ITEM BACKGROUND: As a result of Code Case CE09110007, a Final Order was recorded as Lien on behalf of the County on September 21, 2010 in the name of The Trailer Shop, Robert Violette, President. On November 27, 2012, the property was sold to Chris Sante with outstanding violations. After receiving a partial payment of $8,000.00 and a New Buyer Affidavit from Mr. Sante, the County issued a Partial Lien release and Mr. Sante took responsibility for curing the remaining violations: Storage Containers and a Shade Structure (canopy) on the rear of the building without permit(s) approval(s) and inspection(s). In the New Buyer Affidavit Mr. Sante agreed to a compliance date of February 4, 2013. Subsequently the County agreed to three (3) extensions to the compliance date with the final compliance date of December 24, 2013. Compliance was not achieved by that date and the daily fine of $100.00 began accruing. On March 4, 2014 the Final Order dated January 3, 2013 approving the New Buyer Affidavit and the three (3) extensions was recorded as a lien on behalf of the County. Compliance was achieved on October 1, 2014, therefore a daily fine(s) of $100.00 per day accrued for 280 days, (December 25, 2013 - October 1, 2014) for a fine total of $28,000.00. Additionally Per F.S. §162.07(2), if the local governing body prevails in prosecuting a case before the enforcement board, it shall be entitled to recover all costs incurred in prosecuting the case before the board and such costs may be included in the lien authorized under F.S.§162.09(3). To date these costs are $453.60 and continue to accrue until the case is closed. Therefore, the total amount of the lien to date is $28,453.60. A letter was sent to the property owner March 16, 2015. On April 2, 2015, staff received a request from Mr. Sante to appear at the May 20, 2015, 2015 BOCC meeting. PREVIOUS RELEVANT BOCC ACTION: On May 21, 2008 the BOCC passed and adopted resolution 148-2008 adopting a maximum amount for the reduction of fines by staff after the property has been made compliant. CONTRACT/AGREEMENT CHANGES: N/A STAFF RECOMMENDATIONS: Accept the maximum fine reduction allowed by staff per resolution 148-2008, of $7,453.60 ($7,000.00 fines and $453.60 costs), for 30 days and provide a Full Satisfaction and Release of Lien upon payment. After 60 days amount will revert to the full amount of $28,453.60. Murphy, Dist. 5 TO: Steve Williams, Assistant County Attorney FROM: Kathleen Windsor, Sr. Code Compliance Research Analyst DATE: April 25, 2015 SUBJECT: Request for additional reduction in fines CE09110007, 105850 OVERSEAS HWY KEY LARGO SUMMARY: The County has received a request from Chris Sante, Manager of TRAILER DEPOT, LLC, the property owner, to address the BOCC, asking it to further reduce the amount of fines beyond Staff s authority (75% reduction.) CASE CE09110007 BACKGROUND: On March 10, 2009, Director Norman received a faxed complaint regarding this property stating several issues. On October 13, 2009 the County received a referral for violations from the Florida Department of Transportation. The complaints were combined into case CE09110007 on November 4, 2009, Robert Violette, the property owner at the time, was sent a Notice of Motion/Notice of Hearing certified mail for a hearing to be held on December 3, 2009. Hearings were held on March 2, 2010, May 27, 2010, June 24, 2010 and July 29, 2010. As a result the Special Magistrate issued a Final Order imposing a compliance date of August 9, 2010 for the violation of MCC 110-140(1) with a daily fine of $100.00 per day compliance was not achieved by that date. Compliance was not achieved and the Final Order was recorded as a lien on behalf of the County on September 21, 2010. The daily fine accrued for 848 days until Mr. Violette sold the property to Mr. Sante Prior to the sale staff was contacted by a broker, and on November 2, 2012 an email was sent disclosing the remaining violations along with a New Buyer Affidavit. "Still in violation are Storage Containers and a Shade Structure (canopy) on the rear of the building without permit(s) approval(s) and inspection(s)." On November 7, 2012 Assistant County Attorney, Lisa Granger recommended $8,000.00 for a partial release. Once the County received the signed New Buyer Affidavit, the offer was passed on to the broker. The County received payment on December 3, 2012 in the amount of $8,000.00 and the warranty deed transferring ownership of this property to Chris Sante was