ITEM BACKGROUND:
On May 21, 2008, the County entered into a new 5-year lease with the Higgs
Beach restaurant tenant. The former owner, Fran Gonzon - Key West Hospitality, LLC, then sold the business
and assigned the lease to the new owner, Richard Hatch 1000 Atlantic Boulevard, LLC. Under the terms of
the assigned lease Mr. Hatch was required to provide a number of ADA improvements to the restaurant
property which have all been completed. Once all of the ADA improvements were completed the lease
restaurant property. On October, 20, 2010 the BOCC approved a Lease Extension Agreement extending the
Term for ten (10) years with a termination date of August 11, 2023.
PREVIOUS RELEVANT BOCC ACTION:
Approved original lease at the May 21, 2008 BOCC
meeting, approved the consent and assignment of lease at the October 15, 2008 BOCC meeting. On October
20, 2010 the BOCC approved a Lease Extension Agreement extending the Term for ten (10) years with a
termination date of August 11, 2023.
