AGENDA ITEM WORDING: Discussion and direction regarding the County's request for
qualification for misdemeanor probation services.
ITEM BACKGROUND: This is a placeholder item that is being submitted at the revised agenda
deadline. More information will be provided prior to the June 11 w meeting.
Under Florida law, the County is responsible for providing probation services for those convicted of
misdemeanor offenses. Traditionally, the County has contracted that function out to private providers.
The County's contract with Court Options, the current provider, expires on July 31, 2014. Under this
type of contract, the provider is paid through fees collected from probationers, not County funds.
Accordingly, the County issued a Request for Qualifications (RFQ) for misdemeanor probation
services in March 2014. Notice was published in the Key West Citizen, in The Florida Keys Keynoter,
and The Reporter as well as on DemandStar and the County's website. The deadline for responding to
the RFQ was May 8, 2014. The County received three responses by the deadline. In alphabetical
order, the three responses were from: a) The Advocate Program; b) Judicial Correction Services; and c)
Professional Probation Services, Inc.
The selection committee is scheduled to consider the proposals on June 5s', after the revised agenda
deadline. The results of the selection committee meeting will be made available prior to the June I I1h
meeting. Staff had originally intended to place an item on the July 16, 2014 meeting for the Board to
consider the recommendations of the selection committee; however, due to a notice issue first raised by
the current provider on June 2"d, plus the short time period between the July 16'' meeting and the
expiration of the current contract on July 31 st, staff is adding this item to the June agenda in order to
seek the Board's direction on how to proceed.
Court Options, the current provider, did not submit a response to the RFQ, and now asserts that it did
not receive notice. DemandStar has provided documentation that an email was sent to a representative
of Court Options on March 28, 2014; representatives of Court Options indicate that the email was not
received. Court Options has requested that the Board exercise its discretion under Section 2-347 of the
County Code to reject all bids and re -start the RFQ process.
The Board has three (3) options:
1) Rejecting all bids and re -starting the competitive bidding process. This option will take at least
three (3) months to complete (including the RFQ process, selection committee, approval of top
ranked respondent, and negotiating a new contract). Due to the expiration of the current
contract on July 31, 2014, this option would require an emergency extension of the current
contract that would have to be brought forward in July.
2) Accepting the recommendations of the selection committee and authorizing staff to negotiate a
contract with the top ranked provider (assuming the selection committee makes such a
determination on June 5th).
3) Defer a decision until the July BOCC meeting as originally planned. While this option
provides the benefit of the opportunity to gather additional information, it would place severe
time constraints on executing whichever policy decision is reached at the July meeting.
Depending on the decision reached, it might require an emergency extension of the existing
contract.
PREVIOUS RELEVANT BOCC ACTION: March 19, 2014, the BOCC approved advertisement of
the Request for Qualifications (Item Q-5).

The Selection Committee for the competitive selection of a provider of Misdemeanor Probation Services
in Monroe County met in a publically advertised meeting on June 5, 2012 in the third floor Jury
Assembly Room at the Freeman Justice Center located at 302 Fleming Street, Key West Florida. The
three submissions to be considered were: The Advocate Program, Judicial Correction Service (JCS), and
Professional Probation Services (PPS).
The meeting began at 11:09 A.M. The following committee members were present: Patricia Dochery,
Office of the Public Defender, Holly Elomina, Court Administrator for the 16`h Judicial District, Peary
Fowler, County Court Judge, and Catherine Vogel, State Attorney for Monroe County. The following
members of the public were also present Ruben Valdivia, of Court Options, George Ramagosa, of Court
Options, and Jose' Bermudez of Professional Probation Services. Natileene Cassel, Assistant County
Attorney served as recording secretary for the selection committee. Judge Fowler nominated Holly
Elomina to serve as chairman, seconded by Trish Dochery and Ms. Elomina was unanimously elected.
The recording secretary explained to the public that the purpose of the selection committee is to rank
the three proposals submitted in response to the RFQ and to recommend to the Board of County
Commissioners the proposer which the committee determines to be the best qualified for the County.
Since a member of the public, Ruben Valdivia made a request to speak to the committee. Ms. Cassel
explained that this is a public meeting and speakers are:allowed to address the committee. Speakers will
be given 3 minutes for comments. Speakers wilt not be allowed to question the committee and the
committee will not quesborrspeakers. The responses to.the RFQ-will be considered on the basis of their
submissions. No submissions will be"accepted afterthe date of for submission.
Mr. Valdivia spoke to the committee on be.balf of the present provider of probation services, Court
Options, the company had notsubmitted a:response to,the RFQ. He related Court Option's
accomplishments, including a 35%' increase in collections, good service to the county and its
probationers, and the creation of a diversion program: He advised the committee that the company had
not received notice of the RFQ, In particular, Mr. Valdivia was concerned that the notice sent by
Demand5tar:to Mr. George Ramagosa via email was not received. He expressed concern that the service
from DemandStarto the County was ineffective. He advised the committee that the company had not
seen the advertisements in the newspapers. He felt that advertising only in local newspapers interfered
with the ability to have companiessubmit responses. He assured the committee that his company
would have submitted a'response if4hey had received notice. He requested that the committee
recommend to the Board of County Commissioners that the process be abandoned and rebid, so that
Court Options could be given the opportunity to respond. There were no other speakers.
The chairman called for the members of the committee to discuss the three respondents. Trish Dochery
advised the committee that she looked at the submission from the perspective of her clients, the
immediate users of the system. She was impressed with the level of technical advancement illustrated
by JCS. She noted that both JCS and PPS were Georgia companies but also worked in Florida. PPS worked
in Dade County. She liked that PPS stated that they do not take the cost of supervision until after all the
other fees are received and do not take them from indigents, however, she was not sure of the
practicality of this position. Her concern was that PPS indicated that they would not have an office open
every day in the Upper Keys, and that they identified locations for offices that may not be available. Ms.

