Approval of Fifth Amendment to the Assigned Agreement with
The Florida Keys Society for Prevention of Cruelty to Animals, Inc. (FKSPCA) for operation of the
Marathon Animal Shelter for .7% CPI adjustment effective July 1, 2016 and revision to update the
vehicles/units listed in the contract.
ITEM BACKGROUND:
On January 15, 2016, the Contractor requested an annual CPI-U
adjustment. The percentage change in the Consumer Price Index (CPI) for all urban
consumers (CPI-U) for the most recent 12 months as of December 31, 2015 is .7%. On August
23, 2016 the contractor requested surplus vehicles to be donated to the Florida Keys SPCA,
which will be on this agenda for consideration as a separate agenda item. The vehicles listed in
the contract were outdated and this amendment updates the vehicles listed and also provides
for the county to retain possession of truck upon transfer of other surplus vehicles.
PREVIOUS RELEVANT BOCC ACTION:
On April 20, 2011, the BOCC awarded the contract to SHARK. On May 18, 2011, the contract was

amended to change the effective date of the contract from May 01, 2011 to June 01, 2011. On March
19, 2014 the contract was revised to clarify the payment process to be 1/12 of annual contract sum,
plus any unused balances from prior months where the reimbursement request was less than the
monthly reimbursement amount. On April 15, 2015 the BOCC approved a renewal agreement for (5)
years, effective July 01, 2015 to June 30, 2020. On October 21, 2015 the BOCC approved Consent
to Assignment of Agreement for the
Operation of the Marathon Animal Shelter and to provide animal
control services from Mile Marker 16.7 to Mile Marker 70 between Safe Harbor Animal Rescue of the Keys,
, as the Assignor and ,
Inc., (SHARK)Florida Keys Society for Prevention of Cruelty to Animals, Inc.
(FKSPCA) as the Assignee.
CONTRACT/AGREEMENT CHANGES:
Effective 07/01/2016, monthly reimbursement increases by .7% CPI adjustment (as of Dec. 31,
2015) or an additional $1,732.95 per year. Increases annual contract sum from $247,563.36/year;
$20,630.28/mo. to $249,296.31/year; $20,774.70/month. The Agreement should be revised to update

the vehicles/units listed from a 2004 Ford F150 Truck (Unit 0910/082) and a 2005 Ford F150 Truck
(Unit 0910/1706) to include the correct vehicles/units, a 2003 Ford F150 Truck (Unit 0910/1026)
and 2014 Ford FI50 Truc
