unpermitted living
quarters, a Code Compliance Inspector inspected the property and conducted research for permits
and/or planning approvals. As a result, a Notice of Violation/Notice of Hearing was mailed to the
property owner as per the tax records on July 20, 2011 to appear at the hearing on July 28, 2011.

Monroe County Code as cited and agreeing to a compliance date of October 12, 2011. Compliance
was achieved on all the sign counts and lack of business tax on September 26, 2011, therefore the
County agreed to extend the compliance date and the terms of the Stipulation Agreement on the
three (3) remaining counts until February 8, 2012, listed below:
Sec. 110-140.(1) - To-wit: ALTHOUGH THE PLANNING DEPARTMENT HAS APPROVED
RESOLUTIONS P19-10, VARIANCE TO ALLOW DRY BOAT STORAGE ACCESS DRIVE
AND PARKING. P20-10, AMENDMENT TO A MAJOR CONDITIONAL USE PERMIT TO
IMPROVE THE EXISTING MARINA, AND ADD EMPLOYEE HOUSING UNITS A
BUILDING PERMIT IS STILL REQUIRED.
Sec. 6-144.(7)b - To-wit: PERMIT #10107401, #11100418 HAVE BEEN VOIDED, AND
PERMIT#10101027, #09103686 HAVE NOT RECEIVED FINAL INSPECTIONS.

Stipulation for an extension of time to comply
new compliance date of February 8, 2012 and further agreeing that daily fine(s) of $400.00 will
accrue if compliance is not achieved.
Subsequently the County extended the compliance date five (5) additional times with the final
agreed date of April 11, 2014. Compliance was not achieved and the fines began to accrue on April
12, 2014. On February 18, 2015 the Final Order was recorded as a lien. The code case remains
open for non-compliance and failure to pay outstanding fines and costs.
The property is not homesteaded and there are no pending foreclosure actions at this time.
Under the policy adopted in Resolution 057-2014 the available legal options in regard to the
1. Initiate litigation against the property owner for injunction, foreclosure, writ of execution and
money judgment;
2. Allow the liens to remain against the property owner, the subject property and any other
property owned by the property owner; and/or
3. Reduce the amount of the fines.