recorded in the Official Records on December 5, 2012, therefore staff prepared the Partial Release and executed the New Buyer Affidavit on behalf of the County giving Mr. Saute until February 4, 2013 to achieve compliance or the daily fine of $100.00 would resume accruing. • On January 3, 2013 the Special Magistrate issued a Final Order approving the New Buyer affidavit. • On February 9, 2013 Mr. Sante entered into an Extension agreeing to a compliance date of August 24, 2013. • On September 12, 2013 Mr. Sante entered into an Extension agreeing to a compliance date of October 24, 2013. • On September 30, 2013 an email was sent to Mr. Sante explaining the corrective actions required if he choose not to apply for permit(s) for the storage containers. • On October 18, 2013 the Shade Structure (canopy) on the rear of the building without permit(s) approval(s) and inspection(s) was removed. All that remained are the 6 Storage Containers without permit(s) approval(s) and inspection(s). • On October 31, 2013 Mr. Sante entered into an Extension agreeing to a compliance date of December 24, 2013. • On December 25, 2013, compliance was still not achieved and the daily fine began to accrue. • On March 4, 2014 the Final Order dated January 3, 2013 approving the New Buyer Affidavit and the three (3) extensions was recorded as a lien on behalf of the County. • On May 14, 2014 the September 30, 2013 email explaining the corrective action required if he chooses not to apply for permit(s) for the storage containers was resent. • On May 21, 2014 the September 30, 2013 email explaining the corrective action required if he chooses not to apply for permit(s) for the storage containers was resent. • On June 5, 2014 the September 30, 2013 email explaining the corrective action required if he chooses not to apply for permit(s) for the storage containers was resent. Compliance was achieved on October 1, 2014, therefore a daily fine(s) of $100.00 per day accrued for 280 days, (December 25, 2013 - October 1, 2014) for a fine total of $28,000.00. Additionally Per F.S. § 162.07(2), if the local governing body prevails in prosecuting a case before the enforcement board, it shall be entitled to recover all costs incurred in prosecuting the case before the board and such costs may be included in the lien authorized under F.S.§162.09(3). On April 2, 2015 staff received a request from Mr. Sante to appear at the May 20, 2015 BOCC meeting. NOTE: Although Mr. Sante has deeded the property to Trailer Depot, LLC, the County lien remains. STAFF RECONEVIENDATIONS: Accept the maximum fine reduction allowed by staff per resolution 148-2008, of $7,453.60 ($7,000.00 fines and $453.60 costs), for 30 days and provide a Full Satisfaction and Release of Lien upon payment. It has come to our attention, as a result of several field inspections, that you continue to use FDOT right-of-way adjacent to The Trailer Shop's location at 105850 Overseas Highway without authorization. FDOT's right-of-way is shown on the attached sketch in yellow. The purpose of this letter is to bring to your attention, once again, the unauthorized use of FDOT's property and to serve as formal notice to cease and desist from using the Department's property, immediately. We are disappointed that it has been almost three years and you have not taken the opportunity to correct the situation through a purchase, a lease or by ceasing your continued use of the Department's property. Our offer to lease or purchase is still open, together with a caution that we cannot allow the situation to continue unchecked and we will take the necessary action to protect our interests, without any further notice. At that time the Special Magistrate gave a compliance date of August 9, 2012 for the charge of 110-140(1), with a daily fine of 100.00 per day if compliance was not achieved. This fine has been running for 815 days = 81,500.00. The accrued costs = 5,633.34. Still in violation is Storage Containers and a Shade Structure (canopy) on the rear of the building without permit(s) approval(s) and inspection(s). In order to achieve compliance on this case they either need to removed or permitted. This could be done by the seller, or they can sell the property "as is", the violation(s) run with the property. When a property is sold "as is" the County will negotiate with the seller a partial payment of fines and costs in exchange for a partial lien release if we receive an affidavit from the prospective buyer acknowledging