ITEM BACKGROUND: to the SAFF Advisory Board. In accordance with Section 2-477 of the Monroe County Code, the SAFF Advisory Board considered the application and recommended an award of $7,184.14. The recommendation was item L- m regarding DAS. Ms. Jennifer Powell, President of the DAS Board of Directors, confirmed that (a) certification to operate a shelter, and as a result, (b) DAS had entered into a management agreement with Miami- shelter. At the May BOCC meeting, the BOCC approved the remainder of the SAFF applications, but directed staff to bring more information back on the DAS application in July. At the July BOCC meeting, staff requested further direction regarding the SAFF funds for DAS. Ms. Powell and a representative from The Lodge spoke on behalf of DAS, and indicated that DAS was continuing to work to lift the suspension. The BOCC directed staff to prepare a contract for the SAFF funds with DAS. FOR FY 17 SHARED ASSET FORFEITURE FUNDS WHEREAS, the Monroe County Shared Asset Forfeiture Fund (SAFF) was established in 1999, and the interest earned on the proceeds in the SAFF is distributed annually in the form of grants to eligible community groups based on recommendations of the SAFF Advisory Board; and WHEREAS, grant funds are to be used for one of the following purposes, 1) crime prevention, 2) drug abuse or prevention, 3) mental and physical health care for minors; and WHEREAS, in February 2016, Domestic Abuse Shelter, Inc. (DAS), a not-for-profit entity, submitted an application to the SAFF Advisory Board for a FY 2017 SAFF grant; and WHEREAS, under Section 2-479(d) of the Monroe County Code, the County Administrator presents the recommendations of the SAFF Advisory Board to the Board of County Commissioners (BOCC); and WHEREAS, under Section 2-479(f) of the Monroe County Code, for those items approved by the BOCC that require agreements with third party vendors, such agreements must be entered into between the vendors and the Sheriff, and the containing such terms as the Sheriff determines necessary ensure that the funds are properly spent WHEREAS, on May 3, 2016, the center and imposing certain conditions; and WHEREAS, DAS immediately began working on a corrective action plan to avoid complete revocation of its certification; and WHEREAS, at its July 20, 2016 meeting, the BOCC approved the award of SAFF funds to DAS, as recommended by the SAFF Advisory Board, but directed County staff to bring back an agreement with DAS to ensure that DAS would receive the award only after DAS certification as a domestic violence shelter within Monroe County had been restored, and further specifying that any funds awarded would only be used within Monroe County; and WHEREAS, DAS and MCSO have negotiated and executed an agreement to address the BOCC requirements, a copy of which is attached to this Resolution as Attachment A. 1 4EGOIX4K 5E NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF MONROE COUNTY, FLORIDATHAT , 1. Hall, Assistant County Attorney DATE: October 2, 2016 SUBJECT: Shared Asset Forfeiture Fund: Resolution Approving Agreement Between Monroe County Sheriff’s Office and Domestic Abuse Shelter, Inc. st Section 2-477 of the MonroeCounty Code provides that each year, by no later than May 31, the Shared Asset Forfeiture Fund (SAFF) advisory board will conduct a public hearing and make a recommendation to the Board of County Commissioners (BOCC) regarding the expenditure of funds in the Sheriff’s SAFF account. Under Section 2-479(d) of the Monroe County Code, the BOCC “may approve or disapprove each recommendation as the [BOCC] determine[s]best serves the public interest and welfare.” Section 2-479(f) of the Monroe County Code states: For those items or projects approved by the board of county commissioners that require agreementswith third party vendors, such agreementsmust be entered into between the vendors and the sheriff. The sheriff shall negotiatesuch agreements containing such terms as the sheriff determines necessary to ensure that the funds are properly spentonthe items or projectsapproved by the board ofcounty commissioners and spent in accordance with the laws and regulations of the United States. At the July 20, 2016 BOCC meeting, the BOCC directed preparation of an agreement with DAS containing (among other things) two terms and conditions:(1) the grant funds would not be disbursed until DAS provided documentation showing that thatits certificate to operate a shelter (whichhad been temporarily suspended) hadbeen restored by State of Florida Department of Children and Families, and (b) any SAFF grant funds awarded to DAS would bespent only in Monroe County. SAFF funds are disbursed on a reimbursement basis. Inaccordance with Monroe County Code Section 2-479(f), the two parties to the agreement are Monroe County Sheriff’s Office and DAS.
