AGENDA ITEM WORDING: Approval of a resolution authorizing the release of the affordable
housing deed restrictions on Block 1, Lot 5, Harbor Shores on Key Largo in favor of the Monroe
County Land Authority upon the execution and recordation of affordable housing restrictions in
favor of Monroe County.
ITEM BACKGROUND: The subject property is a 7,500 square foot lot on Fisherman's Trail. on
the ocean side of Key Largo near mile marker 99.
On November 15, 2002 the Land Authority purchased the subject property as an affordable housing
site in partnership with Habitat for Humanity of the Upper Keys, Inc. Habitat has now submitted an
application for a building permit to develop the property with asingle- family home. Habitat is
required to execute a separate set of affordable housing deed restrictions in favor of Monroe County
as a condition of receiving a building permit. The Land Authority restrictions will no longer be
necessary once the deed restrictions required by the Code are executed and recorded.
ADVISORY COMMITTEE ACTION: On January 31, 2018 the Committee voted 4/0 to
recommend approval of this resolution.

A RESOLUTION OF THE MONROE COUNTY
COMPREHENSIVE PLAN LAND AUTHORITY AUTHORIZING
THE RELEASE OF AFFORDABLE HOUSING DEED
RESTRICTIONS ENCUMBERING BLOCK 1, LOT 5, HARBOR
SHORES IN FAVOR OF THE AUTHORITY UPON THE
EXECUTION AND RECORDATION OF AFFORDABLE HOUSING
DEED RESTRICTIONS IN FAVOR OF MONROE COUNTY.
WHEREAS, the Monroe County Comprehensive Plan Land Authority (hereinafter "Land
Authority ") purchased Block 1, Lot 5, Harbor Shores on Key Largo (hereinafter "subject
property ") as an affordable housing site on November 15, 2002 in partnership with Habitat for
Humanity of the Upper Keys, Inc.; and
WHEREAS, on November 26, 2002 the Land Authority transferred title of the subject property to
Habitat for Humanity of the Upper Keys, Inc. via a warranty deed subject to affordable housing
restrictions in favor of the Land Authority (hereinafter "Land Authority restrictions ") recorded in
Book 1836 at page 2005 of the Public Records of Monroe County, Florida; and
WHEREAS, Habitat for Humanity of the Upper Keys, Inc. has submitted an application for a
building permit to develop the subject property with asingle- family home and said application is
currently being reviewed by the Monroe County Planning and Environmental Resources
Department; and
WHEREAS, pursuant to the Monroe County Land Development Code, Habitat for Humanity of
the Upper Keys, Inc. is required to execute a separate set of affordable housing deed
restrictions in favor of Monroe County as a condition of receiving a building permit; and
WHEREAS, the Land Authority restrictions will no longer be necessary once the deed
restrictions required by the Code are executed and recorded; and
WHEREAS, the Land Authority Advisory Committee considered this resolution at a meeting held
on January 31, 2018 and voted 4/0 to recommend approval; NOW, THEREFORE,

BE IT RESOLVED BY THE MONROE COUNTY COMPREHENSIVE PLAN LAND AUTHORITY
that the Chairman of the Land Authority Governing Board is hereby authorized to execute the
necessary documents to release the Land Authority restrictions upon the execution and
recordation of affordable housing deed restrictions in favor of Monroe County.
PASSED AND ADOPTED by the Monroe County Comprehensive Plan Land Authority at a
regular meeting on this day of , 2018.
