Section 2-477 of the MonroeCounty Code provides that each year, by no later than May 31, the
Shared Asset Forfeiture Fund (SAFF) advisory board will conduct a public hearing and make a
recommendation to the Board of County Commissioners (BOCC) regarding the expenditure of
funds in the Sheriff’s SAFF account. Under Section 2-479(d) of the Monroe County Code, the
BOCC “may approve or disapprove each recommendation as the [BOCC] determine[s]best

between the vendors and the sheriff. The sheriff shall negotiatesuch agreements

At the July 20, 2016 BOCC meeting, the BOCC directed preparation of an agreement with DAS
containing (among other things) two terms and conditions:(1) the grant funds would not be
disbursed until DAS provided documentation showing that thatits certificate to operate a shelter
(whichhad been temporarily suspended) hadbeen restored by State of Florida Department of

Monroe County. SAFF funds are disbursed on a reimbursement basis.
Inaccordance with Monroe County Code Section 2-479(f), the two parties to the agreement are
