Wheeler, Trustee of the Alexa L. Wheeler Revocable Trust, for a reduction in the outstanding code fines imposed in code case CE08120093. ITEM BACKGROUND: As a result of Code Case CE08120093, a Final Order was recorded as Lien on behalf of the County on June 2, 2009. This case was deemed compliant on June 30, 2009 with the completion and passing of all required building department inspections on demolition permit 09301966. Therefore a daily fine of $100.00 per day accrued for 88 days (April 3, 2009 -June 30, 2009), fora total fine amount of $8,800.00. Additionally, per F.S. § 162.07(2), if the local governing body prevails in prosecuting a case before the enforcement board, it shall be entitled to recover all costs incurred in prosecuting the case before the board and such costs may be included in the lien authorized under s. 162.09(3). To date these costs are $407.52 and continue to accrue until the case is closed. Therefore the current amount of the Monroe County Lien is $9,207.52 ($8,800.00 fines and $407.52 costs). On March 5, 2010 Assistant County Attorney, Lisa Granger offered Ms. Wheeler the maximum reduction allowed by staff, $2,607.52 ($2,200.00 fines and $407.52 costs), and Ms. Wheeler requested to address the BOCC. While preparing the agenda item, research revealed that the sign permitted with permit 09300270 was in fact located on the State Right of Way due to inadequate site plans submitted with the permit application, thereby creating another violation. After several meetings with staff, and communication with the DOT (Department of Transportation), it was agreed that the DOT would write Ms. Wheeler addressing the issue, and once the sign was either removed, or corrected in some other manner, the County could proceed with their reduction offer and BOCC request. On May 17, 2013 Ms. Wheeler leased the portion of the State Right of Way, thereby correcting the violation. A letter was mailed February 25, 2015 again offering the maximum reduction allowed by staff, $2,607.52 ($2,200.00 fines and $407.52 costs). On March 11, 2015, staff received a request from Ms. Wheeler to appear at the May 20, 2015, BOCC meeting. PREVIOUS RELEVANT BOCC ACTION: On May 21, 2008 the BOCC passed and adopted resolution 148-2008 adopting a maximum amount for the reduction of fines by staff after the property has been made compliant. Wheeler, the property owner, to address the BOCC, asking it to further reduce the amount of fines beyond staff s February 25, 2015 offer. CASE CE08120093 BACKGROUND: On December 9, 2008 research revealed that ground mounted signs had been installed without required permit(s) approval(s) and inspection(s). A case was created (CE08120093) and on January 13, 2009 the property owner was sent a Notice of Motion/Notice of Hearing certified mail for a hearing to be held on March 26, 2009. The certified mail was signed for on January 23, 2009. On March 3, 2009 the County received a permit application for "copy change to existing sign" 09300720. A reinspection for the Hearing was conducted on March 24, 2009 and the signs remained, and the permit had not been issued, therefore the violation remained. On March 26, 2009 the hearing was held and the Special Magistrate found the property in violation of Monroe County Code 9.5-111(1) and imposed a compliance date of April 2, 2009 and imposed a daily fine of $100.00 if compliance was not achieved by that date. Compliance was not achieved by that date. Therefore, the daily fines began accruing on April 3, 2009. Additionally, the Final Order was recorded as a Lien on behalf of the County on June 2, 2009. On May 27, 2009 the County received another permit application for the demolition of the Northbound Sign. This permit 09301966 was issued on June 24, 2009 and closed on June 30, 2009. This case was deemed compliant on June 30, 2009 with the completion and passing of all required building department inspections on demolition permit 09301966. The Department may remove and dispose of all personal property and improvements remaining after the Removal Date without liability to Lessee. (2009). 10. Venue. This Agreement shall be governed by the laws of the State of Florida in terms of Interpretation and performance. Venue for any and all actions arising out of or in any way related to the interpretation, validity, performance or breach of this Agreement shall lie exclusively in a state court of appropriate jurisdiction selected by the Department, including, without limitation, Leon County. Lessee consents to personal jurisdiction in the State of Florida. 11. Entire Agreement. This instrument and attached exhibit contains the entire agreement of the parties and no representations or promises have been made except those that are specifically set out in this Agreement. All prior and contemporaneous conversations, negotiations, possible and alleged agreements and representations, covenants, and warranties with respect to the subject matter of this Agreement, and any part hereof, are waived, merged herein and superseded hereby. 12. Severability. If any section, paragraph, clause or provision of this Agreement is adjudged by a court, agency or authority of competent jurisdiction to be invalid, Illegal or otherwise unenforceable, all .remaining parts of this Agreement shall remain in full force and effect and the parties shall be bound thereby so long as principle purposes of this Agreement remain enforceable. 13. Third Party Beneficiaries. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns. Nothing In this Agreement is intended to confer any rights, privileges, benefits, obligations or remedies upon any other person or entity except as expressly provided for herein. 14. Computation of Time. In computing any period of time prescribed in this Agreement, the day of the act, event or default from which the designated period of time begins to run, shall not be included. The last day of the period shall be included unless it is a Saturday, Sunday or legal holiday, in which event the period shall run until the end of the next day which is not a Saturday, Sunday or legal holiday. 15. Consideration. By their signature below, the parties hereby acknowledge the adequacy and sufficiency of consideration provided in this Lease and forever waive the right to object to or otherwise challenge the same. 16. Miscellaneous. Lessee shall not sublet the property or any part thereof, nor assign this Lease, without the prior written consent of the Lessor. This Lease is being executed by Lessor upon the credit and reputation of Lessee. Acceptance by Lessor of rental from a third party shall not be considered as an assignment or sublease, nor shall it be deemed as constituting consent of Lessor to such an assignment or sublease.
