The petition requests the entire portion of the right-of-way at the terminus of Ed Swift 33 Drive be vacated. The petitioner owns four lots to the east and two lots to the west of the subject 34 right of way. Abandonment of the right of way will allow the property owner to connect all six 35 lots, as the entire portion of right of way would revert to the applicant. The applicant has 36 indicated access to the property for fire and emergency services will be maintained. 37 38 The petitioner provided a notarized affidavit certifying all existing utilities will be relocated at 39 the expense. This is further confirmed in two separate Agreements To Relocate 40 Utilities for all Florida Keys Aqueduct Authority utilities within the right of way and a Keys 41 Energy Service pole, which hosts AT&T facilities. The permits required to relocate the utilities 42 will be obtained with the proper entities within 180 days of the road abandonment approval. If the 15abandonment is granted, the petitioner is entitled to the entire 23 feet of right of way width. 16 17County staff has reviewed this petition and written recommendations of no objection were 18received from the following private utilities and County departments: 19 20Keys Energy Service, letter dated April 11, 2014 21Florida Keys Aqueduct Authority, letter dated June 27, 2014, April 26, 2016 22AT &T, letter dated July 3, 2014 23Comcast, letter dated July 3, 2014 24Monroe County Engineering Services, letter dated February 19, 2014 25Monroe County Fire Marshal, letter dated September 16, 2015 Blake Russell Hill Road Abandonment Petition File # 2015-141 Page 3 of 5 4EGOIX4K 5I 1 Monroe County Code Compliance, email dated March 24, 2014 2 , email dated March 4, 2014 3 4 Although letters of no objection were provided from Keys Energy, Florida Keys Aqueduct 5 Authority and AT&T each of these entities request the existing utilities located in the right of 6 way to be abandoned either be relocated or an easement granted. AT&T facilities are located on 7 the Florida Keys Energy pole. The petitioner has provided Agreements to Relocate Utilities for 8 both Florida Keys Aqueduct Authority and Florida Keys Energy which state the applicant agrees 9 to relocate all utilities within the right of way at his expense. The applicant must submit for 10 appropriate permits to move the utilities within 180 days of the road abandonment approval or 11 the right of way will revert to Monroe County. 12 13 Monroe County Code Section 19-1 - Abandonment of rights-of-way states: 14 15 (a)No dedicated and accepted right-of-way in the county shall be abandoned where: 16 (1)the right-of-way terminates on a body of open water; or The platted, undeveloped right-of-way does not terminate on a 17  body of open water. 18 property. 19 20 (2)the right-of-way provides access to the public to land on open water; or The platted, undeveloped right-of-right does not provide access to 21  the public to land on open water. 22 23 (3)the abandonment would preclude a way for the public to maintain access to 24 the water. The abandonment would not preclude a way for the public to 25  maintain access to water as there is no public access to the water 26 through this right of way. 27 28 29 (b) In all other cases of abandonment, no right-of-way shall be abandoned unless there is 30 an agreement to do so by all affected property owners. For purposes of this 31 subsection, an affected property owner is the owner of property which, if the right-of- 32 way is abandoned, will: 33 (1) Have access that is currently used by that property owner eliminated; The requested abandonment is for right-of-way that bisects the 34  roperty at the terminus of Ed Swift Road. All 35 adjacent properties will continue to Ed Swift Road as it is 36 currently. 37 38 (2) Have the only platted access eliminated; The requested abandonment is for a portion of right-of-way at the 39  end of Ed Swift Road, which is not used for accessed by other 40 properties. 41 42 (3)Have the paved area adjacent to that property increased for turn-around 43 purposes; or A T-turnaround is not required by Engineering Services given the 44  width of the existing right of way. 45 46 (4) Be increased in size. Blake Russell Hill Road Abandonment Petition File # 2015-141 Page 4 of 5 4EGOIX4K 5I The affected property increased in size by 2,415 square feet (.06 1  acres) however, there is no objection to this increase. 2 3 4 (d) All right of way abandonments shall comply with the County Code and Standard 5 Engineering requirements for road, turn-around and fire-rescue access. If required 6 for safety purposes, as determined by either Fire Marshal or County Engineer, a 7 dedicated turn-around area shall be shown on the submitted survey and shall be 8 agreed to in writing and constructed with payment by the property owner(s) 9 requesting abandonment. No objections were given from Monroe County Fire Marshal, 10  letter dated September 16, 2015. The Fire Marshal requires any 11 installation of an access gate to the property be a minimum of 12 12ft in width to accommodate emergency vehicles. Additionally 13 the Fire Marshal recommended the applicant install a fire 14 hydrant given the location of the property. 15 Engineering Services, letter dated February 19, 2014, indicated 16  a T-turnaround is not required given the width of the existing 17 right of way. 18 19 (e) A right of way may be abandoned only at the terminal portion of the road and in its 20 full width unless one of the following applies; 21 1.An adjacent lot owner has on the platted right-of-way or within a setback a 22 substantial structure which predates the Special Session Law 59-1578 23 pertaining to maps, plats and right-of-way. The term "substantial structure" 24 specifically does not include wood or metal fences, sheds or tiki huts or other 25 items not listed which are accessory structures; or 26 2.The abandonment is requested by a County department or governmental agency 27 for a public use; for purposes of this subsection public use is a public facility 28 and/or public/private utility; or 29 3.The right of way area is unusual in size or shape and after abandonment the 30 remaining right of way width will be the same on both sides of the 31 abandonment as shown in Example 1. The petitioner has requested the entire width of the right of way 32  at the terminus of Ed Swift Road to be abandoned; therefore, this 33 requirement does not apply. 34 35 36 The requested abandonment of a portion of the right-of-way of Ed Swift Road, in a part of 37 Government Lot 2, Township 67 South, Range 26 East, on Big Coppitt Key, Monroe County, 38 Florida meets the criteria cited above and is therefore suitable for abandonment. 39 : 40 RECOMMENDATION 41 42 Staff recommends approval of the requested abandonment and required Right of Way Abandonment 43 Agreements for Utility Relocation for Florida Keys Aqueduct Authority and Florida Keys Energy 44 Services.
