AGENDA ITEM WORDING: Approval to advertise a Public Hearing to consider an amendment to Section
2-700 of the Monroe County Code (MCC) relating to expanding the members appointed by the BOCC to the
Affordable Housing Advisory Committee.
ITEM BACKGROUND: In July 2014, the BOCC and the public provided considerable comments, through the
2030 Comprehensive Plan Update process, related to facilitating affordable housing/workforce housing and
expanding the inclusionary housing requirements to include nonresidential and transient development and
redevelopment.
In August, 2014, the BOCC approved an agreement with the FCRC Consensus Center, FSU, for professional
services on an Affordable Workforce Housing Stakeholder Assessment, in order to assess the current affordable
housing situation in the County and propose a process for developing recommendations. During this meeting the
BOCC also discussed reconvening the Monroe County Affordable Housing Advisory Committee.
At the October 17, 2014 and December 10, 2014, BOCC meetings, the BOCC reappointed members to the Monroe
County Affordable Housing Advisory Committee.
In reviewing the Workforce Housing Stakeholder Assessment Report, prepared by the FCRC Consensus Center, the
report includes suggestions to:
• Reconvene the Affordable Housing Advisory Committee to jointly define the workforce problems faced,
review the range of issues and options identified in previous studies and the assessment report, and develop a
package of findings and recommendations over a 7-9 month period.
• Review the current Committee appointments to ensure that a balance of workforce housing stakeholder
perspectives are included in its membership and considering expanding membership to include representation
from of the municipalities in the County, the military, the School Board and perhaps other organizations
impacted by workforce housing policies and programs and with a stake in contributing to solutions to improve
the availability of workforce housing in the Florida Keys.
Staff has prepared a draft ordinance for the BOCC's consideration which outlines the additional suggested members
to the Affordable Housing Advisory Committee, as recommended in the Workforce Housing Stakeholder
Assessment Report. Staff proposed included a representative from the lodging industry as the "other organization
impacted by workforce housing policies," since the BOCC directed developing an inclusionary requirement for
nonresidential and transient development and redevelopment.

FOR AN EFFECTIVE DATE.
WHEREAS, Monroe County, as an Area of Critical State Concern, has adopted
Principles for Guiding Development which includes: Making available adequate affordable
housing for all sectors of the population of the Florida Keys. ; and
WHEREAS, Monroe County has high land values, limited land availability due to its
linear geography and environmental features, controlled growth (the Rate of Growth Ordinance)
and a tourism economy with a prevalence of lower paying service -sector employment; and
WHEREAS, the Board of County Commissioners reconvened the Monroe County
Affordable Housing Advisory Committee to assist with workforce housing issues facing the
County; and
WHEREAS, in August, 2014, the Board of County Commissioners approved an
agreement with the FCRC Consensus Center, FSU, for professional services on an Affordable
Workforce Housing Stakeholder Assessment, in order to assess the current affordable housing
situation in the County and propose a process for developing recommendations; and
WHEREAS, the April 2015 Workforce Housing Stakeholder Assessment Report,
prepared by the FCRC Consensus Center, includes a recommendation to review the current
Committee appointments to ensure that a balance of workforce housing stakeholder perspectives
are included in its membership and considering expanding membership to include representation
from of the municipalities in the County, the military, the School Board and perhaps other
organizations impacted by workforce housing policies and programs and with a stake in
contributing to solutions to improve the availability of workforce housing in the Florida Keys.

NOW, THEREFORE, BE IT ORDAINED BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS:
Section 1. Section 2-700 of the Monroe County Code shall be established as follows (deletions
are str-ieken thfe and additions are underlined):
Sec. 2-700. - Establishment of affordable housing advisory committee.
(a) The affordable housing advisory committee shall be established and operational by June 30,
2008. It shall comply with all requirements in F.S. § 420.9076 (2007) or as subsequently
amended.
(b) The committee shall consist of 4413 members who shall be appointed by the BOCC by
resolution.
(c) The committee must include:
(1) One citizen who is actively engaged in the residential homebuilding industry in
connection with affordable housing.
(2) One citizen who is actively engaged in the banking or mortgage banking industry in
connection with affordable housing.
(3) One citizen who is a representative of those areas of labor actively engaged in home
building in connection with affordable housing.
(4) One citizen who is actively engaged as an advocate for low-income persons in
connection with affordable housing.
(5) One citizen who is actively engaged as a for -profit provider of affordable housing.
(6) One citizen who is actively engaged as a not -for -profit provider of affordable housing.
(7) One citizen who is actively engaged as a real estate professional in connection with
affordable housing.
(8) One citizen who actively serves on the local planning agency pursuant to F.S. §
163.3174.
(9) One citizen who resides within the jurisdiction of the local governing body making the
appointments.
(10) One citizen who represents employers within the jurisdiction.
(11) One citizen who represents essential services personnel, as defined in the local housing
assistance plan.
(12) One citizen who is recommended by the School Board and works for the School Board.
(13) One citizen who is recommended by the lodgingindustry and is impacted by workforce
housing policies.
(d) All meetings of the advisory committee are public meetings, and all committee records are
public records.
(e) Staff, administrative, and facility support to the advisory committee shall be provided by the
BOCC. The advisory committee shall be cooperatively staffed by the local government
department or division having authority to administer local planning or housing programs to
ensure an integrated approach to the work of the advisory committee.
Section 2. Severability.
If any portion of this ordinance is for any reason held invalid or declared to be unconstitutional,
inoperative or void, such holding shall not affect the remaining portions of this ordinance. If this
ordinance or any provision thereof shall be held to be inapplicable to any person, property or

