Approval of Resolution Ratifying Stipulation of Settlement in
Davis v. Monroe County and State of Florida
ITEM BACKGROUND:
Donald Davis is the sole remaining plaintiff from the Collins v. Monroe
County and State of Florida litigation. The Courts have already ruled in favor of the County and
State on the other plaintiffs.
On October 14, 2011, the trial court found that the County and State were liable for the regulatory
-Compensation was to be based on
the fair market value of the property as of July 12, 2002, as determined by a jury in a valuation trial.
The valuation trial was scheduled for October 2016, and the court ordered the parties to attend a
mediation conference on August 28, 2016. At the mediation conference, the parties stipulated that
the fair market value of the property on July 12, 2002, was $175,000. The stipulation eliminates the
need to hold
finding on appeal.
The Stipulation of Settlement memorializes the agreement of the parties but requires approval of the
County Commission to be effective. The resolution formally ratifies the Stipulation of Settlement.
