Authorization to initiate litigation against Freddy E. Demeritt and
Milagros C. Demeritt and the property located at 802 Largo Rd., Key Largo, Florida, to seek
compliance with the County code and enforce a lien arising from Code Compliance wastewater
hookup case number CE13050020.
ITEM BACKGROUND:
This property has been the subject of a Code Compliance case for failure
to hook up to central sewer. The fines are fixed at $11,100.00.
CE13050020:
The Special Magistrate found the property in violation and ordered a compliance
date of December 1, 2014. The property owner did not gain timely compliance by the deadline
was recorded on February 18, 2015. The property owner achieved compliance on March 23, 2015.
Fines accrued at $100.00 per day for 111 days. The code case remains open for failure to pay
outstanding fines and costs.
On July 28, 2015, the County offered the property owner a 75% reduction of the fines. The property
owner declined the offer and requested a mitigation hearing. The mitigation hearing was held on
of 75% reduction reasonable and generous; and the respondent to pay the County a sum of $3,303.15
($2775.00 in fines and $528.15 in costs) within 30 days of the order or the fine shall be restored to
the unmitigated total fine. Fines remain unpaid.
The property is compliant;

The property owner does not own any additional real property;
The public records of Monroe County indicate no pending foreclosure action by the mortgagee.
Under the policy adopted in Resolution 057-2014 the available legal options with respect to the
