The staging area would facilitate a canal restoration/water quality improvement project being carried out by Monroe County. In addition, the applicant is requesting a temporary setback variance to allow placement of staging equipment in the sideyard setback of the parcel. In addition, the applicant is requesting a variance from the front yard setback to allow the placement of dewatering equipment on the property line at the edge of the right of way of Avenue I. The property owner for the adjacent parcel (900110940.000000) is seeking approval for a similar request under a separate application. If approved, the expected commencement date of the staging area is July 1, 2015 and the approval shall expire one year from the date of commencement on June 30, 2016. The BOCC adopted an amendment to Section 6-3 of the Monroe County Code of Ordinances to allow temporary construction staging to occur temporarily within the setbacks to alleviate increased public expenses and avoid threats to public health and safety, provided the adjacent property owners submit letters of no objections to the temporary variance. The applicant has submitted letters of no objection from the adjacent property owners. PREVIOUS RELEVANT BOCC ACTION: At the December 10, 2014 meeting, the BOCC approved an ordinance establishing §6-3 of the Monroe County Code, which provides the approval process for temporary construction staging areas with a special permit granted by the BOCC. (Ordinance 018-2014) At the April 15, 2015 meeting the BOCC approved the advertisement of a Public Hearing for 3:01 pm (approximate) on May 20, 2015 at the Murray Nelson Government Center in Key Largo. At the May 20, 2015 meeting the BOCC adopted an ordinance amending Section 6-3, Temporary Construction Staging Areas, to allow temporary setback variances as part of the approval process for construction staging areas. A special permit may be granted by resolution by the BOCC to allow a 26 property to be used as a construction staging area for an off -site project. The BOCC shall 27 hold a public hearing on the request for a temporary construction staging area and shall issue 28 a resolution granting, granting with conditions or denying the request. The resolution shall 29 take effect on the date of enactment by the BOCC. 30 31 Applicability. A temporary construction staging area for an off -site project is a permitted 32 activity in any land use (zoning) district, provided it is approved by a special permit and 33 meets the criteria set forth in MCC §6-3. This special permit shall approve the temporary 34 construction staging area location and use and shall not override or substitute for any other 35 provision of the Florida Building Code and Monroe County Code that require an additional 36 type of building permit, certification or approval. 37 38 Criteria. Approval of such a special permit shall be granted only if the following criteria are 39 met: 40 41 (1) The temporary construction staging area shall serve a project being carried out in the 42 vicinity of the construction staging area: In compliance. 43 44 The proposed staging area is adjacent to Canal #290 which is one of the approved canal 45 restoration demonstration projects. 46 47 (2) The temporary construction staging area shall serve a project being carried out by a 48 governmental agency: In compliance. Page 2 of 4 (File #2015-042) I The canal restoration project is being carried out by Monroe County, Florida. 2 3 (3) The temporary construction staging area shall be not be located in a tier I designated area: 4 In compliance. 5 6 The proposed staging area would be located on a property that is in a tier III designated 7 area. 8 9 (4) The property subject to the request shall be posted and surrounding property owners 10 within 300 feet shall be notified in writing at least 15 days prior to the BOCC public 11 hearing, with the notice located so it shall be easily visible from all public streets and 12 public ways abutting the property: Compliance to be determined prior to public hearing. 13 14 Planning & Environmental Resources Department staff shall carry out the notification as 15 required. 16 17 (5) Prior to establishment of the temporary construction staging area, a special building 18 permit approving any associated temporary structure shall be issued in accordance with 19 MCC §6-112: Compliance to be determined. 20 21 A permit pursuant to MCC §6-112 will be required for the storage container and 22 temporary fencing. 23 24 (6) No clearing or filling shall occur to accommodate the temporary construction staging 25 area: In compliance. 26 27 The proposed staging area would be located on a property that is predominately scarified. 28 No clearing or filling shall occur to accommodate the staging area. 29 30 (7) Other than fencing, no temporary structure associated with a temporary construction 31 staging area shall be located in any required setback, unless the BOCC determines the 32 temporary construction staging may occur temporarily within the setbacks to alleviate 33 increased public expenses; avoid threats to public health and safety; or the project work 34 cannot be readily performed otherwise: In compliance. 35 36 The applicant is requesting a variance from the sideyard setback adjacent to Parcel 37 00110940-000000, which is also proposed as a staging area under a separate application. 38 The requested variance is to allow the placement of dewatering equipment on the 39 property line between the two parcels. In addition, the applicant is requesting a variance 40 from the front yard setback to allow the placement of dewatering equipment on the 41 property line at the edge of the right of way of Avenue I. 42 43 (8) The temporary construction staging area shall be compatible with existing uses on 44 surrounding properties, as determined by the BOCC. Depending on the nature and anticipated duration of the use, as a condition of approval to the special permit, the board reserves the right to: a) Provide a deadline for termination of the construction staging area; b) Limit the hours of operation; c) Limit the type of equipment and materials on the site; d) Require fencing, landscaping and/or other screening to limit potential visual and noise impacts of the use on adjacent property owners; and e) Provide for temporary setback variances to allow construction staging to occur temporarily within the setbacks, provided the adjacent property owners submit letters of no objections to the temporary variance; and f. Require surface water management improvements to the affected site; and: In compliance. The applicant provided Letters of No Objection signed by the adjacent property owners. The BOCC reserves the right to attach such conditions to any special permit approval at the May 20, 2015 public hearing. The purpose of the project is to hydraulically vacuum dredge the accumulated weed rack along the bottom of the unnamed manmade canal located between Avenues I and J in Big Pine Key, Florida to a maximum depth of - 8.9 feet Mean Low Water. Due to weed rack loading and lack of flushing, a layer of decomposing weed rack (organic muck) has accumulated along the bottom of the canal which consumes oxygen and prevents the inhabitance offish or other marine organisms. The project entails hydraulically removing the organic muck layer within the canals to the limestone bottom to promote a viable benthic community. Six inches of sand will be placed on the limestone canal bottom after dredging to assist in promoting seagrass growth.
