ITEM BACKGROUND: On February 19, 2014, the Board of County Commissioners approved a Memorandum of Understanding (MOU) between Monroe County, Florida ("COUNTY") and the Monroe County Sheriff's Office ("SHERIFF"), in order for the COUNTY to disburse to the SHERIFF and in order for the SHERIFF to accept $48,462.63 in grant funds awarded to Monroe County from the Urban Area Security Initiative ("UASI") FY 2012 grant program from the State of Florida Division of Emergency Management and a subgrant awarded by Florida Division of Emergency Management to the City of Miami. The COUNTY and the SHERIFF were recently notified (April 10, 2014) by the City of Miami that additional 2012 UASI grant funding was made available for disbursement to the COUNTY and in turn to the SHERIFF, and the COUNTY wishes to disburse $100,000.00 of the additional funds to the SHERIFF and the SHERIFF wishes to accept $100,000.00 from the grant award. The funds must be used by April 30, 2014 and the reimbursement package must be submitted to the granting agency by no later than May 15, 2014. Transaction will be reported on FY14 for both the Sheriff and the BOCC. PREVIOUS RELEVANT BOCC ACTION: Back on September 12, 2013 the BOCC entered into a Memorandum of Agreement with the City of Miami through the Urban Area Security Initiative (UASI) Grant Program for FY 2012. The agreement was between the City of Miami and Monroe County. The BOCC met on November 20, 2013 and approved the grant document. WITNESSETH WHEREAS, the U.S. Department of Homeland Security Office for Domestic Preparedness has awarded a grant to the State of Florida Department of Community. Affairs through the FY 2012 Urban Area Security Initiative (UASI), and WHEREAS, the State of Florida Department of Community Affairs has awarded a subgrant of these funds to the City of Miami through a federally -funded subgrant agreement, and WHEREAS, the COUNTY entered into an agreement with the City of Miami on September 12, 2013, by which the City of Miami sub -granted the sum of ninety-six thousand nine hundred twenty-five dollars and twenty seven cents ($96,925.27), of which forty-eight thousand four hundred and sixty-two dollars and sixty three cents ($48,462.63) was to be given to Monroe County Sheriff's Office for the purchase of equipment approved by the granting agency as well as other items, and WHEREAS, on February 19, 2014, the BOCC approved a Memorandum of Understanding (MOU) with the Sheriffs Office, whereby the Sheriff's Office would receive one- half of the total funds available at that time, or forty-eight thousand, four hundred and sixty-two dollars ($48,462.63); and WHEREAS, the COUNTY and the SHERIFF were recently notified (April 10, 2014) by the City of Miami that $100,000 in additional 2012 UASI grant funding was made available for disbursement to the COUNTY (Attachment A hereto), and in turn to the SHERIFF, and the COUNTY wishes to disburse $100,000.00 of the additional funds to the SHERIFF and the SHERIFF wishes to accept $100,000.00 from the grant award, and WHEREAS, it is necessary to extend the term of the agreement (currently April 30, 2014) by thirty (30) days to allow expenditure of additional grant funds by April 30, 2014 (the reimbursement packages must be submitted to the granting agency no later than May 15, 2014); and WHEREAS, the SHERIFF has agreed to purchase law enforcement equipment as well as other equipment (i.e.; interoperable communications equipment, etc.) approved by the granting agency in accordance with the COUNTY'S agreement with the City of Miami with the additional grant funds, NOW THEREFORE, in consideration of the mutual understandings and agreements set forth herein, the COUNTY and the SHERIFF agree as follows: Monroe County Sheriffs Office — First Amendment to MOU UASI FY 2012 (Additional Funding) Page 1 of 2 m Section 1: Paragraph (1) in the MOU is revised to read as follows: 1. TERM — The term of this Agreement is from September 12, 2013, through May 30, 2014, the date of the signature by the parties notwithstanding, unless earlier terminated as provided herein. Section 2: Paragraph (4) in the MOU is revised to read as follows: 4. FUNDS - The total project budget to be expended by the SHERIFF in performance of the services set forth in this agreement shall be the total sum of $148,462.63. The total sum represents federal grant support in the amount of $148,462.63 and matching funds in the amount of $0.00. All funds shall be expended in accordance with the grant agreement. Section 3: In all other respects, the MOU dated February 19, 2014 by and between the parties remains unchanged and in full force and effect.
