AGENDA ITEM WORDING: A public hearing to consider approval of a resolution authorizing a

ITEM BACKGROUND: The applicant has requested a special permit to utilize the subject property
for a temporary construction staging area. The staging area would facilitate a canal restoration/water
quality improvement project being carried out by Monroe County. In addition, the applicant is
requesting a temporary setback variance to allow placement of staging equipment in the sideyard
setback of the parcel. In addition, the applicant is requesting a variance from the front yard setback to
allow the placement of dewatering equipment on the property line at the edge of the right of way of
Avenue I. The property owner for the adjacent parcel (400110960.000000) is seeking approval for a
similar request under a separate application. If approved, the expected commencement date of the
staging area is July 1, 2015 and the approval shall expire one year from the date of commencement on
June 30, 2016.
The BOCC adopted an amendment to Section 6-3 of the Monroe County Code of Ordinances to allow
temporary construction staging to occur temporarily within the setbacks to alleviate increased public
expenses and avoid threats to public health and safety, provided the adjacent property owners
submitted letters of no objections to the temporary variance. The applicant has submitted letters of no
objection from the adjacent property owners.
PREVIOUS RELEVANT BOCC ACTION:
At the December 10, 2014 meeting, the BOCC approved an ordinance establishing §6-3 of the Monroe
County Code, which provides the approval process for temporary construction staging areas with a
special permit granted by the BOCC. (Ordinance 018-2014)
At the April 15, 2015 meeting the BOCC approved the advertisement of a Public Hearing for 3:01 pm
(approximate) on May 20, 2015 at the Murray Nelson Government Center in Key Largo.
At the May 20, 2015 meeting the BOCC adopted an ordinance amending Section 6-3, Temporary
Construction Staging areas to allow temporary setback variances as part of the approval process for
construction staging areas.

20 The requested temporary staging is to provide a suitable location for a pipeline to run to and
21 from the canal (#290) and to allow the placement of water separation equipment required to
22 extract and dewater the organic material to meet return water turbidity thresholds.
23
24 The BOCC has the authority to approve temporary construction staging areas in accordance
25 with MCC §6-3. A special permit may be granted by resolution by the BOCC to allow a
26 property to be used as a construction staging area for an off -site project. The BOCC shall
27 hold a public hearing on the request for a temporary construction staging area and shall issue
28 a resolution granting, granting with conditions or denying the request. The resolution shall
29 take effect on the date of enactment by the BOCC.

31 Applicability. A temporary construction staging area for an off -site project is a permitted
32 activity in any land use (zoning) district, provided it is approved by a special permit and
33 meets the criteria set forth in MCC §6-3. This special permit shall approve the temporary
34 construction staging area location and use and shall not override or substitute for any other
35 provision of the Florida Building Code and Monroe County Code that require an additional
36 type of building permit, certification or approval.

38 Criteria. Approval of such a special permit shall be granted only if the following criteria are
39 met:
40
41 (1) The temporary construction staging area shall serve a project being carried out in the
42 vicinity of the construction staging area: In compliance.
43
44 The proposed staging area is adjacent to Canal #290 which is one of the approved canal
45 restoration demonstration projects.
46
47 (2) The temporary construction staging area shall serve a project being carried out by a
48 governmental agency: In compliance.

4 (3) The temporary construction staging area shall be not be located in a tier I designated area.-
5 In compliance.

7 The proposed staging area would be located on a property that is in a tier III designated
8 area.

10 (4) The property subject to the request shall be posted and surrounding property owners
11 within 300 feet shall be notified in writing at least 15 days prior to the BOCC public
12 hearing, with the notice located so it shall be easily visible from all public streets and
13 public ways abutting the property: Compliance to be determined prior to public hearing.

15 Planning & Environmental Resources Department staff shall carry out the notification as
16 required.

18 (5) Prior to establishment of the temporary construction staging area, a special building
19 permit approving any associated temporary structure shall be issued in accordance with
20 MCC §6-112. Compliance to be determined.

22 A permit pursuant to MCC §6-112 will be required for the storage container and
23 temporary fencing .

25 (6) No clearing or filling shall occur to accommodate the temporary construction staging
26 area: In compliance.

28 The proposed staging area would be located on a property that is predominately scarified.
29 No clearing or filling shall occur to accommodate the staging area.
30
31 (7) Other than fencing, no temporary structure associated with a temporary construction
32 staging area shall be located in any required setback, unless the BOCC determines the
33 temporary construction staging may occur temporarily within the setbacks to alleviate
34 increased public expenses; avoid threats to public health and safety; or the project work
35 cannot be readily performed otherwise; and: In compliance.

37 The applicant is requesting a variance from the sideyard setback adjacent to Parcel
38 00I 10960-000000, which is also proposed as a staging area under a separate application.
39 The requested variance is to allow the placement of dewatering equipment on the
40 property line between the two parcels. In addition, the applicant is requesting a variance
41 from the front yard setback to allow the placement of dewatering equipment on the
42 property line at the edge of the right of way of Avenue I.

