Approve Memorandum of Agreement between Monroe County
and Florida Department of Environmental Protection (FDEP) establishing a protocol for the County
to act as agent to purchase lands within the State of Florida Forever program boundaries.
ITEM BACKGROUND:
Monroe County has actively sought Florida Department of
Environmental Protection Department (FDEP) purchase of land within the Florida Forever
boundaries, within the Florida Keys, since the slowdown in the economy.
With the passage of the Florida Keys Stewardship Bill, it is anticipated FDEP will begin purchasing
land more frequently. This Memorandum of Agreement establishes the protocol to be used, if the
County (or as identified in a separate agenda item, the Monroe County Land Authority acting as
agent for the County) works with FDEP to determine parcels where a joint purchase can be made.
The agreement indicates a cost share for purchases of 50% for each party, or if FDEP agrees, the
purchase price can be a greater percentage funded by the State of Florida. Further, it outlines
required survey and title work details associated with a real estate contract.