Dochery liked the fact that PPS encouraged its personnel to be involved in the community.
Catherine Vogel expressed a strong opinion that companies must be realistic about staffing in the
Florida Keys. She advised that in her experience staffing is difficult. She noted that one company wanted
to require a 4 year degree for staff members, a goal which is admirable, but may not be achievable. She
advised the committee that AP presently provides a DUI program in the Keys, which has been successful
in reducing the number of cases. She expressed a desire to continue that program no matter what
company is chosen. She noted that PPS and Advocate were non-profit organizations. She stated that her
biggest concern was for a probation company with experience in the Florida Keys; therefore of the three
proposals she would gave an edge to the Advocate and expressed that she was inclined to reopen the
bid so that Court Options could submit a bid. '
Judge Fowler expressed a need for as quick a transition time to any new company. She noted that PPS
has an "under the influence" program for adults, which has been helpful to the county. She was
concerned about the viability of any company working in Monroe County if they did not accept cost of
supervision fees from indigents. She also expressed the need for companies to work in all areas of the
Keys and she agreed that companies should encourage their staff to be involved in the community.
Holly Elomina, in addition to moderating the discussion among the members, expressed a necessity for
adequate presence of any probation company in all areas of the Keys. She noted that PPS has shown
initiative by researching possible locations for offices1n the Upper; Middle and Lower Keys. She liked the
fact that PPS has invested in a screening machine. She�advised that this is the same machine used by
Drug Court; it has been a very successful tool 'and allows screening to be -done on site rather than to be
sent to another location for processing. Regarding,the consideration of Court Options she advised the
committee they could not rank Court Options since there was no response submitted.
Chairman Elomina asked the members to.rank the responses individually, read the scores to the
committee, and the scores weretabulated The. highest number of points equaled the winning
respondent. PPS received the highest rank, followed by The Advocate Program and JCS, both tied in
second place. The Cam mittee.recommends that the BOCC accept PPS as the most qualified respondent.
The Committee asked Ms. Cassel about the Court Options issue. She advised that the committee could
not rank Court Options, since Court Options did not submit a response. However, if the committee did
not want to recommend any of the companies who provided a response, the committee could advise
the BOCC. In addition, Ms. Cassel advised the committee that Court Options has a pending request for
discussion before the BOCC on June 11, 2014 (a copy of that agenda item had been provided to the
committee). Court Options will be able to state their case before the BOCC, which is the proper forum,
at that time and again when BOCC considers the Committee recommendation and when the contract
award comes before the BOCC.
The Committee was dismissed and the meeting Adjourned at 11:49 A.M.

The Respondent awarded a contract shall provide MISDEMEANOR PROBATION SERVICES
for the Sixteenth Judicial Circuit for Monroe County as required by Florida Statutes. The contract
will provide for the supervision: rehabilitation and probation services for defendants placed on

AGENDA ITEM WORDING: Discussion and direction regarding the County's request for
qualification for misdemeanor probation services.
ITEM BACKGROUND: This is a placeholder item that is being submitted at the revised agenda
deadline. More information will be provided prior to the June I 11h meeting.
Under Florida law, the County is responsible for providing probation services for those convicted of
misdemeanor offenses. Traditionally, the County has contracted that function out to private providers.
The County's contract with Court Options, the current provider, expires on July 31, 2014. Under this
type of contract, the provider is paid through fees collected from probationers, not County funds.
Accordingly, the County issued a Request for Qualifications (RFQ) for misdemeanor probation
services in March 2014. Notice was published in the Key West Citizen, in The Florida Keys Keynoter,
and The Reporter as well as on DemandStar and the County's website. The deadline for responding to
the RFQ was May 8, 2014. The County received three responses by the deadline. In alphabetical
order, the three responses were from: a) The Advocate Program; b) Judicial Correction Services; and c)
Professional Probation Services, Inc.
The selection committee is scheduled to consider the proposals on June 5 th , after the revised agenda
deadline. The results of the selection committee meeting will be made available prior to the June 11`h
meeting. Staff had originally intended to place an item on the July 16, 2014 meeting for the Board to
consider the recommendations of the selection committee; however, due to a notice issue first raised by
the current provider on June 2,d , plus the short time period between the July 161h meeting and the
expiration of the current contract on July 31 st, staff is adding this item to the June agenda in order to
seek the Board's direction on how to proceed.
Court Options, the current provider, did not submit a response to the RFQ, and now asserts that it did
not receive notice. DemandStar has provided documentation that an email was sent to a representative
of Court Options on March 28, 2014; representatives of Court Options indicate that the email was not
received. Court Options has requested that the Board exercise its discretion under Section 2-347 of the
County Code to reject all bids and re -start the RFQ process.
The Board has three (3) options:
1) Rejecting all bids and re -starting the competitive bidding process. This option will take at least
three (3) months to complete (including the RFQ process, selection committee, approval of top
ranked respondent, and negotiating a new contract). Due to the expiration of the current
contract on July 31, 2014, this option would require an emergency extension of the current
contract that would have to be brought forward in July.
2) Accepting the recommendations of the selection committee and authorizing staff to negotiate a
contract with the top ranked provider (assuming the selection committee makes such a
determination on June 5th).
3) Defer a decision until the July BOCC meeting as originally planned. While this option
provides the benefit of the opportunity to gather additional information, it would place severe
time constraints on executing whichever policy decision is reached at the July meeting.
Depending on the decision reached, it might require an emergency extension of the existing
contract.
PREVIOUS RELEVANT BOCC ACTION: March 19, 2014, the BOCC approved advertisement of
the Request for Qualifications (Item Q-5).