44 (8) The temporary construction staging area shall be compatible with existing uses on
45 surrounding properties, as determined by the BOCC. If necessary, prior to issuance of a
46 special permit allowing the temporary construction staging area, the board may attach

i conditions to any special permit approval to a) avoid substantial harm to public health or
2 safety; b) avoid substantial harm to, or impairment of the normal use of, a public place;
3 and/or c) avoid substantial harm to the environment. Depending on the nature and
4 anticipated duration of the use, as a condition of approval to the special permit, the board
5 reserves the right to: a) Provide a deadline for termination of the construction staging
6 area; b) Limit the hours of operation; c) Limit the type of equipment and materials on the
7 site; d) Require fencing, landscaping and/or other screening to limit potential visual and
8 noise impacts of the use on adjacent property owners; and e) Provide for temporary
9 setback variances to allow construction staging to occur temporarily within the setbacks,
10 provided the adjacent property owners submit letters of no objections to the temporary
11 variance; and f) Require surface water management improvements to the affected site: In
12 compliance.

14 The applicant provided Letters of No Objection signed by the adjacent property owners.

16 The BOCC reserves the right to attach such conditions to any special permit approval at
17 the May 20, 2015 public hearing.

19 (9) The property shall be restored to its prior condition: Compliance to be determined upon
20 termination of the staging area.

WHEREAS, an application was filed for a special permit allowing a temporary
construction staging area at a property on Avenue I, Big Pine Key, approximate mile marker 31
(Florida Bay side of the Overseas Highway); and
WHEREAS, the property is described as a tract of land in a part of Block 51, Sand's
Subdivision (Plat Book 1, Page 65), having real estate (RE) Number: 00110940.000000; and
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
grant the special permit allowing a temporary construction staging area and temporary setback
variance of 25' from the required 25' front yard setback along the Avenue I right-of-way and 10'
from the required 10' side yard setback along the eastern property line; and
WHEREAS, the temporary construction staging area would facilitate a canal
restoration/water quality improvement project being carried out by Monroe County; and
WHEREAS, due notice has been carried out and a public hearing was held in accordance
with Monroe County Section 6-3; and
WHEREAS, at said public hearing, the Board considered the argument of all parties
present wishing to speak on the matter; and

WHEREAS, the Board makes the following Findings of Fact and Conclusions of Law:
1. The temporary construction staging area is not inconsistent with any of the criterion
provided in Monroe County Code §6-3;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the preceding Findings of
Fact and Conclusions of Law support its decision to approve the request for a special permit,
subject to the following conditions:
1. The temporary construction staging area shall only be used in association with the canal
restoration project for Canal #290 on Big Pine Key,
2. The expected commencement date of the temporary construction staging area is July 1,
2015. The termination date of the temporary construction staging area shall be no later
than June 30, 2016.
3. Upon termination of the temporary construction staging area, the property shall be
restored to its prior condition.

Description of Project: This project is part of the Water Quality Improvement Program being
funded by Monroe County for Canal Restoration Demonstrations. The purpose of the project is to
hydraulically vacuum dredge the accumulated weed rack along the bottom of the unnamed
manmade canal located between Avenues I and J in Sig Pine Key, Florida to a maximum depth of -
8.9 feet Mean Low Water. Due to weed rack loading and lack of flushing, a layer of decomposing
weed rack (organic muck) has accumulated along the bottom of the canal which consumes oxygen
and prevents the inhabitance of fish or other marine organisms. The project entails hydraulically
removing the organic muck layer within the canals to the limestone bottom to promote a viable
benthic community. Six inches of sand will be placed on the limestone canal bottom after dredging
to assist in promoting seagrass growth_
Commencement and Termination Dates of Construction Staging Area: July 1, 2015 through
September 30, 2015
Hours of Operation: 8 AM — 6 PM Monday through Friday
Types of Equipment and Materials to be Stored in Staging Area:
1. Pipeline run to and from the canal and placement of water separation equipment required to
extract and dewater the organic material to sweet return water NTU turbidity thresholds.
Equipment includes shaker/mix tank, clarifier, and belt presses.
2. Additionally; trucks and other equipment will need to enter the property to place and remove
the containers and the final dewatered dredge spoil material.
Setbacks and Request for Variances:
A 5 foot setback can be met on the western property boundary and a 20 foot setback can be met
along the canal as the property line extends to the middle of the canal.
A variance is being requested along —the -eastern property boundary for a 0 foot setback to
accommodate all the equipment. The adioining parcel on the eastern side, Parcel ID
#00110960-000000, is also a „part of the dewatering staging area.
A variance is being requested along the front of the property for a 0 foot setback as the
dewatering a ni anent needs to extend into the Right -of -Way in order to fit all the required
equipment.
Proposed Fencing, Screening or Landscaping: A temporary construction fence consisting of 6
foot high chain link fence with canvas privacy screening will be placed on the property extending to
the front of the property staging area continuing cast connecting with fence on Parcel IDS
00110960-000000 property.

Any Proposed Surface Water Management Improvements: The Contractor will be required to
implement best management practices within the staging area to control all storm water runoff. The
Contractor will provide a final Erosion and Sediment Control plan based upon the Sediment and
Erosion Control Plan presented on the Design Drawings.
Current Vegetation: The property has been landscaped with three varieties of palms: 1 king palm
(Archontophoenix alexandrae), 15 areca palm (Chrysalidocaipus lutescens) maintained at shrub
height, and 1 coconut palm (Cocos nucifera).The existing surface soil conditions are described as an
"urban complex" consisting of fill material covered ,%ith a small aggregate pea gravel.
