Islander Village Development for permit fees ($28,120.00) paid for 15 single family house permits and impact fees ($13,806.00) for 9 single family houses due to a contractor misunderstanding that inspections are required every 180 days after permit issuance even though the development has a conditional use permit, for a total refund amount of $41,926.00. ITEM BACKGROUND: In a letter written on March 5, 2014, property owners Drive In Homebuilders stated they believed the 15 single family permits issued under the conditional use permit authorizing the development of the Property were to be treated as one development, and as such, mistakenly did not obtain the necessary inspections on each of the 15 homes required under Section 105.4.1.3. of the Florida Building Code (inspections on each home must progress every 180 days under the code). Drive In Homebuilders is requesting to be refunded the permit monies they paid ($28,120.00) for 15 permits and impact fees of ($13,806.00) for 9 of the permits. Only the Board of County Commissioners can refund permit fees as required by 6-108(f) Monroe County code, after request by the County Administrator. The Planning Director can and has approved refimd of the impact fees according to Section 126-6(d)(5)(c) of the [Uyron.- •00 The total amount in which they are to be reimbursed is $41,926.00. They have or will be re -paying the permit fees for the reissuance of the 15 permit that have expired. No additional plan review is required, as no codes changed that impact the permit applications, which means the only resources by staff required to re -issue is the intake and issuance by customer service representatives. Therefore, staff is recommending approval. The reason there are only 9 permits that are due impact fee refunds vs. 15 permits that are due permit fee refunds is because not all permits issued for this development were required to pay impact fees. 11 of the 22 were impact fee exempt because they were "linked" to the Islander Village Affordable Housing project. Sec. 130-161 (a)(1) of the Land Development Code indicates the developer of an affordable housing project may have 20% market rate units if they comply with Section 130-161(a)(8). Islander Village/Drive In Ltd. complied with (a)(8) for 11 of the units. So, only 11 of the 22 units paid impact fees; 9 of which had the permits expire.
