The FLUM would be amended from Conservation to RM. The Zoning Map would be amended from Native to IS. And the Tier Map would be amended from Tier I to Tier III. Currently, Ordinance 028-2012 states that any private application which proposes an increase in allocated density or intensity must be designated as Tier III and have existing public facilities. Additionally any private application shall be required to purchase and donate land to offset the proposed increase. Enclosed is the pre-1986 zoning map showing the property was zoned RU-3, which allowed single family homes on each of the lots. Also attached is a 1958 photograph that shows the lots were filled and disturbed as a result of the excavation of the canal; a wetland delineation sketch prepared by Curtis Kruer, on behalf of the Army Corps of Engineers; and County Permit No. C21076 to refill the lots. We have been advised that the County did not carefully review the habitat or site conditions on these specific lots when it rezoned Blocks 1 and 4 to Native, instead of IS. It is interesting to note that Enos helped dig the canal soon after he moved from Arkansas. He later purchased several lots, built a home, and started a family. The Mitchells operated a successful septic tank business for years until recently, when a central sewage system was built. The Mitchells are elderly and desperately need the County's assistance in restoring these lots to buildable status. To clarify, my clients are asking the Board of County Commissioners to consider directing staff to process an amendment to the Future Land Use Map and the Zoning Map for the above lots at the BOCC meeting in Key Largo on February 18 or 19, 2015. We believe the BOCC should sponsor the amendment for two reasons. First, it is unreasonable to require my clients to donate land as a condition of amending the zoning maps. Second, it is the right thing to do. Based on historical research, including the attachments (1958 & 1959 Aerial, 1985 Zoning Map, 1986 Existing Conditions Map - Disturbed w. Saltmarsh, 1987 Fill Permit, 2004 Flood Map AE8, it is my belief that a drafting error was made in 1986, when the County zoned the disturbed lots in Block 1 and 4, Native (NA) instead of URM or Improved Subdivision. According to § 130-39 the purpose of NA is: "... to establish areas that are undisturbed with the exception of existing solid waste facilities, and because of their sensitive environmental character should be preserved in their natural state." The purpose of the SS district is to establish areas of low - density residential development where the predominant charac- ter is native or open space lands. (Ord. No. 33-1986, § 9-109) Sec. 9.5-210. Purpose of the Native Area District (NA). The purpose of the NA district is to establish areas that are undisturbed with the exception of existing solid waste facilities, and because of their sensitive environmental character should be preserved in their natural state. (Ord, No. 33-1986, § 9-110) Sec. 9.5-211. Purpose of the Mainland Native District (MN). The purpose of the MN district is to protect the undeveloped ind environmentally sensitive character of lands within Monroe county that are located on the mainland of the Florida peninsu- .a. (Ord. No. 33-1986, § 9-111) Sec. 9.5-212. Purpose of the Offshore Island District (OS). The purpose of the OS district is to establish areas that are not -- connected to U.S. 1 as protected areas, while permitting low - intensity residential uses and campground spaces in upland areas that can be served by cisterns, generators and other self-contained facilities. (Ord. No. 33-1986, § 9-112; Ord. No. 40-1987, § 54) Annotation —The intent of amendment 54 was to add campground uses in the OS district. Sec. 9.5-213. Purpose of the Improved Subdivision District (IS). The purpose of the IS district is to accommodate the legally vested residential development rights of the owners of lots in subdivisions that were lawfully established and improved prior to the adoption of this cl.apter. For the purpose of this section, improved lots are those which are served by a dedicated and accepted existing road of porous or nonporous material, that have a Florida Keys Aqueduct Authority approved potable water sup- ply, and that have sufficient uplands to accommodate the pro- posed use in accordance with the required setbacks.
