RESOLUTION NO. 092 - 2018
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA
URGING THE UNITED STATES CONGRESS AND THE
FLORIDA LEGISLATURE TO CONSIDER LEGISLATION
TO IMPROVE OUR MENTAL HEALTH LAWS TO CREATE
A COMPREHENSIVE SYSTEM FOR INVESTIGATING AND
REPORTING CONCERNS REGARDING POTENTIAL
VIOLENCE TO LAW ENFORCEMENT; AND PROVIDE
ADDITIONAL FUNDING FOR MENTAL HEALTH
PROGRAMS.
WHEREAS, on February 14, 2018, a mentally disturbed young adult shot and killed
seventeen (17) students and staff members at Marjorie Stoneman Douglas High School in
Broward County, Florida; and
WHEREAS, this episode is the latest in a series of violent acts in this country which
were committed by individuals with serious mental health conditions; and
WHEREAS, following such tragedies, communities often lament the fact that warning
signs were either missed or did not trigger sufficient actions to prevent the loss of life; and
WHEREAS, these incidents demonstrate a need to improve our state and federal mental
health laws to allow law enforcement to investigate and obtain a mental health evaluation for an
individual when information is obtained raising concern about that individual's propensity to
commit a violent act in the future; and
WHEREAS, our state and national legislators should consider creating a highly
publicized reporting system that is combined with an effective public information program which
teaches the public how to recognize indicators of potential violent behavior; and
WHEREAS, the focus of such a system should be on predictors of violence and not rest
solely on the presence or absence of mental illness since violence is not limited to those suffering
from mental illness; and
WHEREAS, the State of Florida was recently reported to rank 50th in the nation for
funding for mental health programs; and
WHEREAS, the State of Florida must adequately fund existing mental health programs
and fully fund any programs created in the future; and

WHEREAS, the Federal government should supplement State funding efforts for mental
health programs;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1. The recitals set forth above are incorporated by reference herein as findings by the
Board.
Section 2. The State and Federal governments are urged to legislatively create and fund
more comprehensive strategies and systems that would:
a. Amend the Baker Act to allow law enforcement and mental health officials to
investigate and evaluate individuals who demonstrate certain predictors of
violent behavior; and
b. Amend the Baker Act to authorize and encourage law enforcement to provide
the mental health professional conducting the evaluation with as much
background information on the patient as possible with the aim of providing
the evaluator with as complete a picture of the patient's background as
possible; and
c. Create a highly publicized state hot line reporting system which is operated 24
hours a day, 7 days a week and which will alert appropriate stakeholders in
affected communities so that timely and effective evaluations can be
conducted and treatment plans and strategies can be implemented; and
d. Implement an effective public information program to teach our residents and
stakeholders to recognize the indicators of potential violent behavior; and
e. Examine the impacts under current law has on protected health information
and privacy requirements which limit the sharing of health information; and
f. Consider legislation that will improve the efficient reporting of critical
information to appropriate law enforcement agencies and other stakeholders
while striving to maintain patient privacy to the extent reasonably possible,
and
g. Adequately and fully fund such strategies and systems.

Dear Mr. Madok:
Thank you for contacting me about improving our mental health care system. I
understand the _importance of mental health-to-an individual's -Overall well -being and-have-___ _
championed increased access to psychological and psychiatric care throughout my career.
For far too long, many Americans have not had access to mental health services. On
December 13, 2016, President Obama signed into law the 21st Century Cures Act (P 114
255). I voted for this bipartisan legislation, which boosts mental health programs and improves
research, diagnosis, and care for individuals with mental health issues.
Additionally, in 2008, I successfully fought for bipartisan Mental Health Parity
legislation, which requires insurance plans that offer mental health coverage to provide the same
benefits and cost - sharing requirements for mental health services that are given for other medical
illnesses. Mental illnesses can affect persons of any age, race, religion, or income. While all
ages are susceptible, the young and the old are especially vulnerable, so it is critical that we
protect mental health benefits for these groups.
