ITEM BACKGROUND: The applicant has requested a special permit to utilize the subject property for a temporary construction staging area. The staging area would facilitate a canal restoration/water quality improvement project being carried out by Monroe County, In addition, the applicant is requesting a temporary setback variance to allow placement of staging equipment in the sideyard setback of the parcel. In addition, the applicant is requesting a variance from the front yard setback to allow the placement of dewatering equipment on the property line at the edge of the right of way of Avenue I. The property owner for the adjacent parcel (#00110960�.000000) is seeking approval for a similar request under a separate application. If approved, the expected commencement date of the staging area is July 31, 2015, and the approval shall expire one year from the date of commencement on July 31, 2016, Note: The BOCC is considering an amendment to Section 6-3 of the Monroe County Code of Ordinances to allow temporary construction staging to occur temporarily within the setbacks to alleviate increased public expenses and avoid threats to public health and safety, provided the adjacent property owners submit letters of no objections to the temporary variance. The applicant has submitted letters of no objection from the adjacent property owners. PREVIOUS RELEVANT BOCC ACTION: At the December 10, 2014 meeting, the BOCC approved an ordinance establishing §6-3 of the Monroe County Code, which provides the approval process for temporary construction staging areas with a special permit granted by the BOCC. Flood Zones: VE III REVIEW OF APPLICATION: The requested temporary staging is to provide a suitable location for a pipeline to run to and from the canal (#290) and to allow the placement of water separation equipment required to extract and dewater the organic material to meet return water turbidity thresholds. The BOCC has the authority to approve temporary construction staging areas in accordance with MCC §6-3. A special permit may be granted by resolution by the BOCC to allow a property to be used as a construction staging area for an off -site project. The BOCC shall hold a public hearing on the request for a temporary construction staging area and shall issue a resolution granting, granting with conditions or denying the request. The resolution shall take effect on the date of enactment by the BOCC. Applicability. A temporary construction staging area for an off -site project is a permitted activity in any land use (zoning) district, provided it is approved by a special permit and meets the criteria set forth in MCC §6-3. This special permit shall approve the temporary construction staging area location and use and shall not override or substitute for any other provision of the Florida Building Code and Monroe County Code that require an additional type of building permit, certification or approval. Criteria. Approval of such a special permit shall be granted only if the following criteria are met: (1) The temporary construction staging area shall serve a project being carried out in the vicinity of the construction staging area: In compliance. The proposed staging area is adjacent to Canal #290 which is one of the approved canal restoration demonstration projects. (2) The temporary construction staging area shall serve a project being carried out by a governmental agency: In compliance. (3) The temporary construction staging area shall be not be located in a tier I designated area: In compliance. The proposed staging area would be located on a property that is in a tier III designated area. (4) The property subject to the request shall be posted and surrounding property owners within 300 feet shall be notified in writing at least 15 days prior to the BOCC public hearing, with the notice located so it shall be easily visible from all public streets and public ways abutting the property: Compliance to be determined prior to public hearing. Planning & Environmental Resources Department staff shall carry out the notification as required. (5) Prior to establishment of the temporary construction staging area, a special building permit approving any associated temporary structure shall be issued in accordance with MCC §6-112: Compliance to be determined. A permit pursuant to MCC §6-112 will be required for the storage container and temporary fencing. (6) No clearing or filling shall occur to accommodate the temporary construction staging area: In compliance. The proposed staging area would be located on a property that is predominately scarified. No clearing or filling shall occur to accommodate the staging area. (7) Other than fencing, no temporary structure associated with a temporary construction staging area shall be located in any required setback unless the BOCC determines the temporary construction staging may occur temporarily within the setbacks to alleviate increased public expenses and avoid threats to public health and safety: In compliance pending temporary setback Variance Approval. The applicant is requesting a variance from the sideyard setback adjacent to Parcel 00110960-000000, which is also proposed as a staging area under a separate application. The requested variance is to allow the placement of dewatering equipment on the property line between the two parcels. In addition, the applicant is requesting a variance from the front yard setback to allow the placement of dewatering equipment on the property line at the edge of the right of way of Avenue I. Note: The BOCC is considering an amendment to Section 6-3 of the Monroe County Code of Ordinances to allow temporary setback variances on May 20, 2015. If necessary, prior to issuance of a special permit allowing the temporary construction staging area, the board may attach conditions to any special permit approval to a) avoid substantial harm to public health or safety; b) avoid substantial harm to, or impairment of the normal use of, a public place; and/or c) avoid substantial harm to the environment. Depending on the nature and anticipated duration of the use, as a condition of approval to the special permit, the board reserves the right to: a) Provide a deadline for termination of the construction staging area; b) Limit the hours of operation; c) Limit the type of equipment and materials on the site; d) Require fencing, landscaping and/or other screening to limit potential visual and noise impacts of the use on adjacent property owners; and e) Require surface water management improvements to the affected site: In compliance. The BOCC reserves the right to attach such conditions to any special permit approval at the May 20, 2015 public hearing. The purpose of the project is to hydraulically vacuum dredge the accumulated weed rack along the bottom of the unnamed manmade canal located between Avenues I and J in Big Pine Key, Florida to a maximum depth of - 8.9 feet Mean Low Water. Due to weed rack loading and lack of flushing, a layer of decomposing weed rack (organic muck) has accumulated along the bottom of the canal which consumes oxygen and prevents the inhabitance of fish or other marine organisms. The project entails hydraulically removing the organic muck layer within the canals to the limestone bottom to promote a viable benthic community. Six inches of sand will be placed on the limestone canal bottom after dredging to assist in promoting seagrass growth.
