ITEM BACKGROUND: This property is subject of two Code Compliance liens. Case CE10100037 is a result of the failure to maintain the property and all attempts to persuade Mr. Yawt to comply have failed. As of July 23, 2016, fines in the amount of $200.00 per day have accrued for approximately 1899 days for a total of $379,800.00 and continue to accrue until compliance is achieved and the lien is paid. Case CE15030049 is a result of the failure to connect to the central sewer system and is now compliant. CE10100037 : As a result of a complaint and investigation by staff, a hearing was held on April 28, 2011 and no one appeared on behalf of the property owner. The Special Magistrate found the property in violation of Monroe County Code as cited: MCC Sec. 17-2(a) ABANDONED VEHICLES, and MCC Sec. 21-20(a) PREMISES TO BE CLEANED OF TRASH AND DEBRIS AND OVERGROWN VEGETATION, The Special Magistrate imposed a compliance date of May 11, 2011 with a daily fine of $100.00 per count to accrue if compliance is not achieved. Compliance was not achieved, therefore the fine(s) began to accrue and the Final Order was recorded as a lien on June 23, 2011. The case remains open for non-compliance and failure to pay outstanding fines and costs. CE15030049 : As result of a referral from KLWTD for the failure to connect to the central sewer system, a hearing was held on November 19, 2015 and no one appeared on of behalf of the property owner. The Special Magistrate found the property in violation of Monroe County Code as cited and imposed a compliance date of February 18, 2016 with a daily fine of $100.00 if compliance was not achieved by that date. Compliance was not achieved and the Final Order was recorded as a lien on March 4, 2016. Compliance was achieved on July 6, 2015 and the case remains open for failure to pay outstanding fines and costs. 4EGOIX4K 4 The property is not homesteaded and there are no pending foreclosure actions at this time. Under the policy adopted in Resolution 057-2014 the available legal options in regard to the 1. Initiate litigation against the property owner for injunction, foreclosure, writ of execution and money judgment; 2. Allow the liens to remain against the property owner, the subject property and any other property owned by the property owner; and/or 3. Reduce the amount of the fines.