circumstances, such holding shall not affect its applicability to any other person, property or
circumstances.
Section 3. Conflicting Provisions.
All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the
extent of said conflict.
Section 4. Inclusion in the Code of Ordinances.
The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances
of the County of Monroe, Florida, as an addition to amendment thereto, and shall be
appropriately renumbered to conform to the uniform numbering system of the Code.
Section 5. Transmittal and Effective Date.
This Ordinance shall be filed with the Department of State and shall be effective as provided in
section 125.66(2)(b), Florida Statutes.

Mayor Kolb and Commissioners. I am Deb Curlee Vice President of Last Stand and I am speaking
today on behalf of Last Stand.
Last Stand supports the commission's efforts to work on solutions to the affordable housing crisis.
Last Stand has concerns about the following proposed recommendations for the expanded duties of the
advisory committee.
• The comprehensive plan places restraints on several areas included in the proposed
recommendations. Members need to be aware of the restrictions of the ROGO system,
increases in density, highway capacity and evacuation times.
• The DRC is now in the process of addressing height regulations for the comprehensive plan.
• There needs to be a citizen-at-large member of the committee with no financial ties to
affordable housing needs.
Last stand supports the reusing, remodeling and repurposing of existing affordable housing.
The existing definitions of income requirements to qualify for affordable housing need to be updated to
reflect the current incomes of professional and service industry employees.

WORKFORCE HOUSING—BOCC direction to staff—May 20,2015
The Monroe County Planning &Environmental Resources staff shall be tasked to coordinate
with the Monroe County Affordable Housing Advisory Committee and shall be tasked to
work on the following:
1. Amend the Land Development Code based on the a new "workforce" housing
definition;
2. Review and propose Land Development Code amendments for providing housing for
various income levels (very low, low, median and moderate);
3. Review and propose Land Development Code amendments for encouraging
workforce rental housing and for creating a local requirement for management of
rental housing;
4. Propose amendments to the distribution of ROGO allocations by income level;
5. Coordinate with the Land Authority to prioritize the purchase of Tier III properties for
development of workforce housing;
6. To preserve and maintain existing affordable housing, develop a financial incentive to
encourage property owners to extend existing deed restrictions;
7. Identify Tier III and Tier III-A (SPA without native habitat) for workforce housing
sites and audit publicly owned property for suitability for affordable housing on Tier
III properties;
8. Review and propose amendments to statutes to address:
a. Sadowski Trust Fund donor inequity,
b. Allow Land Authority funds to be used for extending deed restrictions or
buying back expired deed restrictions to preserve affordable housing,
c. Amend Low Income Housing Tax Credit (LIHTC) program to require on-site
management longer than 15 years,
d. Amend or increase 1 cent Tourist Impact Tax to provide dedicated funding for
the provision of workforce housing specifically for the hospitality industry;
and
9. Develop and process inclusionary housing requirements for hospitality and
commercial sector to build workforce housing.
The Monroe County Board of County Commissioners and County staff have a goal of
facilitating affordable/workforce housing in conjunction with other partners, including but
not limited to FIRM, and Miami-Dade Transit, as follows:
1. Consider height restrictions in light of Federal flood insurance changes and the
creation of more workforce housing;
2. Creation of development incentives and public-private partnerships, such as a
property tax exemption for workforce housing units;
3. Address related workforce issues due to high cost of housing:
a. Insurance (wind and flood),
b. Childcare,
c. Food insecurity,
d. Living wage,
e. Transportation/Transit,
f. Assistance toward down payment/rental deposit;
4. Address insurance to give commercial properties that are used for workforce
housing the same discount primary homeowners obtain for wind and flood; and
5. Address online marketplace for vacation rentals that connects users with property
to rent with users looking to rent the space(e.g. AirBnB) and its impact on bed tax
revenue.
