Discussion of a Memorandum of Agreement between Monroe
County and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida
concerning Florida Forever projects in the Keys.
ITEM BACKGROUND:
This proposed Memorandum of Agreement (MOA) between the State of
Florida and Monroe County (County) is meant to establish a formal, cooperative and coordinated
partnership for acquiring property located within the Florida Forever project boundaries in the Keys.
The MOA is to be implemented through the Trustees of the Internal Improvement Trust Fund
(Trustees) and its agent, the Department of Environmental Protection (DEP)/Division of State Lands
(DSL), and the County and/or its agent, the Monroe County Comprehensive Plan Land Authority
(MCLA).
The MOA is similar to others that DEP/DSL has entered into with other local governments in
Florida. It allows the County/MCLA, subject to DEP/DSL approval, to use County/MCLA funds to
acquire properties inside the project boundaries or to act as an agent for the Trustees through
DEP/DSL. In the first case, title would vest with the County/MCLA. In the latter case, the
County/MCLA would follow all DEP/DSL statutory and administrative requirements and cost share
(50%) of such acquisitions, including pre-acquisition costs, with DEP/DSL. Title would vest with
the Trustees. Nothing in the MOA prevents DEP/DSL from purchasing, in the future, properties
previously acquired by the County/MCLA.
DEP/DSL will require a 50% match from the County/MCLA for properties it acquires within the
project boundaries unless otherwise agreed to by DEP/DSL. We understand this was a partnership
arrangement involving passage of the Florida Keys Stewardship Act of 2016 (see attached County
letter dated February 19, 2014).
Two attachments apply. Attachment A lists the Florida Forever projects in the Keys. Attachment B
is a confidentiality agreement.
The MOA will end on June 30, 2018, unless extended, but may be terminated by either party on