the violation(s), acknowledging that they be cited for the violation(s) and acknowledging that they will be given a reasonable period of time to achieve compliance before the fines resume running. The County does have a form for this which includes a Stipulation Agreement and by using the county's form the new property owner can avoid attending a hearing. Since this appears to be the fastest way to expedite this sale, I have attached the New Buyer's affidavit/agreement for your review. This is the form the County uses to satisfy Florida Statutes 162 and to not be an impediment to short sales when there is an open code action against the property. If the buyer decides to use our form, it will become effective when the deed is filed in the Monroe County Clerk's office. Please have the buyer insert their legal name and address as Respondent and sign in the presence of a Notary and return the entire document to me. I will sign on behalf of the County. Just to reiterate our phone conversation, I would suggest that the buyer speak with the inspector on the case, Diane Link, 305-453-2208 to discuss any additional violations on this property and speak to the T. I know we have had clear site triangle issues and setback issues in addition to the problems on the State's Right -of -Way. If the buyer is willing to take responsibility for the outstanding violations, someone should speak to our Assistant County Attorney for Code, Lisa Granger, ASAP and find out what the County can accept for a Partial Release of this lien. WHEREAS, Section 162.09(1), Florida Statutes, and Monroe County Code Section 6.3-7 gives the special master appointed to hear Code Enforcement cases the authority to impose fines after a finding that the property owner has violated the Monroe County Code and that the property owner thereafter has not corrected the violation(s); and WHEREAS, under Section 162.09(3), Florida Statutes, and Monroe County Code Section 6.3-5, if the County prevails in prosecuting a case before the special master, the County is also entitled to recover all costs incurred in prosecuting the case; and WHEREAS, a certified copy of the order imposing fines and costs becomes a lien on real and personal property owned by the violator once recorded with the County Clerk; and WHEREAS, thereafter, the County has the authority to initiate litigation for foreclosure of the lien or for a money judgment; and WHEREAS, in the alternative, the County has the ability to enter into an agreement with the property owner to settle the matter on such terms and conditions as the parties deem mutually acceptable, in order to resolve the matter short of litigation; and WHEREAS, the average cost of investigating and prosecuting a Code Enforcement case is at least $1,101.43. and the Code Enforcement Department projects that 1,200 cases will be brought before the special master in the current fiscal year, for a total projected cost of approximately $1.2 million; and WHEREAS, it is appropriate to defray the majority if not all of the cost through the collection of fines and costs from the actual property owners cited for the violations; and WHEREAS, it is advantageous for the County not to mitigate the fines and costs by a significant amount at time of settlement, so that the fines and costs will serve as a deterrent to other property owners not to violate the Monroe County Code, or so that the imposed fines and costs will act as an incentive for the property owners found to have violated the Code to correct the Code violations as quickly as possible. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, that: Section I. It is hereby declared to be the policy of the County that the County will accept a minimum of trrent1f ve percent (L 5%) of accrued fines and costs in settlement of Code Enforcement cases after said fines and costs have been imposed by the special master. The County will not settle any fines or costs prior to compliance. Section 2. Any resolutions concerning the policy of the County with respect to the percentage of fines and costs to be accepted in settlement of Code Enforcement cases after said fines and costs have been imposed by the Special Magistrate are hereby repealed and any contrary provisions of the Monroe County Code are hereby repealed. Section 3. This resolution shall take effect on May 21 ' 2008. Section 4. The Clerk of the Court is hereby directed to forward one (1) certified copy of this Resolution to the Division of Growth Management.
